{"id":283748,"date":"2024-02-21T19:00:09","date_gmt":"2024-02-21T13:30:09","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=283748"},"modified":"2024-02-21T18:51:40","modified_gmt":"2024-02-21T13:21:40","slug":"forest-conservation-amendment-bill-2023-explained-pointwise","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/forest-conservation-amendment-bill-2023-explained-pointwise\/","title":{"rendered":"SC Interim Order on Forest (Conservation) Amendment Act 2023- Explained Pointwise"},"content":{"rendered":"<p>Supreme Court (SC), in its <span style=\"color: #ff0000;\">interim Order<\/span> on the <span style=\"color: #333333;\">PIL challenging the constitutionality of the Forest (Conservation) Amendment\u00a0Act 2023<\/span>, has asked the <span style=\"color: #333333;\">States<\/span> and <span style=\"color: #333333;\">Union Territories<\/span> (UT) to ensure compliance with the &#8216;<span style=\"color: #ff0000;\">definition of Forest<\/span>&#8216; as laid down in the <span style=\"color: #ff0000;\">TN Godavarman Thirumalpad v. This process of preparation of records is still underway. The petitioners raised the <span style=\"color: #ff0000;\">apprehension <span style=\"color: #333333;\">about lands-<\/span><\/span> which are \u2018<span style=\"color: #ff0000;\">forests<\/span>\u2019 as <span style=\"color: #ff0000;\">per the Godavarman judgement<\/span>&#8211; <span style=\"color: #ff0000;\">getting diverted for non-forest use in the meantime<\/span>.<\/p>\n<p><strong>SC Order-<\/strong><br \/>\n(1) Till the time the records on forest land is not prepared, the States and UTs must <span style=\"color: #ff0000;\">ensure<\/span> <span style=\"color: #ff0000;\">compliance<\/span> with the &#8216;<span style=\"color: #ff0000;\">definition of Forest<\/span>&#8216; as enunciated in the <span style=\"color: #ff0000;\">Godavaram Judgement<\/span>.<\/p>\n<p>(2) Centre has to <span style=\"color: #ff0000;\">submit to a comprehensive record<\/span> of land registered as \u2018forest\u2019 by expert committees constituted by states and UTs as per the guidelines laid by the TN Godavarman judgement. The record has to be submitted within a period of two weeks.<\/p>\n<p><strong>Note-<\/strong> T.N. Godavarman Thirumulpad judgement brought in the concept of \u2018deemed forests,\u2019 or tracts. These tracts were not officially classified as such in government or revenue records. States were asked to constitute expert committees to identify such \u2018deemed forests.\u2019<\/p>\n<p>(3) The <span style=\"color: #ff0000;\">Expert Committees which have been constituted as per Rule 16 of the 2023 Rules<\/span> shall duly bear in mind, the work carried out by the previous expert committees, formed as per the Godavarman judgement. They have the liberty to expand the ambit of forest lands which are worthy of protection.<\/p>\n<p><strong>Petitioners Contention-2-<\/strong> The petitioners had highlighted apprehensions about <span style=\"color: #ff0000;\">Section 5 of the Forest (Conservation) Amendment Act, 2023<\/span>. This section <span style=\"color: #ff0000;\">exempts the Zoos and safaris<\/span> referred to in the Wild Life (Protection) Act, 1972, <span style=\"color: #ff0000;\">from the definition of \u2018forests\u2019<\/span>.<\/p>\n<p><strong>SC Order-<\/strong> Any proposal for the establishment of zoo\/safaris shall not be finally approved without the permission of the SC.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">Read More- <a href=\"https:\/\/forumias.com\/blog\/states-uts-must-adhere-to-the-forest-definition-from-the-godavarman-judgment-sc\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">States\/UTs must adhere to the forest definition from the Godavarman judgment-SC<\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><strong><span style=\"color: #000000;\"><a id=\"toc2\"><\/a>What is the Forest (Conservation) Amendment Act 2023?<\/span><\/strong><\/h2>\n<p>The Forest (Conservation) Amendment Act, 2023, amended the Forest (Conservation) Act, 1980. Its objective is to promote sustainable development while conserving India\u2019s forests and biodiversity.