This <span style=\"color: #ff0000;\">notification exempted the extraction of ordinary earth for linear projects<\/span> like road and railway construction from needing Environmental Clearance (EC).<\/p>\n<h2>What was the notification that exempted earth extraction for Linear Projects?<\/h2>\n<p><strong>1.<\/strong> <strong>First notification<\/strong>&#8211; In 2006, the Environment Ministry released a notification under the Environment (Protection) Act 1986 (EPA), specifying activities necessitating prior Environmental Clearance (EC).<\/p>\n<p><strong>2. Second notification<\/strong>&#8211; Later in 2016, a second notification was issued, granting exemptions to certain project categories from this requirement.<\/p>\n<p><strong>3. Third notification<\/strong>&#8211; <span style=\"color: #333333;\">In 2020, a third notification was issued<\/span>, adding &#8220;<span style=\"color: #ff0000;\">Extraction<\/span> or<span style=\"color: #ff0000;\"> sourcing or borrowing of ordinary earth for linear projects such as roads, pipelines, etc<\/span>.&#8221; to the list of exempted activities.<\/p>\n<h2>Basis for Challenging the 2020 Exemption\/Notification<\/h2>\n<p><strong>1.<\/strong> <a href=\"https:\/\/forumias.com\/blog\/article-14-and-article-16-in-the-constitution-of-india-1949\/\" target=\"_blank\" rel=\"noopener\"><strong>Violation of Article 14<\/strong><\/a>&#8211; The exemption faced a challenge in front of the <a href=\"https:\/\/forumias.com\/blog\/national-green-tribunalngt\/#:~:text=About%20NGT%3A&amp;text=The%20act%20provides%20for%20effective,mainstream%20code%20of%20civil%20procedure.\" target=\"_blank\" rel=\"noopener\">National Green Tribunal (NGT)<\/a>, arguing that permitting unrestricted earth extraction was arbitrary and infringed upon Article 14 of the Constitution of India, as only linear projects were exempted.<\/p>\n<p><strong>2.<\/strong> <strong>Violation of SC guidelines on environmental clearance<\/strong>&#8211; The petitioner contended that the exemption contradicted the necessity for prior Environmental Clearance outlined by the Supreme Court in the case of <span style=\"color: #ff0000;\">Deepak Kumar<\/span> versus <span style=\"color: #ff0000;\">the State of Haryana (2012).<\/span><\/p>\n<p><strong>3.<\/strong> <strong>Government Response<\/strong>&#8211; The Center delayed action on the NGT order until the appellant approached the Supreme Court.<\/p>\n<h2>What does the Supreme Court held?<\/h2>\n<p><strong>1.<\/strong> <strong>Violation of Article 14<\/strong>&#8211; The court ruled that the blanket exemption without clear guidance was arbitrary and violated Article 14 because the <span style=\"color: #ff0000;\">2020 notification lacked definitions for &#8216;linear projects<\/span>&#8216; and <span style=\"color: #ff0000;\">specifics on extraction quantity and area<\/span>.<\/p>\n<p><strong>2.
