{"id":28895,"date":"2018-10-24T15:31:40","date_gmt":"2018-10-24T10:01:40","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=28895"},"modified":"2018-10-24T15:31:40","modified_gmt":"2018-10-24T10:01:40","slug":"india-not-ready-to-sign-the-hague-treaty","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/india-not-ready-to-sign-the-hague-treaty\/","title":{"rendered":"India not ready to sign the Hague treaty"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/news\/national\/india-not-yet-ready-to-sign-the-hague-treaty-maneka\/article24106642.ece\">India not ready to sign the Hague treaty<\/a><\/p>\n<p>Hague treaty, inter-country abduction of children by parents<\/p>\n<p><strong><u>News:<\/u><\/strong><\/p>\n<ul>\n<li>India is not yet ready to sign the <strong>Hague treaty on the civil aspects of international child abduction.<\/strong><\/li>\n<\/ul>\n<p><strong><u>Important facts:<\/u><\/strong><\/p>\n<ul>\n<li>There has been immense pressure from the U.S. on the government to sign the treaty.<\/li>\n<li>A committee constituted by the Centre to examine legal issues involved in international parental abduction submitted its report in April, opposing a central provision of the Hague Convention.<\/li>\n<li>India will follow Japan\u2019s example and put safeguards in place before acceding to the Hague treaty<\/li>\n<li><strong><u>Arguments against not singing treaty:<\/u><\/strong><\/li>\n<li>According to the Indian government the criterion of habitual residence of the child, which is used to determine whether the child was wrongfully removed by a parent as well as to seek the return of the child to the country of habitual residence, was not in the best interest of the child.<\/li>\n<li>India has long held the view that the decision could lead to harassment of women escaping marital discord or domestic violence<\/li>\n<li><strong><u>Suggestions:<\/u><\/strong><\/li>\n<li>Setting a <strong>Child Removal Disputes Resolution Authority<\/strong> to act as a nodal body to decide on the custody of the child as well as a model law to deal with such disputes.<\/li>\n<li>The government is contemplating assigning <strong>the National Commission for Protection of Children<\/strong> the responsibility to adjudicate on such cases along with a judicial expert.<\/li>\n<li><strong><u>Recent updates:<\/u><\/strong><\/li>\n<li>The government in 2016 had decided that it will not sign the Hague treaty, later it appointed a panel under Rajesh bindal to prepare a report indicating that there was a some rethinking within the government on the matter.<\/li>\n<\/ul>\n<table>\n<tbody>\n<tr>\n<td width=\"638\"><strong><u>About Hague Convention:<\/u><\/strong><\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The Hague Convention is a <strong>multi-national treaty<\/strong> <strong>that seeks to protect children wrongfully<\/strong> removed by one of the parents from the custody of the other parent.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Concluded on May 29, 1993 in The Hague, the Netherlands, the Convention establishes international standards of practices for intercountry adoptions.<\/p>\n<p>\u00b7\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 It enables intercountry adoption to take place when, among other steps:<\/p>\n<p>1-\u00a0\u00a0\u00a0\u00a0\u00a0 The child has been deemed eligible for adoption by the child&#8217;s country of origin; and<\/p>\n<p>2-\u00a0\u00a0\u00a0\u00a0\u00a0 Due consideration has been given to finding an adoption placement for the child in its country of origin.<\/p>\n<p>3-\u00a0\u00a0\u00a0\u00a0\u00a0 The Convention provides for recognition by other party countries of adoptions made in accordance with the Convention.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n","protected":false},"excerpt":{"rendered":"<p>India not ready to sign the Hague treaty Hague treaty, inter-country abduction of children by parents News: India is not yet ready to sign the Hague treaty on the civil aspects of international child abduction.