<\/p>\n<p><span style=\"color: #000000;\"><strong>Land under the purview of the Act-<\/strong><\/span> The Act provides two types of land that will be under the purview of the Act-<br \/>\n(i) <span style=\"color: #ff0000;\">land notified as a forest under the Indian Forest Act, 1927<\/span> or under any other law,<br \/>\n(ii) land not covered in the first category but <span style=\"color: #ff0000;\">notified as a forest on or after October 25, 1980 in a government record<\/span>.<\/p>\n<p><strong><span style=\"color: #000000;\">Exempted categories of Forest land-<\/span><\/strong> Certain types of forest land are exempted from the provisions of the Act, such as:<\/p>\n<p>(i) <span style=\"color: #ff0000;\">Forest land along a rail line or a public road<\/span> maintained by the government providing access to a habitation, or to a rail, and roadside amenities up to a maximum size of 0.10 hectare.<\/p>\n<p>(ii) <span style=\"color: #ff0000;\">Forest land situated within 100 km from international borders<\/span>, Line of Control, or Line of Actual Control, for construction of a strategic linear project of national importance and concerning national security<\/p>\n<p>(iii) <span style=\"color: #ff0000;\">Forest land,<\/span> up to 10 hectares, for <span style=\"color: #ff0000;\">constructing security-related infrastructure<\/span>.<\/p>\n<p>(iv) <span style=\"color: #ff0000;\">Forest land<\/span> proposed to be used for constructing defence related projects, camps for paramilitary forces, or public utility projects up to <span style=\"color: #ff0000;\">five hectares in a left-wing extremism affected area<\/span>.<\/p>\n<p><span style=\"color: #000000;\"><strong>Permitted activities in forest land- <\/strong><\/span>The Amendment Act <span style=\"color: #ff0000;\">adds more activities to the list of permitted activities in forest land<\/span>, such as:<br \/>\n(i) zoos and safaris under the Wild Life (Protection) Act, 1972<br \/>\n(ii) ecotourism facilities,<br \/>\n(iii) silvicultural operations and<br \/>\n(iv) any other purpose specified by the central government.<\/p>\n<p><strong>Power to issue directions-<\/strong> The amendment added that the central government may issue directions for the implementation of the Act to any authority\/organization under or recognised by the centre, state, or union territory<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">Read More- <a href=\"https:\/\/forumias.com\/blog\/objections-overruled-forest-bill-goes-to-house-unchanged\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">Amendment Act 2023- Provisions<\/a><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What was the Govt&#8217;s rationale for the Introduction of Forest (Conservation) Amendment Act 2023?<\/strong><\/span><\/h2>\n<p><strong>1. Clarity in Interpretation of Forest Land- <\/strong><span style=\"color: #333333;\">With the SC judgement in <span style=\"color: #ff0000;\">Godavarman case<\/span>, ambiguities arose in the applicability of FCA to lands that looked like forests, private forest lands, and plantations. The amendment makes the FCA applicable <span style=\"color: #ff0000;\">only to notified forests<\/span> and <span style=\"color: #ff0000;\">lands that were identified as \u2018forest\u2019 in government records<\/span>.<\/span><\/p>\n<p><strong>2. Fastening of Approval Process-<\/strong> The Forest Conservation Act,1980 required <span style=\"color: #ff0000;\">consent from numerous authorities at the state and national levels<\/span> before engaging in any non-forest activity in an area designated as \u2018forest.\u2019 This approval process was very <span style=\"color: #ff0000;\">difficult and challenging<\/span>.<\/p>\n<p><strong>3. Creation of additional carbon sink-<\/strong> There were concerns about the applicability of Forest Conservation Act 1980, on private plantations, after the expanded definition of forest in the <span style=\"color: #ff0000;\">Godavarman Case<\/span>. This was <span style=\"color: #ff0000;\">impeding afforestation and tree plantation efforts outside official forest areas<\/span>, and was an obstacle in the creation of additional carbon sinks.<\/p>\n<p><strong>4. Development of Security Infrastructure-<\/strong> The amendment will expedite the development of essential security infrastructure, <span style=\"color: #ff0000;\">particularly along international border<\/span> <span style=\"color: #ff0000;\">areas<\/span> like the Line of Actual Control (LAC) and Line of Control (LoC), as well as in <span style=\"color: #ff0000;\">notified Left-Wing Extremism regions<\/span>.