Through this judgement, <span style=\"color: #ff0000;\">the supreme court has recognized the practice of &#8216;samskara&#8217;, <\/span>which is a sacrament that must be followed in a Hindu marriage.<\/p>\n<p>The court considered that <span style=\"color: #ff0000;\">marriage is sacred under the Hindu Marriage Act<\/span> for it provides a lifelong, dignity-affirming, equal, consensual and healthy union of two individuals.<\/p>\n<h2>About Hindu Marriage Act (HMA)1955<\/h2>\n<p><strong>1. About Hindu Marriage Act (HMA):<\/strong> It is legislation that <span style=\"color: #ff0000;\">regulates Hindu marriages and divorce by codifying laws<\/span> concerning these aspects within the <span style=\"color: #ff0000;\">Hindu community.<\/span><\/p>\n<p><strong>2. Applicability:<\/strong> The HMA applies to individuals who are<span style=\"color: #ff0000;\"> Hindu by birth or through conversion.<\/span> It also includes <span style=\"color: #ff0000;\">Buddhists, Jains, and Sikhs.<\/span><\/p>\n<p><strong>3. Provisions: <\/strong><\/p>\n<p><strong>a) Marriageable Age:<\/strong> Under the HMA, the <span style=\"color: #ff0000;\">minimum age for marriage is set at 21 for the bridegroom and 18 for the bride.<\/span> Marrying minors is punishable by imprisonment for up to three years and\/or a fine of up to Rs 1 lakh.<\/p>\n<p><strong>b) Recognition of Customs and Ceremonies:<\/strong> The HMA <span style=\"color: #ff0000;\">respects customary practices,<\/span> including the essential <span style=\"color: #ff0000;\">ritual of Saptapadi,<\/span> where the bride and groom take seven steps before the sacred fire.<\/p>\n<p><strong>c) Prohibition of Bigamy and Polygamy:<\/strong> The Act <span style=\"color: #ff0000;\">prohibits bigamy, polygamy, or polyandry.<\/span> <span style=\"color: #ff0000;\">Section 5<\/span> declares <span style=\"color: #ff0000;\">having two living spouses simultaneously illegal and punishable<\/span> under <span style=\"color: #ff0000;\">Sections 494 and 495 of the Indian Penal Code.<\/span><\/p>\n<p><strong>d) Mental health as a ccriterion for void marriage:<\/strong> Under the act,<span style=\"color: #ff0000;\"> Marriages are deemed void if one or both parties are mentally unfit.<\/span> Legal consent is required in such cases.<\/p>\n<p><strong>e) Registration provision:<\/strong> Registration is subject to state laws. However, <span style=\"color: #ff0000;\">lack of an official certificate does not invalidate a marriage.<\/span><\/p>\n<p><strong>f) Divorce provision:<\/strong> Divorce is permitted through<span style=\"color: #ff0000;\"> mutual consent or judicial separation.<\/span> Special circumstances may warrant divorce before one year of marriage.
