Constitutional Provision<\/strong>: According to<span style=\"color: #ff0000;\"> Article 80<\/span> of the Constitution, Rajya Sabha representatives from each State are <span style=\"color: #ff0000;\">indirectly elected<\/span> by the elected members of their Legislative Assembly.<\/p>\n<p><strong>2. Historical background<\/strong>&#8211;<span style=\"color: #ff0000;\"> Before 1998<\/span>, the <span style=\"color: #ff0000;\">outcome of Rajya Sabha elections<\/span> were usually a <span style=\"color: #ff0000;\">foregone conclusion<\/span>, as the candidates were nominated by various parties in accordance to their strength in the Assembly. Hence, they used to be elected unopposed.\u00a0<span style=\"color: #333333;\">However<\/span>, the<span style=\"color: #ff0000;\"> June 1998 elections in Maharashtra saw cross-voting<\/span>, breaking this tradition.<\/p>\n<h2>Legal provisions and precedent for curbing cross voting<\/h2>\n<p><strong>1. Open Ballot system:<\/strong><br \/>\n<strong>a.<\/strong> To prevent MLAs from cross-voting, an <span style=\"color: #333333;\"><span style=\"color: #ff0000;\">amendment<\/span> to Section 59 of <a style=\"color: #333333;\" href=\"https:\/\/forumias.com\/blog\/answereddiscuss-various-provisions-of-disqualifications-under-representation-of-peoples-act-do-you-think-these-provisions-have-helped-in-decriminalising-indian-politics\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">Representation of the People Act, 1951<\/a><\/span> was made in 2003. This amendment <span style=\"color: #ff0000;\">introduced open ballot voting in Rajya Sabha elections.<\/span><br \/>\n<strong>b.<\/strong> MLAs from political parties <span style=\"color: #ff0000;\">must display their ballot papers to their party&#8217;s authorized agent.<\/span> Failure to do so or showing it to anyone else will invalidate the vote. <span style=\"color: #ff0000;\">Independent MLAs cannot show their ballots to anyone<\/span>.<\/p>\n<p><strong>2. Tenth Schedule:<\/strong><br \/>\n<strong>a.<\/strong> It introduced in 1985.<br \/>\n<strong>b.<\/strong> This schedule states that if a member of a Parliament or State legislature <span style=\"color: #333333;\">voluntarily leaves their political party<\/span> or <span style=\"color: #333333;\">votes against their party&#8217;s instructions<\/span>, they <span style=\"color: #ff0000;\">can be disqualified from the House<\/span>. SC Court Rulings:<br \/>\na.<\/strong> The Supreme Court in <span style=\"color: #ff0000;\">Kuldip Nayar versus Union of India (2006)<\/span>, upheld the system of open ballot for Rajya Sabha elections.<br \/>\n<strong>b.<\/strong> In the same case, the court also decided that a political party&#8217;s elected MLA <span style=\"color: #ff0000;\">would not be disqualified under the Tenth Schedule<\/span> for voting against their party candidate.
