For ex-deepfake videos of <strong>Indian Prime minister.<\/strong><\/p>\n<p><strong>2) Weaponization of social media<\/strong>&#8211; Deepfake videos evoke emotions and exaggerate<strong> confirmation bias <\/strong>by spreading<strong> more misinformation on<\/strong> social media platforms.<\/p>\n<p><strong>3)<\/strong> <strong>External election interference-<\/strong> Digital businesses can create context-specific fake videos for politicians and<strong> foreign powers<\/strong>. These fake videos may be abused by<strong> hostile foreign countries <\/strong>to threaten the integrity of Indian elections.<\/p>\n<h2><strong>What are the issues in regulating deepfakes?<\/strong><\/h2>\n<p>The April 2023 amendment to IT rules empowers the<strong> central government<\/strong> to instruct social media platforms and intermediaries to remove deepfakes or objectionable content. There are certain issues:<br \/>\n<strong>A)<\/strong> This provision may be abused by<strong> the ruling party<\/strong> for targeting political adversaries.<\/p>\n<p><strong>B)<\/strong> The current IT rules focus on content takedown but do not provide<strong> penal provisions<\/strong> for creating deepfakes.<\/p>\n<p><strong>C)<\/strong> The <strong>Bhartiya Nyaya Sanhita <\/strong>places the burden of proof on the <strong>prosecution<\/strong> for establishing deep fake related crime.<\/p>\n<p><strong>D)<\/strong> Most deepfakes are uploaded from <strong>abroad<\/strong> with masked entities. However, Indian law does not have<strong> extra-territorial jurisdiction<\/strong> to prosecute entities outside India which endangers Indias interest.<\/p>\n<h2><strong>What steps can be taken to preserve the sanctity of the electoral process?<\/strong><\/h2>\n<p><strong>1) Continuous monitoring<\/strong>&#8211; The ECI (Election Commission of India) can continuously monitor social media posts which are trending. The ECI may collaborate with IITs to deploy <strong>Fakecatcher technology <\/strong>which is capable of identifying <strong>tampered videos<\/strong> in real-time.<\/p>\n<p><strong>2) Empowering the ECI<\/strong>&#8211; There is a need to amend the IT rules to grant the <strong>ECI<\/strong> the power to <strong>directly instruct<\/strong> intermediaries to take down fake videos. This will also ensure political neutrality.<\/p>\n<p><strong>3) Overcoming regulatory hurdles-<\/strong><br \/>\na) The IT rules need to be amended to put the burden of proof on fake content creators. There should be<strong> penal provision<\/strong> for creating deepfakes.<br \/>\nb) There should be enactment of some laws which can be <strong>extra-territorial<\/strong> in nature.<\/p>\n<p><strong>4) Global Cooperation<\/strong>&#8211; This involves collaborating with global platforms to share information regarding <strong>uploads<\/strong>, assistance in <strong>investigation<\/strong> and quick <strong>removal <\/strong>of objectionable content.<\/p>\n<p><strong>Conclusion:<\/strong> Deepfake poses a great challenge to the 2024 general elections.
