Market Capitalization and Widespread User Base-<\/strong> Big techs exert considerable influence over industry trends, consumer behaviour, and public policy.<br \/>\n<strong>a. Amazon-<\/strong> Amazon through its Amazon.com platform and Amazon Web Services (AWS) <span style=\"color: #ff0000;\">dominates the E-commerce<\/span> and <span style=\"color: #ff0000;\">cloud computing market<\/span>.<br \/>\n<strong>b. Google (Alphabet)-<\/strong> Google (Alphabet) through its search engine and subsidiary companies like YouTube and Google Ads <span style=\"color: #ff0000;\">controls the majority of online search traffic<\/span> and <span style=\"color: #ff0000;\">digital advertising revenue<\/span>.<br \/>\n<strong>c. Facebook (Meta)- <\/strong>Facebook (Meta) through its social media platforms such as <span style=\"color: #ff0000;\">Facebook<\/span>, <span style=\"color: #ff0000;\">Instagram<\/span>, and <span style=\"color: #ff0000;\">WhatsApp<\/span> dominates the social media landscape.<\/p>\n<p><strong>2. Provide Innovative technological products and services-<\/strong> Big Techs have been pioneering advancements in various fields such as artificial intelligence, cloud computing, and digital entertainment.<br \/>\n<strong>a. Microsoft- <\/strong>Microsoft through its products like the <span style=\"color: #333333;\">Windows operating system, Office suite, Xbox gaming consoles and Azure cloud platform<\/span>, <span style=\"color: #ff0000;\">innovates in various technologies such as software<\/span>, <span style=\"color: #ff0000;\">hardware<\/span> and <span style=\"color: #ff0000;\">cloud services<\/span>.<br \/>\n<strong>b. Apple-<\/strong> Apple through its products such as the<span style=\"color: #333333;\"> iPhone, iPad, and MacBook has been\u00a0<\/span>innovating in <span style=\"color: #ff0000;\">groundbreaking communication products<\/span>.<br \/>\n<strong>c. Tesla-<\/strong> Tesla has been involved in<span style=\"color: #ff0000;\"> disruption of the automotive industry<\/span> with electric vehicles, renewable energy solutions, and autonomous driving technology.<\/p>\n<p><strong>3. Generates steady and profitable career possibilities-<\/strong> It attracts top people with attractive compensation and enticing employee incentives. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Amazon web service (AWS) region in India employs nearly 48,000 full-time employees yearly<\/span>.<\/p>\n<p><strong>4. Push to startups-<\/strong> Big techs provide the necessary push to the startups in India, with many utilising their Web services and cutting edge software technologies. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Deal between the Startup Hub of the Ministry of Electronics and IT with the social network company META<\/span> September 2022 to create an accelerator programme that would award incentives to businesses developing services for the metaverse.<\/p>\n<p><strong>5. Innovation in providing social sector services like Health and Education-<\/strong> Big Techs have been pioneering innovations in the fields of health and education through their innovative delivery mechanisms. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Microsoft and Apollo partnership to develop an API model for accurate healthcare diagnostics<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What are the issues which necessitate regulating Big Techs in India?<\/strong><\/span><\/h2>\n<p><strong>1. Abuse of Dominant market position-<\/strong> Big techs have been fraught with the issue of abusing their dominant market position. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Google abusing its dominant position in the Android and Play Store ecosystem<\/span> by pressurising app developers to use Google&#8217;s proprietary billing system or face a fee if they opt for a competitor&#8217;s service.<\/p>\n<p><strong>2. Self-preferencing and platform bias-<\/strong> It refers to the practice of a company promoting its services or subsidiaries on its platform while also operating as a competitor on the same platform. <span style=\"color: #333333;\"><strong>For ex-<\/strong><\/span> <span style=\"color: #ff0000;\">Amazon&#8217;s e-commerce service<\/span> has been <span style=\"color: #ff0000;\">under scrutiny in India<\/span> due to its <span style=\"color: #ff0000;\">dual role of being a marketplace operator, as well as retailer<\/span> on its own platform.