Why in the news?<\/h2>\n

The Law commission, in its 287th report, has proposed making certain changes for NRI marriages by revising the pending Registration of Marriage of Non-Resident Indians Bill, 2019 (NRI Bill).<\/p>\n

Issues with NRI marriages<\/h2>\n

1) The Law Commission has highlighted the increase in instances of fraudulent marriages<\/span>. Post marriage, women are being abandoned<\/span> or being financially exploited<\/span>.<\/p>\n

2)\u00a0 Due to lack of proper procedure for registration or verification of the NRI spouses\u2019 claims, women are often left without legal recourse.<\/span><\/p>\n

3) The women are exposed to risks like desertion,<\/span> domestic violence<\/span> and isolation<\/span> from any form of social or familial support while residing in a foreign country.<\/p>\n

1) New Procedure for NRI marriage registration-<\/strong> There will be a new procedure for registering marriages with NRIs. NRIs will have to give notice to the district Marriage Officer<\/span>. The notice will then be displayed for 30 days<\/span> for anyone who would want to object<\/span> to the wedding.<\/p>\n

2) Penal Provisions-<\/strong> Law commission has recommended penal provisions in cases of failure in registering divorce<\/span>, failure in providing maintenance<\/span> and <\/span>child support etc.<\/span><\/p>\n

3) Amendment of Passport Act 1967-<\/strong> It has recommended amendment of the Passport Act, 1967, to include<\/span><\/span> the detail of <\/span>marital<\/span> status<\/span> in a person\u2019s passport.<\/p>\n

4) Separate division to register NRI marriages-<\/strong> It has also recommended creation of a separate division in the Ministry of Home Affairs<\/span> or External Affairs<\/span> to serve as a registry for NRI<\/span> and OCI marriages.<\/span><\/p>\n
