The court ensures that the statement was not a result of imagination or coercion.<\/p>\n<h2><span id=\"What_is_the_Dying_Declaration\"><strong>About Dying Declaration<\/strong><\/span><\/h2>\n<p>i) The Dying Declaration is the statement of a person who had died explaining the circumstances of his death.<\/p>\n<p>ii) A dying declaration is considered\u00a0<span style=\"color: #ff0000;\">credible and trustworthy evidence,<\/span> based upon the general belief that most people who know that they are about to die, do not lie.<\/p>\n<p><span style=\"color: #ff0000;\"><span style=\"color: #333333;\">iii)<\/span> Section 32 of the<\/span> <span style=\"color: #ff0000;\">Indian Evidence Act<\/span> deals with the cases related to that person who is dead or who cannot be found.<\/p>\n<p><span id=\"Who_can_record_dying_declarations\">iv) <\/span><span style=\"color: #ff0000;\">Anyone can record\u00a0the dying declaration\u00a0<\/span>of the deceased as per law.
