Why in the News?<\/h2>\n

The Supreme Court, in its recent judgment on the Chandigarh mayor election<\/span>, utilized its authority under Article 142 of the Constitution to ensure ‘complete justice’ and uphold the sanctity of electoral democracy.<\/p>\n

What is Article 142 of the Constitution?<\/h2>\n

1. About- <\/strong>Article 142 grants the Supreme Court<\/span> discretionary authority<\/span>. It empowers<\/span> it to issue decrees<\/span> or orders deemed necessary to achieve complete justice in any pending cause<\/span> or matter within its jurisdiction<\/span>.<\/p>\n

2<\/strong>. Positive utilisation<\/strong>– This provision allows the Supreme Court to exercise wide-ranging powers to ensure justice is served, even if there is no specific law<\/span> or provision applicable<\/span> to the case at hand.<\/p>\n

Significant cases where article 142 was invoked<\/h2>\n

1.<\/strong> The ban on the sale of alcohol along national and state highways<\/strong>:
\na.<\/strong> The central government’s notification banned liquor stores only along National Highways<\/span>, but the Supreme Court extended the ban to a distance of 500 meters by using Article 142<\/span>.
\nb.<\/strong> Moreover, in the absence of similar notifications from any State governments, the court expanded the prohibition to include State highways.
\nc.<\/strong> Such rulings have raised questions about the court’s discretion to invoke Article 142, particularly when fundamental rights of individuals are overlooked.<\/p>\n

2. Babri Masjid Case<\/strong>: Article 142 was invoked in the Ram Janmabhoomi-Babri Masjid land dispute, leading to the transfer of the disputed land to a trust to be established by the central government.<\/p>\n\n\n\n
