However, EFTA&#8217;s demands for inclusion of \u2018<span style=\"color: #ff0000;\">Data exclusivity<\/span>\u2018 and \u2018<span style=\"color: #ff0000;\">Specific duration<\/span>\u2019 clauses in the agreement have been a sticking issue in the negotiations. All four member states participate in the <span style=\"color: #ff0000;\">European Single Market<\/span> through European Economic Area (EEA) Agreement.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Trade and Economic Partnership Agreement (TEPA)<\/strong><\/p>\n<p>The TEPA is a <span style=\"color: #ff0000;\">comprehensive agreement<\/span> that covers trade in goods, trade in services, investment, intellectual property rights, competition, government procurement, trade facilitation, trade remedies, dispute settlement, and other areas of mutual interest.<\/p>\n<p><strong>Objective<\/strong><\/p>\n<p>1. It <span style=\"color: #ff0000;\">aims to eliminate\/reduce tariffs and non-tariff barriers<\/span> on a wide range of products. It will create opportunities for trade and investment between India and EFTA.<\/p>\n<p>2. It aims to <span style=\"color: #ff0000;\">ensure fair and transparent market access conditions<\/span> for service providers and investors. It will also <span style=\"color: #ff0000;\">enhance cooperation on intellectual property rights<\/span> protection and enforcement.<\/p>\n<p>3. TEPA aims to establish <span style=\"color: #ff0000;\">effective mechanisms for dispute resolution<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What is the Significance of EFTA for India?<\/strong><\/span><\/h2>\n<p><strong>1. Deep Economic Relations-<\/strong><br \/>\na. EFTA is <span style=\"color: #ff0000;\">India&#8217;s 9th largest trading partner<\/span>, accounting for about <span style=\"color: #ff0000;\">2.5% of India&#8217;s total merchandise trade in 2020-21<\/span>.<br \/>\nb. The <span style=\"color: #ff0000;\">main items of India&#8217;s exports to EFTA<\/span> are textiles, chemicals, gems, and jewellery, machinery, and pharmaceuticals.<br \/>\nc. The <span style=\"color: #ff0000;\">main items of India&#8217;s imports from EFTA<\/span> are machinery, chemicals, precious metals, and medical instruments.<\/p>\n<p><strong>2. Innovation and Competitiveness-\u00a0<\/strong>EFTA nations are leaders in innovation and competitiveness. EFTA companies are <span style=\"color: #ff0000;\">world leaders<\/span> in <span style=\"color: #ff0000;\">pharmaceuticals<\/span>, <span style=\"color: #ff0000;\">biotechnology<\/span>, <span style=\"color: #ff0000;\">machinery manufacturing<\/span>, <span style=\"color: #ff0000;\">R&amp;D-driven technology products<\/span>, <span style=\"color: #ff0000;\">geothermal-related technologies<\/span>, marine technology, energy-related services, financial services, banking, and insurance.<\/p>\n<p><strong>3. Success History of EFTA&#8217;s Trade Agreements- <\/strong>FTAs with EFTA have been favourable for other countries of the world. <span style=\"color: #ff0000;\">29 free trade agreements<\/span> (<span style=\"color: #ff0000;\">FTAs<\/span>) with the EFTA are currently in operation.<\/p>\n<p><strong>4. Support of India&#8217;s permanent membership of UNSC-<\/strong>The\u00a0EFTA countries recognise the growth of India as a world leader and support India&#8217;s permanent membership of UNSC.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What are the benefits of free trade agreement\u00a0between India-EFTA?<\/strong><\/span><\/h2>\n<p><strong>1. Increase in Trade Opportunities-<\/strong> A free trade agreement between India and EFTA would lead to increased trade opportunities for India. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">It would give India market access to high per capita European countries<\/span>.<\/p>\n<p><strong>2. Increase in Investment-<\/strong> It would give a <span style=\"color: #ff0000;\">further push to EFTA investments<\/span>, which is around <span style=\"color: #ff0000;\">$35 bn in sectors<\/span> such as machinery, electrical engineering and metals, pharmaceuticals, banking, financial services and insurance, construction, and fast-moving consumer goods (FMCG)<\/p>\n<p><b>3. Enhanced cooperation in service sector- <\/b>A free trade agreement between India-EFTA would give a further push to the services sector cooperation. It would create <span style=\"color: #ff0000;\">more business opportunities for skilled Indian service providers<\/span>.<\/p>\n<p><strong>4. Push to Green energy sector in India-<\/strong> EFTA countries are leaders in green energy. EFTA states can <span style=\"color: #ff0000;\">help India to meet its green growth aspirations<\/span> of 50% renewable energy by 2030, with their cutting-edge technologies.<\/p>\n<p><strong>5. Promotion of Democratic values-<\/strong> Deeping of economic cooperation between India and EFTA states would further promote the shared democratic values such as <span style=\"color: #ff0000;\">sustainable development<\/span>, <span style=\"color: #ff0000;\">inclusive growth<\/span> and <span style=\"color: #ff0000;\">gender equality<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What are the Challenges in India-EFTA Relations?<\/strong><\/span><\/h2>\n<p><strong>1. Data exclusivity and specific Duration Clauses &#8211;<\/strong> Data exclusivity safeguards the clinical trial information of a pharmaceutical company, about a particular medication. During the exclusivity period, <span style=\"color: #ff0000;\">generic competitors cannot use the originator\u2019s data<\/span> to get approval for similar drugs.<br \/>\nThese provisions would promote monopolization for foreign pharmaceutical companies and <span style=\"color: #ff0000;\">would be a setback for the Indian generic industry<\/span>. This will also lead to a rise in the cost of affordable medicines in India.<\/p>\n<p><strong>2. Differences in Economic Structures &#8211;<\/strong> Bridging the differences in the economic interests of different economic structures of <span style=\"color: #ff0000;\">India<\/span> (<span style=\"color: #ff0000;\">developing country with low per capita<\/span>) and <span style=\"color: #ff0000;\">EFTA countries<\/span> (<span style=\"color: #ff0000;\">developed economies with high per capita income<\/span>) is a formidable challenge.<\/p>\n<p><strong>3. Intellectual Property Rights Protection &#8211;<\/strong> Challenge of protection of IPR of the EFTA companies engaged in <span style=\"color: #ff0000;\">pharmaceuticals<\/span>, <span style=\"color: #ff0000;\">biotechnology<\/span>, and <span style=\"color: #ff0000;\">machinery manufacturing<\/span>.<\/p>\n<p><strong>4. Market access challenges &#8211;<\/strong> There are issues regarding <span style=\"color: #ff0000;\">tariffs<\/span>, <span style=\"color: #ff0000;\">quotas<\/span>, and <span style=\"color: #ff0000;\">non-tariff barriers<\/span> which are hindering the free market access between the two parties. Identification of areas of Mutual Benefit-<\/strong> Both the parties should identify areas of mutual benefit, such as <span style=\"color: #ff0000;\">technology transfer<\/span>, <span style=\"color: #ff0000;\">R&amp;D and innovation.\u00a0<span style=\"color: #333333;\">Cooperation must be enhanced in these mutually beneficial sector before the FTA is concluded.<\/span><\/span><\/p>\n<p><strong>3.
