Right against Climate Change is a fundamental right-<\/strong> <span style=\"color: #ff0000;\">Right to a healthy environment<\/span>, <span style=\"color: #ff0000;\">which is safe from the ill-effects of climate change<\/span>, is a fundamental right.<\/p>\n<p><strong>2. Expansive view of the Fundamental rights under Art 14 and 21-<\/strong> SC has held that <span style=\"color: #ff0000;\">right to life <span style=\"color: #333333;\">(<\/span>Art 21<span style=\"color: #333333;\">)<\/span><\/span> and <span style=\"color: #ff0000;\">right to equality <span style=\"color: #333333;\">(Art 14) <\/span>could not be fully realised<\/span> without a <span style=\"color: #ff0000;\">clean<\/span>,<span style=\"color: #ff0000;\"> stable environment<\/span>. SC has <span style=\"color: #ff0000;\">expanded the scope of Art 14<\/span> and <span style=\"color: #ff0000;\">Art 21<\/span> to underline the need to protect lives and livelihoods in the face of climate change.<\/p>\n<p><strong>3. Impact on the right to health (Art 21) due to Climate Change-<\/strong> The right to health (<span style=\"color: #ff0000;\">which is a part of the right to life under Article 21<\/span>) is impacted due to factors such as<span style=\"color: #ff0000;\"> air pollution<\/span>, <span style=\"color: #ff0000;\">vector-borne diseases<\/span>, <span style=\"color: #ff0000;\">rising temperatures<\/span>, <span style=\"color: #ff0000;\">droughts<\/span>. These factors are exacerbated due to climate change.<\/p>\n<p><strong>4. Impact on the right to equality (Art 14) due to Climate Change- <\/strong>Climate change and environmental degradation lead to acute food and water shortages in a particular area where the <span style=\"color: #ff0000;\">poorer communities suffer more than richer ones<\/span>. <span style=\"color: #ff0000;\">Forest dwellers<\/span>, <span style=\"color: #ff0000;\">tribal<\/span> and <span style=\"color: #ff0000;\">indigenous communities<\/span> have a <span style=\"color: #ff0000;\">higher risk of losing their homes and culture<\/span> due to climate change as compared to other communities.<\/p>\n<p><strong>5. Interconnection between climate change and human rights-<\/strong> SC in its judgement has held that climate change impacts various human rights such as the <span style=\"color: #ff0000;\">right to health<\/span>, <span style=\"color: #ff0000;\">indigenous rights<\/span>, <span style=\"color: #ff0000;\">gender equality<\/span>, and the <span style=\"color: #ff0000;\">right to development<\/span>.<\/p>\n<p><strong>6. Right against Climate change and right to clean environment two sides of the same coin-<\/strong> SC in its ruling has observed that the right against adverse effect of climate change and the right to clean environment are two sides of the same coin. However, <span style=\"color: #ff0000;\">with the increase in adverse effects of climate change<\/span>, it is <span style=\"color: #ff0000;\">imperative to recognise the right against adverse effects of climate change<\/span> as a <span style=\"color: #ff0000;\">distinct right<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What is the significance of the Supreme Court Ruling on right against Climate Change?<\/strong><\/span><\/h2>\n<p><strong>1. Reiteration of India&#8217;s commitment to climate justice- <\/strong>The SC ruling reiterates India&#8217;s Climate responsibilities under International laws and agreements such as the <span style=\"color: #ff0000;\">Paris Agreement<\/span>, which <span style=\"color: #ff0000;\"><span style=\"color: #333333;\">aim to provide<\/span> environmental <span style=\"color: #333333;\">and<\/span> climate justice.<\/span><\/p>\n<p><strong>2. Makes the Issue of Climate change a part of public discourse-<\/strong> The <span style=\"color: #ff0000;\">recognition of the right against climate change as a fundamental right<\/span>, makes the issue of climate change a part of the public and political discourse in the country. It will <span style=\"color: #ff0000;\">nudge the Parliament to enact legislations on the issues of climate change<\/span>.<\/p>\n<p><strong>3. Opens the doors of constitution courts for Environmental Jurisprudence-<\/strong> The recognition of the right against the climate change as a fundamental right, <span style=\"color: #ff0000;\">opens the doors of the constitutional courts for citizens to litigate climate change issues in future<\/span>.<\/p>\n<p><strong>4. Progressive step setting a significant legal precedent-<\/strong> In the <span style=\"color: #ff0000;\">absence of a single or umbrella legislation against climate change in the country<\/span>, the <span style=\"color: #ff0000;\">recognition of the rights of Indians against climate change<\/span> by the Judiciary, is a <span style=\"color: #ff0000;\">progressive step <span style=\"color: #333333;\">setting a <\/span><\/span><span style=\"color: #333333;\">significant<\/span> legal precedent.<\/p>\n<p><strong>5. Recognises the Vulnerability of Indians to climate change-<\/strong> The Supreme court ruling is a recognition of the Vulnerability of Indians to climate Change which has been <span style=\"color: #ff0000;\">highlighted by the several studies, including IPCC reports<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What are the vulnerabilities of Indians to Climate change which enhance the importance of the Verdict?<\/strong><\/span><\/h2>\n<p><strong>1. Increase in Glacial lake outburst floods-<\/strong> Climate change has increased the intensity and frequency of GLOFs due to rapid melting of the Hindukush Himalayan Ranges. <strong>For Ex-<\/strong> <span style=\"color: #ff0000;\"><span style=\"color: #333333;\">Recent<\/span> <a href=\"https:\/\/forumias.com\/blog\/upsc-current-affairs-news\/glacial-lake-outburst-flood-glof-in-uttarakhand-explained\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #333333;\">GLOF induced flooding in Sikkim<\/span><\/a><\/span> leading to destruction of lives and livelihood.<\/p>\n<p><strong>2. Changing Rainfall Patterns and increase in droughts-<\/strong> There has been increase in the frequency of droughts in <span style=\"color: #ff0000;\">north-western India<\/span>, <span style=\"color: #ff0000;\">Jharkhand<\/span>, <span style=\"color: #ff0000;\">Orissa<\/span> and <span style=\"color: #ff0000;\">Chhattisgarh<\/span>.<\/p>\n<p><strong>3. Increase in sea levels-<\/strong> The densely populated cities of Kolkata and Mumba are particularly vulnerable to the impacts of <span style=\"color: #ff0000;\">sea-level rise<\/span>, <span style=\"color: #ff0000;\">tropical cyclones<\/span>, and <span style=\"color: #ff0000;\">riverine flooding<\/span>.<\/p>\n<p><strong>4. Endangered Food and Energy Security- <\/strong>There has been a <span style=\"color: #ff0000;\">decrease in the crop yields<\/span> because of extreme heat and low rainfall, which endangers the food security of the country. Enaction of legislation to give effect to the right-<\/strong> <span style=\"color: #ff0000;\">Enaction of legislation and framing of policies against climate change<\/span> will help in the actual realisation of the right of citizens against climate change.<\/p>\n<p><strong>2. Inclusion in Political Manifestos-<\/strong> This recognised fundamental right against climate change <span style=\"color: #ff0000;\">must<\/span> <span style=\"color: #ff0000;\">be a part of the political manifestos of the political parties<\/span> in the fray for Lok Sabha Polls. They must outline their plan of action for the realisation of these rights.<\/p>\n<p><strong>3. Avoiding hiatus between environmental jurisprudence and policy-<\/strong> <span style=\"color: #ff0000;\">Governments must give proper respect to these SC rulings<\/span> that underline the links between ecology and human dignity.
