S.C directed the advertisers <span style=\"color: #ff0000;\">to submit self-declarations,<\/span> affirming the accuracy of their product claims, before promoting them through various media channels.<\/p>\n<p><strong>2.\u00a0Implementation Plans: <\/strong><\/p>\n<p>a) To enforce this directive effectively, advertisers are mandated to adhere to the <span style=\"color: #ff0000;\">Cable TV Network Regulations Rules of 1994.<\/span><\/p>\n<p>b) Advertiser<span style=\"color: #ff0000;\"> must upload their self-declarations on the Information and Broadcasting Ministry\u2019s \u2018Broadcast Seva\u2019 portal<\/span> before airing ads on TV channels. Copies of these declarations are also required to be provided to the broadcasters.<\/p>\n<p>c) A <span style=\"color: #ff0000;\">similar portal for print advertisers<\/span> will be established within a four-week timeframe.<\/p>\n<p><strong>3. Responsibility of Promoters:<\/strong> The Supreme Court has <span style=\"color: #ff0000;\">emphasized on the responsibility <span style=\"color: #000000;\">of social media influencers,<\/span><\/span> celebrities, and public figures endorsing products. They have been<span style=\"color: #ff0000;\"> urged to possess sufficient knowledge<\/span> <span style=\"color: #ff0000;\">about the products<\/span> they promote and to ensure that their endorsements are not contributing to deceptive advertising practices.<\/p>\n<p><strong>4. Enhanced Consumer Protection Measures:<\/strong><\/p>\n<p>a) Recognizing the importance of consumer empowerment, the Court has directed the Centre <span style=\"color: #ff0000;\">to establish a clear and accessible procedure for filing complaints<\/span> against misleading advertisements.<\/p>\n<p>b) Consumers are entitled to be<span style=\"color: #ff0000;\"> informed of the outcomes of their complaints,<\/span> ensuring transparency and accountability.<\/p>\n<p><strong>5. Government Action:<\/strong> The Ministry of Health has been directed <span style=\"color: #ff0000;\">to furnish data regarding complaints<\/span> received by the Food Safety and Standards Authority of India (FSSAI) pertaining to misleading advertisements and misbranding of food and health products.
