The <span style=\"color: #ff0000;\">Parliamentary Standing Committee<\/span> on Personnel, Public Grievances, Law and Justice apprised the Lok Sabha, that the <span style=\"color: #ff0000;\">Law Ministry has accepted its recommendation to establish regional benches of the Supreme Court<\/span> across India.<\/p>\n<p>However, the standing committee report also pointed out that the <span style=\"color: #ff0000;\">Supreme Court<\/span> has been \u201c<span style=\"color: #ff0000;\">consistently<\/span>\u201d <span style=\"color: #ff0000;\">rejecting the idea<\/span> of establishment of regional benches. Many countries around the world have instituted Courts of Cassation that decide cases involving non-Constitutional disputes and appeals from the lower level of courts. These are courts of last resort that have the power to reverse decisions of lower courts. (Cassation: annulment, cancellation, reversal).<\/p>\n<p><span style=\"color: #000000;\"><strong>Recommendations of Standing Committees of Parliament-<\/strong><\/span> Standing Committees of Parliament in <span style=\"color: #ff0000;\">2004<\/span>, <span style=\"color: #ff0000;\">2005<\/span>, and <span style=\"color: #ff0000;\">2006, <\/span><span style=\"color: #ff0000;\"><span style=\"color: #333333;\">also<\/span> recommended<\/span> the establishment of regional benches.<\/p>\n<h2><strong><span style=\"color: #000000;\"><a id=\"toc2\"><\/a>What are the reasons behind the demand for Regional Benches of Supreme Court?<\/span><\/strong><\/h2>\n<p><strong>1. Geographical Bias in cases filed before the SC- <\/strong>There exists a geographical bias in cases filed before the SC, as <span style=\"color: #ff0000;\">the majority of<\/span><span style=\"color: #ff0000;\"><span style=\"color: #333333;\"> cases before the Supreme Court<\/span> are from High Courts close to Delhi<\/span>.<\/p>\n<p><strong>2. Geographical barrier hindering citizen judicial activism-<\/strong> Citizen judicial activism has increased in recent years, with more citizens approaching the SC with PILs against the arbitrary or unjust actions of the state. However, the seat of SC only at Delhi, <span style=\"color: #ff0000;\">has created geographical barriers for many citizens to directly approach the Supreme court<\/span>.<\/p>\n<p><strong>3. Disproportionate impact on Lawyer&#8217;s careers-<\/strong> The location of Supreme Court at Delhi has disproportionately impacted the legal careers of lawyers <span style=\"color: #ff0000;\">who cannot afford to relocate to Delhi<\/span>.<\/p>\n<p><strong>4. Legal Marginalization of the Underprivileged-<\/strong> The location of SC makes it difficult for extensively underprivileged people living in the remotest areas of the country, as <span style=\"color: #ff0000;\">travelling to New Delhi<\/span> or <span style=\"color: #ff0000;\">engaging expensive Supreme Court counsel<\/span> to pursue a case is beyond the means of most litigants.<\/p>\n<p><strong>5. International examples-<\/strong> <span style=\"color: #ff0000;\">France<\/span>, <span style=\"color: #ff0000;\">US<\/span> have <span style=\"color: #ff0000;\">separated the court of appeal<\/span> and <span style=\"color: #ff0000;\">courts of cassation<\/span>, which has reduced the burden on their top-most judiciary.<\/p>\n<h2><strong><a id=\"toc3\"><\/a><span style=\"color: #000000;\">What will be the advantages of these regional benches of Supreme Court?<\/span><\/strong><\/h2>\n<p><strong>1. Fulfilment of Constitutional Mandate of Article 39A-<\/strong>\u00a0<span style=\"color: #333333;\">Article 39A of the constitution provides for <span style=\"color: #ff0000;\">the state to secure equitable access to justice for all<\/span>. The regional benches will help in ensuring that justice reaches the doorsteps of citizens.<\/span><\/p>\n<p><strong>2. Reduction of Judicial Pendency-<\/strong> <span style=\"color: #ff0000;\">More than 80,000 cases<\/span> are currently pending adjudication in the<span style=\"color: #ff0000;\"> overburdened Supreme Court<\/span>. The establishment of regional benches will increase the number of judges as well as lawyers in the SC and will boost the rate of case disposal.<\/p>\n<p><strong>3. Enhanced Focus on Constitutional matters- <\/strong>T<span style=\"color: #333333;\">he <span style=\"color: #ff0000;\">principal bench in Delhi can exclusively focus on constitutional matters<\/span>, while the <\/span>regional benches can discharge appellate functions. The SC judges at the Principal court <span style=\"color: #ff0000;\">will get adequate time to properly scrutinise<\/span> and <span style=\"color: #ff0000;\">pronounce impactful judgments<\/span> in constitutional matters.