<\/p>\n<p><strong>3. Restrictions on Third-Party Applications-<\/strong> There are instances where entities have restricted the installation or operation of third-party applications. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Apple\u2019s restriction on installing third-party applications on the iPhone<span style=\"color: #333333;\">.<\/span><\/span><\/p>\n<p><strong>4. Bundling and Tying-<\/strong> Big Tech Firms compel consumers to purchase related services by linking their main products or services to other complementary offerings. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Operating system providers like Microsoft<\/span>, <span style=\"color: #ff0000;\">bundling the use of its search engine and products like Office<\/span>, which <span style=\"color: #ff0000;\">generates pricing asymmetry<\/span> and results in the elimination of competition from the market.<\/p>\n<p><strong>5. Anti-Steering-<\/strong> Anti-steering provisions are employed by big tech entities to hinder business users from migrating away from the platform and utilizing alternative options. This results in restriction of customer choices. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Apple\u2019s anti-steering practices<\/span> <span style=\"color: #ff0000;\">prevents users from truly exercising their choice of services<\/span> with the Apple ecosystem.<\/p>\n<p><strong>6. Arbitrary Pricing-<\/strong> The big techs demonstrate &#8216;network effects&#8217;, which <span style=\"color: #ff0000;\">enable rapid growth of their user base<\/span> and fix arbitrary prices, which create challenges for new competitors to overcome. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Meta&#8217;s subscription model<\/span> offering people in EU, European Economic Area (EEA) and Switzerland <span style=\"color: #ff0000;\">the choice to use Facebook and Instagram without any ads<\/span>.<\/p>\n<p><strong>7. Concerns Over Data Privacy-<\/strong> Big Tech companies gather vast amounts of user data through their platforms and services. This has raised concerns about <span style=\"color: #ff0000;\">privacy<\/span>, <span style=\"color: #ff0000;\">digital<\/span> <span style=\"color: #ff0000;\">surveillance<\/span>, and <span style=\"color: #ff0000;\">data security<\/span>.\u00a0<span style=\"color: #333333;\"><strong>For ex-<\/strong> <span style=\"color: #ff0000;\">CCI\u2019s probe into WhatsApp\u2019s privacy policy<\/span>, on allegations that the messaging platform shares user data with its parent Facebook.<\/span><\/p>\n<p><strong>8. Killer Acquisitions and Mergers-<\/strong> <span style=\"color: #ff0000;\">Killer acquisitions<\/span>, where big techs purchase valuable start-ups without being subject to merger control rules based on turnover, create an unfair playing field in the digital market. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Facebook&#8217;s killer acquisition of Instagram and WhatsApp<\/span>, led to the monopolisation of social media communication domain.<\/p>\n<p><strong>9. Social and Political Impacts-<\/strong> The big techs are the foremost medium of fake news, hate speech, election manipulation. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Facebook&#8217;s Cambridge Analytica controversy regarding electoral choice&#8217;s by voter profiling<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What steps are being taken worldwide and in India for regulating Big Techs?<\/strong><\/span><\/h2>\n<p><strong>1. US&#8217;s Changed Stance-<\/strong> The US has changed its stance towards antitrust enforcement. <span style=\"color: #ff0000;\">The US Department of Justice<\/span>, and <span style=\"color: #ff0000;\">16 states<\/span> have recently <span style=\"color: #ff0000;\">sued Apple<\/span> alleging that it monopolized and abused the smartphone market.<br \/>\nThe antitrust enforcement agencies in India and US, can now proceed in case of violations by these big tech firms without geopolitical repercussions because the protective shield of the home country (USA) for these firms has been lifted.<\/p>\n<p><strong>2. EU\u2019s Initiatives-<\/strong> EU enacted the Digital Markets Act (DMA), 2022 to ensure <span style=\"color: #ff0000;\">contestable and fair markets in the digital sector<\/span>.