{"id":28827,"date":"2018-10-24T15:06:05","date_gmt":"2018-10-24T09:36:05","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=28827"},"modified":"2018-10-24T15:06:05","modified_gmt":"2018-10-24T09:36:05","slug":"the-missing-tiers","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/the-missing-tiers\/","title":{"rendered":"The missing tiers"},"content":{"rendered":"<p><strong>The missing tiers<\/strong><\/p>\n<p><strong><u>Article:<\/u><\/strong><\/p>\n<p>1-Mathew Idiculla, lawyer and researcher on urban issues, analyse the reasons behind disempowerment and depoliticisation of urban local government.<\/p>\n<p><strong><u>Important Analyses:<\/u><\/strong><\/p>\n<p>2- The passage of 73 rd\u00a0 and 74<sup>th<\/sup>\u00a0 Amendment came into force\u00a0 in 1993<\/p>\n<p>3- 73<sup>rd<\/sup>\u00a0amendment deals with creation of panchayats, while 74<sup>th<\/sup>\u00a0amendment deals with creation of municipalities.<\/p>\n<p><strong><u>4-<\/u><\/strong><u>\u00a0Problems associated with 74 amendment act in the Constitution.<\/u><\/p>\n<ul>\n<li>Many of its key provisions are not mandatory for state government.<\/li>\n<li>12<sup>th<\/sup>\u00a0schedule do not include essential such as urban transportation, housing or urban commons.<\/li>\n<li>Power in urban areas is concentrate in a single municipal bodies.<\/li>\n<li>Municipalities not created in areas declared industrial townships.<\/li>\n<li>Unlike the 73rd Amendment which provides for three levels of panchayats (village, taluk, and district levels), power in urban areas is concentrated in a single municipal body (whether it is a municipal corporation, municipal council or town panchayat).<\/li>\n<\/ul>\n<ol start=\"5\">\n<li>Author raise concern about the continuous dis empowering of local government by state government<\/li>\n<\/ol>\n<ul>\n<li>In most municipal corporation, Mayor is the ceremonial head while executive power is vested with the state government appointed commissioner.<\/li>\n<li>this is usually done to curtail the power of local level politician.<\/li>\n<\/ul>\n<ol start=\"6\">\n<li>some other concerns raised by author about urban local government are<\/li>\n<\/ol>\n<ul>\n<li>lack of proper finance<\/li>\n<li>Administrative capacity of ULBs is weak which led yo implementation failure<\/li>\n<li>By creating many parastatal agencies like\u00a0urban development authorities (which build infrastructure) and public corporations (which provide services such as water, electricity and transportation)<\/li>\n<li>Local government need to take permission of state government for levying taxes.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li>Smart cities mission of central government further delegate the power of local bodies.<\/li>\n<\/ol>\n<ul>\n<li>smart cities program\u00a0mandates for the creation of special purpose vehicles (SPVs) which will have \u201coperational independence and autonomy in decision making and mission implementation\u201d.<\/li>\n<\/ul>\n<ol start=\"8\">\n<li>Ward committee and Metropolitan planning failed to create civic activism as envisaged by 74th amendment.<\/li>\n<li>Author suggested for reform in urban governance which vests power in a singular municipality<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>The missing tiers Article: 1-Mathew Idiculla, lawyer and researcher on urban issues, analyse the reasons behind disempowerment and depoliticisation of urban local government.
