About<\/strong>&#8211; Section 153A of the IPC <span style=\"color: #ff0000;\">aims to penalize individuals who promote hostility between different groups<\/span> based on factors like religion, caste, race, place of birth or residence, or language.<\/p>\n<p><strong>2. Accountability<\/strong>&#8211; The provision holds accountable those who<br \/>\n<strong>a.<\/strong> <span style=\"color: #ff0000;\">Spread hate through words (spoken or written), images, or signs<\/span> to stir up discord, animosity, or unrest among people of different groups, religions, castes, or communities.<br \/>\n<strong>b.<\/strong> Spread disharmony and disturb the public tranquility of the people belonging to different racial and religious groups.<br \/>\n<strong>c.<\/strong> <span style=\"color: #ff0000;\">Assist in arranging activities<\/span> that promote and train participants to use criminal force and violence against people of different racial and religious backgrounds.<br \/>\n<strong>d.<\/strong> This section also includes <span style=\"color: #ff0000;\">offenses involving moral wrongdoing.<\/span><\/p>\n<p><strong>3. Punishment:<\/strong><br \/>\n<strong>a.<\/strong> The offense is <span style=\"color: #ff0000;\">cognizable offense<\/span> and can lead to up to <span style=\"color: #ff0000;\">three years in prison, a fine<\/span>, or <span style=\"color: #ff0000;\">both<\/span>.<br \/>\n<strong>b.<\/strong> If the offense happens in a place of worship, the <span style=\"color: #ff0000;\">punishment can increase to five years in prison<\/span> and <span style=\"color: #ff0000;\">a fine<\/span>.<br \/>\n<strong>c.<\/strong> Additionally, under Section 153A, the <span style=\"color: #ff0000;\">offense is non-bailable<\/span>, and the <span style=\"color: #ff0000;\">accused is tried by a first-class magistrate.<\/span><\/p>\n<p><strong>Note<\/strong>&#8211; A cognizable offense allows a police officer to investigate and <span style=\"color: #ff0000;\">make an arrest without needing a magistrate&#8217;s order <span style=\"color: #333333;\">or<\/span> a warrant<\/span>.<\/p>\n<p><strong>4. Low conviction rate issue- <\/strong>According to the National Crime Records Bureau (NCRB), the conviction rate for Section 153A is notably low.<\/p>\n<p><strong>5. Safeguards against misuse:<\/strong><br \/>\n<strong>a.<\/strong> Sections 153A and 153B <span style=\"color: #ff0000;\">need government approval before starting prosecution<\/span>.