\u00a0<span style=\"color: #333333;\">The <span style=\"color: #ff0000;\">European Commission<\/span> in March 2024 <span style=\"color: #ff0000;\">initiated<\/span> \u2018<span style=\"color: #ff0000;\">non-compliance investigations<\/span>\u2019 against the Big Techs like Apple, Meta and Google\u2019s parent Alphabet.\u00a0<\/span><\/p>\n<p><strong>3. India-<\/strong><br \/>\n<span style=\"color: #ff0000;\"><strong><span style=\"color: #333333;\">a.<\/span><\/strong> Competition Act 2002 amended in 2007<span style=\"color: #333333;\">&#8211; <\/span><\/span>This amended act provides the powers to the Competition Commission of India (CCI) to regulate anticompetitive practices adopted by the big techs in India. <span style=\"color: #ff0000;\">In 2022<\/span>, <span style=\"color: #ff0000;\">the CCI imposed a penalty of Rs 1,337.76 crore on Google<\/span> for abusing its dominant position in multiple markets for &#8216;anti-competitive practices&#8217;.<\/p>\n<p><strong>b.<\/strong> <span style=\"color: #ff0000;\">The Information and Technology Act, 2000<span style=\"color: #333333;\">&#8211;<\/span>\u00a0<span style=\"color: #333333;\">Intermediaries like providers of network service, telecom service, Internet service and web hosting are required to preserve and retain specified information. Enactment of Digital Competition Act-<\/strong> The Committee on Digital Competition Law has recommended the enactment of a Digital Competition Act <span style=\"color: #ff0000;\">aimed specifically at big techs<\/span>, <span style=\"color: #ff0000;\">complementing the Competition Act<\/span>.<\/p>\n<p><strong>2. Systemically Significant Digital Enterprises (SSDEs) Classification-<\/strong> The tech companies with a &#8216;<span style=\"color: #ff0000;\">significant presence<\/span>&#8216; in &#8216;<span style=\"color: #ff0000;\">Core Digital Service<\/span>&#8216; market must <span style=\"color: #ff0000;\">self designate themselves<\/span> as SSDEs. Specific rules for SSDEs must be determined after public consultations.<\/p>\n<p><span style=\"color: #333333;\"><strong>Implementing the recommendations of the Parliamentary Standing Committee on Finance for new digital competition regulations-<\/strong><\/span><\/p>\n<p><strong>3. Regulating anti-competitive practices-<\/strong> The committee has pointed regulating 10 anti-competitive practices employed by the big techs like <span style=\"color: #ff0000;\">anti-steering<\/span>, <span style=\"color: #ff0000;\">deep discounting<\/span>, <span style=\"color: #ff0000;\">bundling and tying together of services<\/span>, <span style=\"color: #ff0000;\">targeted advertising<\/span> etc.<\/p>\n<p><strong>4. Identification of Digital Gatekeepers as SIDIs-<\/strong> India should identify key players in digital markets that could harm competition and classify them as <span style=\"color: #ff0000;\">Systemically Important Digital Intermediaries<\/span> (<span style=\"color: #ff0000;\">SIDIs<\/span>) based on factors like revenue, market capitalization, and user base. <span style=\"color: #ff0000;\">SIDIs <span style=\"color: #333333;\">should then<\/span> submit yearly reports <span style=\"color: #333333;\">to the<\/span> Competition Commission of India<\/span> (<span style=\"color: #ff0000;\">CCI<\/span>) outlining their efforts to meet mandatory requirements.<\/p>\n<p><strong>5. <span style=\"color: #333333;\">Platform Neutrality- <\/span><\/strong><span style=\"color: #333333;\"><span style=\"color: #ff0000;\">Significant Digital Intermediaries<\/span> (<span style=\"color: #ff0000;\">SIDIs<\/span>) should not show preferential treatment towards their services over those of their competitors.<\/span><\/p>\n<p><strong>6. Protection of Data Privacy-<\/strong> SIDIs <span style=\"color: #ff0000;\">should not process personal data of end users<\/span> who use <span style=\"color: #ff0000;\">third-party services are dependent<\/span> on the SIDI&#8217;s core services.<\/p>\n<p><strong>7. Allowing Third-Party Applications-<\/strong>\u00a0<span style=\"color: #333333;\">SIDIs should allow and technically enable the installation and use of third-party software applications.<\/span><\/p>\n<p><strong>8. Revamping CCI-<\/strong> The committee has recommended the revamp of CCI by <span style=\"color: #ff0000;\">creating<\/span> <span style=\"color: #ff0000;\">specialised digital markets unit<\/span> in CCI.