<\/p>\n<p><strong>5. Promotion of Agroforestry-<\/strong> The Amendment encourages private forests and agroforestry projects because these <span style=\"color: #ff0000;\">would not be considered forests under the FCA 1980<\/span>.<\/p>\n<p><strong>6. Better forest management-<\/strong> The <span style=\"color: #ff0000;\">inclusion of additional activities<\/span> in the forest land, such as <span style=\"color: #ff0000;\">creation of infrastructure for frontline forest staff<\/span>, will facilitate a swift response to natural hazards in forested areas.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What are the Concerns with the Forest Conservation Amendment Act 2023?<\/strong><\/span><\/h2>\n<p><strong>1. Exclusion of Forest areas from the purview of the original Act-<\/strong> <span style=\"color: #ff0000;\">Section 1A<\/span> inserted by the 2023 amendment has <span style=\"color: #ff0000;\">narrowed the expansive definition of<\/span> \u2018<span style=\"color: #ff0000;\">forest<\/span>\u2019 given in the <span style=\"color: #ff0000;\">Godavarman judgement<\/span>. This amended FCA is only applicable to notified forest land and the land classified as forest as part of Govt record.<br \/>\nThe Joint Parliamentary Committee (JPC) and the critics have pointed to the <span style=\"color: #ff0000;\">potential exclusion of 28% of India\u2019s forests<\/span> that lie outside Recorded Forest Areas from the purview of the amended FC Act.<\/p>\n<p><strong>2. Exclusion of fragile ecosystems which require protection-<\/strong> The Amended Act excludes some of India\u2019s most delicate ecosystems, by exempting the requirement for forest clearances for security-related infrastructure within 100 km of international borders. These include globally recognized biodiversity hotspots such as the <span style=\"color: #ff0000;\">forests of northeastern India<\/span> and <span style=\"color: #ff0000;\">high-altitude Himalayan forests and meadows<\/span>.<\/p>\n<p><strong>3. Concerns about the exemptions granted in Forest Areas-<\/strong> The additional exemptions in the Amended FCA like <span style=\"color: #ff0000;\">construction of Zoo safaris<\/span> and <span style=\"color: #ff0000;\">eco-tourism facilities<\/span>, raise concerns about potential exploitation of forest resources without adequate environmental scrutiny.<\/p>\n<p><strong>4. Concerns regarding Centralization of Power-<\/strong> The Amended Act has raised serious concerns regarding the enhanced powers of the Central Govt in diversion of forest land for strategic purposes. <span style=\"color: #ff0000;\">States like Nagaland and Sikkim have expressed serious worries<\/span> over the potential impact on their territories.<\/p>\n<p><strong>5. Disenfranchisement of local Forest Dwellers-<\/strong> The Amended Act has excluded certain forest areas and <span style=\"color: #ff0000;\">simplified the diversion process of forests for non-forestry use<\/span>. This might lead to the disenfranchisement of <span style=\"color: #ff0000;\">local forest dwellers<\/span>, who were <span style=\"color: #ff0000;\">provided consultation rights<\/span> in case of any forest land diversion by the <span style=\"color: #ff0000;\">Forest Rights Act,2006.<\/span><\/p>\n<h2><strong><span style=\"color: #000000;\"><a id=\"toc5\"><\/a>What Should be the Way Forward?<\/span><\/strong><\/h2>\n<p><strong>1. Earliest completion of ground surveys by the expert committee-<\/strong> The<span style=\"color: #ff0000;\"> expert committee constituted under Rule 16 of the Act<\/span> must ensure to complete its report of recording the forest areas at the earliest.<\/p>\n<p><strong>2. Balance development and conservation-<\/strong> We must try to maintain a balance between development projects and forest conservation. <span style=\"color: #ff0000;\">Environment &amp; social cost of Project should be in line with forest conservation<\/span>.<\/p>\n<p><strong>3. Respecting the rights of Indigenous and forest community rights-<\/strong> The <span style=\"color: #ff0000;\">consent of local forest dwellers must be sought<\/span> in case of diversion of forest land for non-forest purpose.<\/p>\n<p><strong>4.