<\/p>\n<p><strong>4. Democratisation of the SC Bar-<\/strong> The setting up of regional benches of SC, would lead to democratisation of the SC Bar by securing greater opportunities for lawyers belonging to different geographical regions. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Division of<\/span> <span style=\"color: #ff0000;\">the jurisdiction<\/span> of the <span style=\"color: #ff0000;\">Tis Hazari Court<\/span> into three different district courts of <span style=\"color: #ff0000;\">Saket<\/span>, <span style=\"color: #ff0000;\">Rohini<\/span>, and <span style=\"color: #ff0000;\">Karkardooma<\/span>, has <span style=\"color: #ff0000;\">increased opportunities for young judges<\/span>.<\/p>\n<h2><strong><span style=\"color: #000000;\"><a id=\"toc4\"><\/a>What are the arguments against the idea of Regional benches?<\/span><\/strong><\/h2>\n<p><strong>1. Dilution of sacrosanct nature of the Supreme Court-<\/strong> Critics argue that the idea of setting up regional benches will lead to Balkanization of the Supreme Court and <span style=\"color: #ff0000;\">lessen the binding force of the decisions<\/span> of the Supreme Court.<\/p>\n<p><strong><span style=\"color: #333333;\">2. Issue of Territorial jurisdiction and divergent views of Justice-<\/span><\/strong> The regional benches can create conflict by <span style=\"color: #ff0000;\">interfering in the territorial jurisdiction of the HCs<\/span>. Also, there are challenges of <span style=\"color: #ff0000;\">emergence of divergent views<\/span> which may adversely affect our justice system.<\/p>\n<p><strong>3. Increase in litigations- <\/strong>There are concerns regarding the increase in litigation due to <span style=\"color: #ff0000;\">frivolous petitions<\/span> being filed with easier access to justice.<\/p>\n<p><strong>4. Huge infrastructural Cost-<\/strong> The establishment of regional benches of SC entails huge infrastructural cost in terms of <span style=\"color: #ff0000;\">Money<\/span> and <span style=\"color: #ff0000;\">Human resources<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc5\"><\/a>What should be the way forward?<\/strong><\/span><\/h2>\n<p>Since the matter of regional benches is sub-judice, in the meantime we can adopt the following measures to enhance citizen&#8217;s accessibility to Justice from the SC.<\/p>\n<p><strong>1. Mechanism for Virtual Hearing in SC-<\/strong> Virtual hearings by can well be an alternative to regional benches. A mechanism for virtual hearing in the SC can be put in place, where <span style=\"color: #ff0000;\">preliminary and admission hearings<\/span> are conducted virtually, while the <span style=\"color: #ff0000;\">final hearings are conducted physically<\/span>.<\/p>\n<p><strong>2. Mechanism for Filing SLPs-<\/strong> Special Leave Petitions (<span style=\"color: #ff0000;\">SLPs<\/span>) constitute over <span style=\"color: #ff0000;\">90% of the Supreme Court\u2019s case docket<\/span>. A mechanism should be put in place where the <span style=\"color: #ff0000;\">Supreme Court would admit only those SLPs<span style=\"color: #333333;\">,<\/span> <\/span>which have been <span style=\"color: #ff0000;\">certified by the concerned High Courts<\/span>.<\/p>\n<p><strong>3. Improving the efficiency of the existing courts-<\/strong> The <span style=\"color: #ff0000;\">judicial vacancies<\/span>, <span style=\"color: #ff0000;\">Judicial infrastructure<\/span> and <span style=\"color: #ff0000;\">Judicial Processes<\/span> must be streamlined, would reduce the problem of Judicial pendency. <strong>For ex-<\/strong> <a href=\"https:\/\/forumias.com\/blog\/upsc-current-affairs-news\/all-india-judicial-service-aijs\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">All-India Judicial Service<\/a> to boost the quality of judicial appointments.<\/p>\n<p><strong>4. Mechanism for Scrutiny of cases-<\/strong> The SC must also put in place a mechanism for scrutinising the types of petitions that are permitted to be admitted in the top court. <span style=\"color: #ff0000;\">Transfer petitions<\/span>, <span style=\"color: #ff0000;\">arbitral appeals<\/span> must be transferred to the <span style=\"color: #ff0000;\">respective HCs<\/span>.<\/p>\n<p><strong>5.
