This decision came after a lawsuit filed by Dolma Tsering, who claimed rights to the trademark.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid; background-color: #dedede;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Trademark<\/strong><\/p>\n<p><strong>1. About<\/strong>&#8211; A trademark is a <span style=\"color: #ff0000;\">symbol, design, word<\/span>, or <span style=\"color: #ff0000;\">phrase<\/span> that represents a business. Registering a trademark <span style=\"color: #ff0000;\">gives its owner exclusive rights to use it<\/span>.<\/p>\n<p><strong>2. Regulation<\/strong>&#8211; The <span style=\"color: #ff0000;\">Trademarks Act of 1999<\/span> regulates trademarks and their registration in India. It <span style=\"color: #ff0000;\">ensures protection<\/span> for <span style=\"color: #ff0000;\">trademarks registered with the Controller General of Patents, Designs, and Trademarks,<\/span> also <span style=\"color: #ff0000;\">known as the trademark registry<\/span>.<\/p>\n<p><strong>3. About:<br \/>\na.<\/strong> Passing off involves <span style=\"color: #ff0000;\">using someone else&#8217;s goods<\/span> or <span style=\"color: #ff0000;\">services without authorization<\/span>, which can mislead customers about the origin of those products.<br \/>\n<strong>b.<\/strong> Passing off is when someone sells their products as if they belong to someone else.<\/p>\n<p><strong>2. Protection against Passing off:<br \/>\na.<\/strong> The concept of Passing off under the Indian Trademarks Act of 1999 <span style=\"color: #ff0000;\">aims to protect the reputation linked with unregistered trademarks<\/span>.<br \/>\n<strong>b.<\/strong> While passing off<span style=\"color: #ff0000;\"> isn&#8217;t specifically defined in the Indian Trademarks Act of 1999<\/span>,<span style=\"color: #ff0000;\"> Section 27 recognizes the common law rights of a trademark owner<\/span>. This allows the owner to take legal action against anyone who tries to pass off goods or services as belonging to another person.<\/p>\n<p><strong>3. Difference between infringement and Passing off<\/strong>&#8211; If the trademark is registered and infringement occurs, it&#8217;s a case of infringement. <span style=\"color: #ff0000;\">If the trademark isn&#8217;t registered<\/span> and <span style=\"color: #ff0000;\">infringement occurs, <\/span>it&#8217;s a <span style=\"color: #ff0000;\">case of passing off<\/span>.<\/p>\n<p><strong>4.
