The Supreme Court <span style=\"color: #ff0000;\">overruled its judgment in the JMM bribery case of 1998.<\/span><\/p>\n<p><strong>Background<\/strong>&#8211; In 1993, JMM leader Shibu Soren and some of his party MPs were accused of accepting bribes to vote against the <a href=\"https:\/\/forumias.com\/blog\/what-is-a-no-confidence-motion\/#gsc.tab=0\" target=\"_blank\" rel=\"noopener\">no-confidence motion<\/a> against the then P V Narasimha Rao government. <span style=\"color: #ff0000;\">In 1998, a five-judge Supreme Court bench<\/span>, in its majority ruling, <span style=\"color: #ff0000;\">dismissed the case<\/span> against the JMM MPs, <span style=\"color: #ff0000;\">citing immunity under Article 105(2)<\/span>.<\/p>\n<h2><strong>What was the recent ruling by the Supreme Court?<\/strong><\/h2>\n<figure id=\"attachment_285710\" aria-describedby=\"caption-attachment-285710\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-285710\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/03\/No-immunity-for-MPs-MLAs-in-bribery-cases.png?resize=300%2C171&#038;ssl=1\" alt=\"No immunity for MPs, MLAs in bribery cases\" width=\"300\" height=\"171\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/03\/No-immunity-for-MPs-MLAs-in-bribery-cases.png?resize=300%2C171&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/03\/No-immunity-for-MPs-MLAs-in-bribery-cases.png?w=533&amp;ssl=1 533w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-285710\" class=\"wp-caption-text\"><strong>Source-<\/strong> Hindustan Times<\/figcaption><\/figure>\n<p><strong>1. <\/strong>The court stated that legislators&#8217; freedom of speech and expression, along with their voting rights in the House, <span style=\"color: #333333;\">do not protect them from giving<\/span> or <span style=\"color: #333333;\">taking bribes<\/span>. Similarly, the <span style=\"color: #ff0000;\">immunities provided under Article 105<\/span> and <span style=\"color: #ff0000;\">194 also do not shield them in such cases<\/span>.<\/p>\n<p><strong>2.<\/strong> The <span style=\"color: #ff0000;\">act of bribery is considered complete when the legislator accepts the bribe<\/span>. It doesn&#8217;t matter if the legislator votes as agreed or doesn&#8217;t vote at all.<\/p>\n<p><strong>Note<\/strong>&#8211; The reference came in an appeal filed by JMM leader Sita Soren, who was accused of taking a bribe to vote for a particular candidate in the 2012 Rajya Sabha elections.<\/p>\n<h2><strong>What are the constitutional immunities for state legislature and parliament members?<\/strong><\/h2>\n<p><strong>1.<\/strong> <span style=\"color: #ff0000;\">Article 194(2)<\/span> of the Constitution grants immunity to State Legislature members, while <span style=\"color: #ff0000;\">Article 105(2)<\/span> provides the same protections to Parliament members.<\/p>\n<p><strong>2.<\/strong> <span style=\"color: #ff0000;\">Article 105<\/span> of the Constitution addresses the authority, privileges, and immunities of Parliament and its members.<\/p>\n<p><strong>3.<\/strong> <span style=\"color: #ff0000;\">Article 105(2)<\/span> states that no Member of Parliament can be held accountable in court for statements made or votes cast in Parliament or its committees.<\/p>\n<p><strong>UPSC Syllabus- Polity and Nation<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Source-This post on No immunity for MPs, MLAs in bribery cases: SC\u00a0is based on the article &#8220;Immunity won\u2019t protect legislators taking bribes to vote in Parliament from criminal prosecution: Supreme Court&#8221; published in &#8220;The Hindu&#8221; on 4th March 2024.
