It has been held that a <span style=\"color: #ff0000;\">candidate\u2019s decision to keep private those details which do not pertain to or affect their suitability for public office<\/span> should not be considered a &#8216;corrupt practice&#8217; under<span style=\"color: #ff0000;\"> Section 123 of the Representation of People Act, 1951. <span style=\"color: #333333;\">Such non-disclosure would not amount to a<\/span> \u201cdefect of a substantial nature\u201d <span style=\"color: #333333;\">under Section 36(4) of the 1951 Act.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">2. The Supreme Court observed that it is not necessary for a candidate to declare every item of movable property that he or his dependent family members owns.<\/p>\n<p style=\"text-align: justify;\">3. Items which <span style=\"color: #ff0000;\">constitute a sizeable asset in itself or reflects upon the candidature, in terms of his lifestyle, must be disclosed<\/span>.<\/p>\n<p style=\"text-align: justify;\">4. The Court also highlighted that <span style=\"color: #ff0000;\">candidates must declare their assets to enhance democratic participation<\/span> and ensure voters have the necessary information to make informed choices.<\/p>\n<p style=\"text-align: justify;\">5.
