Why in the News?<\/h2>\n

The Union Home Ministry has declared two factions of the Muslim Conference of Jammu and Kashmir (MCJK) as “unlawful associations<\/span>” under the anti-terror Unlawful Activities (Prevention) Act (UAPA).<\/p>\n

The government said these groups have been involved in actions against the nation’s sovereignty<\/span> and integrity.<\/span><\/p>\n

What is Unlawful Activities (Prevention) Act (UAPA)?<\/h2>\n

1. About<\/strong>– UAPA is the primary counter-terrorism law<\/span> in India.<\/p>\n

2. Enacted<\/strong>– It was enacted in 1967.<\/p>\n

3. Objective<\/strong>– To enhance the prevention of unlawful activities by both individuals<\/span> and groups<\/span>, to combat terrorism, and to more effectively address actions that threaten the integrity and sovereignty of India.<\/p>\n

4. Activities include<\/strong>:
\na.<\/strong> Assisting and supporting terrorists
\nb.<\/strong> Funding terrorists
\nc.<\/strong> Encouraging anti-national sentiments among the public
\nd.<\/strong> Other unlawful activities against the state<\/p>\n

What are the Key provisions of UAPA ?<\/h2>\n

1. Applicability<\/strong>– The law applies even if the offenses occur outside of India<\/span>. Both<\/span> Indian<\/span> citizens<\/span> and foreign nationals can face charges<\/span>.<\/p>\n

2. Wide powers to Centre<\/strong>– The Central Government is granted extensive authority to designate organizations as terrorist entities<\/span>. It also prescribe the penalties for involvement in the activities of such organizations.<\/p>\n

3. Charge sheet<\/strong>: The investigating agency can file a charge sheet in a maximum of 180 days<\/span> after the arrests and the duration can be extended further after intimating the court.<\/p>\n

4. Unlawful association provision<\/strong>– Under section 3 of the UAPA Act<\/span>, the government has powers to declare an association ‘unlawful’.<\/p>\n

5. Appeal against the Ban<\/strong>:
\na.<\/strong> Within 30 days of notification<\/span>, the government must establish a tribunal led by a sitting High Court Judge<\/span> to review evidence and allegations.
\nb.<\/strong> The tribunal can examine evidence, listen to objections from the organization or its members\/supporters, and decide whether to confirm<\/span> or reject the ban.<\/span><\/p>\n\n\n\n
