The Court stated that a Supreme Court bench in 2018 did not have the authority to establish a six-month time limit for lifting stay orders.<\/p>\n<h2>What did the 2018 bench rule in the Asian Resurfacing case?<\/h2>\n<figure id=\"attachment_285385\" aria-describedby=\"caption-attachment-285385\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-285385\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/03\/Supreme-court-stay-order-decision-1.png?resize=300%2C172&#038;ssl=1\" alt=\"Supreme court overruled its stay order decision\" width=\"300\" height=\"172\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/03\/Supreme-court-stay-order-decision-1.png?resize=300%2C172&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/03\/Supreme-court-stay-order-decision-1.png?w=531&amp;ssl=1 531w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-285385\" class=\"wp-caption-text\">Source- Hindustan Times<\/figcaption><\/figure>\n<p><strong>Background:<\/strong><br \/>\n<strong>a.<\/strong> In 2018, a three-judge bench comprising Justices Adarsh Goel, Navin Sinha and Rohinton Nariman were deciding a batch of cases involving the <a href=\"https:\/\/forumias.com\/blog\/prevention-of-corruption-amendment-bill-2018\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">Prevention of Corruption Act<\/a>.<br \/>\n<strong>b. <\/strong>These cases had one thing in common: the respective High Courts had granted a stay at some point during the trial.<br \/>\n<strong>c. <\/strong><span style=\"color: #ff0000;\">Stay orders<\/span> are issued by courts to <span style=\"color: #ff0000;\">temporarily halt legal proceedings<\/span>, protecting citizens&#8217; rights. A stay always postpones the trial, regardless of who benefits from it.<\/p>\n<p><strong>SC 2018 ruling in Asian Resurfacing case<\/strong>&#8211; To tackle the significant issue of delays in criminal trials, the Supreme Court ruled that<span style=\"color: #ff0000;\"> interim stay orders from High Courts and Civil Courts will only last for six months<\/span>. At the conclusion of this duration, they will be automatically revoked or &#8220;lifted&#8221;.<\/p>\n<p><strong>Impact of 2018 ruling<\/strong><\/p>\n<p>This decision raised several questions as follows:<\/p>\n<p><strong>Question 1<\/strong>&#8211; Can the Supreme Court, under <span style=\"color: #ff0000;\">Article 142<\/span> of the Constitution (which empowers it to pass any order to ensure &#8220;complete justice&#8221;), order the automatic removal of all interim orders from High Courts that suspend proceedings of civil and criminal cases after a certain period has expired?<\/p>\n<p><strong>Question 2- <\/strong>Can the Supreme Court, under Article 142 of the Constitution, instruct the High Courts to resolve pending cases where interim stay orders on proceedings have been issued, on a daily basis and within a set timeframe?<\/p>\n<h2>Why was the 2018 ruling reversed?<\/h2>\n<p><strong>1. Lacked authority to set a timeline<\/strong>&#8211; The court ruled that the Asian Resurfacing bench lacked the authority to establish a six-month deadline for lifting stay orders.<\/p>\n<p><strong>2.<\/strong> <strong>Defeat justice<\/strong>&#8211; The court stated that automatically lifting a stay order after six months would actually &#8220;defeat justice&#8221; by invalidating interim orders that had been legally issued without hearing the parties.<\/p>\n<p><strong>3.<\/strong> <strong>Only legislature have the power<\/strong>&#8211; The court mentioned that the six-month limit would be like creating laws from the bench, which is not allowed.
