Godavarman Thirumalpad vs. Union of India case. <\/span><br \/>\nThis directive applies while identifying land recorded as forests in Government records under the 2023 amendments to the Forest Conservation Act (1980).<\/p>\n<h2><strong>What was the context of the case that led to the issuance of the interim order?<\/strong><\/h2>\n<figure id=\"attachment_283576\" aria-describedby=\"caption-attachment-283576\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-283576\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/02\/The-Supreme-Court.png?resize=300%2C167&#038;ssl=1\" alt=\"Supreme Court: Use dictionary meaning of \u2018forest'.\" width=\"300\" height=\"167\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/02\/The-Supreme-Court.png?resize=300%2C167&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/02\/The-Supreme-Court.png?w=532&amp;ssl=1 532w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-283576\" class=\"wp-caption-text\"><strong>Source-<\/strong> Hindustan Times<\/figcaption><\/figure>\n<p><strong>1.<\/strong> A bench led by Chief Justice of India issued the interim order during the <span style=\"color: #ff0000;\">hearing of several writ petitions that contested the 2023 amendments to the Forest Conservation Act (1980)<\/span>.<\/p>\n<p><strong>2.<\/strong> The petitioners argued that the <span style=\"color: #ff0000;\">broad definition of &#8216;forest&#8217;<\/span> established in the Godavarman judgment has been <span style=\"color: #ff0000;\">restricted by<\/span> <span style=\"color: #ff0000;\">Section 1A introduced by the 2023 amendment<\/span>.<\/p>\n<p><strong>3.<\/strong> The Court was informed that the <span style=\"color: #ff0000;\">narrowed definition would exclude approximately 1.99 lakh square kilometers of forest land<\/span> from being considered as &#8216;forest&#8217;.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Read more<\/strong>&#8211; <a href=\"https:\/\/forumias.com\/blog\/forest-conservation-amendment-bill-2023-explained-pointwise\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">Forest (Conservation) Amendment Bill, 2023<\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><strong>What did the Supreme Court determine in the recent interim order?<\/strong><\/h2>\n<p><strong>1.<\/strong> The court instructed states and Union territories to <span style=\"color: #ff0000;\">temporarily apply the dictionary definition of &#8220;forest&#8221; when evaluating land activities<\/span>. Under Rule 16, the principles outlined in the TN Godavarman judgment must continue to be followed.<\/p>\n<p><strong>2.<\/strong> The Court <span style=\"color: #ff0000;\">instructed the Union of India<\/span> to <span style=\"color: #ff0000;\">request detailed records from all States\/UTs regarding lands identified as forests<\/span> by their respective expert committees, in accordance with the TN Godavarman judgment.<\/p>\n<p><strong>3.<\/strong> The court also <span style=\"color: #ff0000;\">prohibited the establishment of zoos<\/span> or <span style=\"color: #ff0000;\">safaris<\/span> in these areas <span style=\"color: #ff0000;\">without prior court approval<\/span>.<\/p>\n<h2><strong>What was TN.Godavarman Thirumulpad v Union of India (1996) judgement?<\/strong><\/h2>\n<p><strong>1.<\/strong> <strong>Background<\/strong>:<br \/>\n<strong>a.<\/strong> The Forest conservation act 1980 aims to safeguard India\u2019s forests from industrial exploitation and promote reforestation.<br \/>\n<strong>b.<\/strong> It grants the <span style=\"color: #ff0000;\">Central government authority to regulate the extraction of forest resources<\/span>, including timber, bamboo, coal, and minerals, by industries and forest-dwelling communities.<br \/>\n<strong>c.<\/strong> However, this protection<span style=\"color: #ff0000;\"> applies only to areas<\/span> officially <span style=\"color: #ff0000;\">designated as &#8216;forest&#8217; in Central<\/span> or <span style=\"color: #ff0000;\">State government records<\/span>.<\/p>\n<p><strong>2.<\/strong> The <span style=\"color: #ff0000;\">Supreme Court&#8217;s ruling<\/span> in the TN.Godavarman Thirumulpad v Union of India (1996) case <span style=\"color: #ff0000;\">broadened the protection of forests<\/span>.<\/p>\n<p><strong>3.\u00a0<\/strong> According to the ruling, areas that meet the &#8216;<span style=\"color: #ff0000;\">dictionary<\/span>&#8216; definition of forests are protected, <span style=\"color: #ff0000;\">even if they have not been officially notified by the government<\/span> or <span style=\"color: #ff0000;\">recorded in historical documents.<br \/>\n<\/span><\/p>\n<p><strong>Note<\/strong>&#8211; Currently in India, there is <span style=\"color: #ff0000;\">no universally accepted definition of &#8216;forest&#8217;<\/span>.
