A 372-sq-km area that includes <span style=\"color: #ff0000;\">Kalapani, Limpiadhura, and Lipulekh<\/span>\u00a0at the India-Nepal-China trijunction in Uttarakhand\u2019s Pithoragarh district.<br \/>\nb. <span style=\"color: #ff0000;\">Susta Region<\/span> in West Champaran district, Bihar.<\/p>\n<p><span style=\"color: #000000;\"><strong>a. The Kali River in the Kalapani region demarcates the border between India and Nepal.<\/p>\n<p>The <span style=\"color: #ff0000;\">discrepancy in locating the source of the Kali river<\/span> has to boundary disputes between India and Nepal. Each country has produced its own maps supporting their own claims.<\/p>\n<p><span style=\"color: #333333;\"><strong>Nepal\u2019s stand<\/strong><\/span><\/p>\n<p>Nepal is of the view that the <span style=\"color: #ff0000;\">river which flows to the west of Kalapani is the main River Kali<\/span>. They also believe that River Kali originates at either Limpiyadhura or the nearby Lipulekh pass, which are both within the Nepalese territory.<\/p>\n<p><strong>India\u2019s stand<\/strong><\/p>\n<p>India believes that the <span style=\"color: #ff0000;\">River Kali originates from a smaller rivulet named Pankhagad<\/span>. It lies on the southern portion of Kalapani. Hence, it is the true border, and the Kalapani territory lies in India.<\/p>\n<p><span style=\"color: #000000;\"><strong>b. Lipulekh and Limpiyadhura region<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\">Lipulekh and Limpayadhura<\/span> (Limpiya pass) located on the <span style=\"color: #ff0000;\">Nepal-Tibet border<\/span>. <span style=\"color: #ff0000;\">Lipulekh<\/span> is the <span style=\"color: #ff0000;\">shortest route to reach Taklakot<\/span>, a Tibetan township of China.<\/p>\n<p>Nepal claims that the Indian army has encroached on both regions during the 1962 territorial offering of King Mahendra.<\/p>\n<p><span style=\"color: #000000;\"><strong>c. Susta Region (West Champaran)<\/strong><\/span><\/p>\n<p>Susta, is <span style=\"color: #ff0000;\">another disputed area in the India-Nepal border<\/span>. It is a <span style=\"color: #ff0000;\">145-sq-km area<\/span> that had <span style=\"color: #ff0000;\">fallen on the Indian side<\/span> after the <span style=\"color: #ff0000;\">River Gandak<\/span> changed course.<\/p>\n<p>During the <span style=\"color: #ff0000;\">1816 Treaty of Sugauli<\/span>, the <span style=\"color: #ff0000;\">west side of the Gandak river<\/span> belongs to Nepal and the <span style=\"color: #ff0000;\">Eastern part of the river belongs to India<\/span>. But due to frequent change of course by the Gandak river, the Susta region at present belongs to the Eastern part. This is not accepted by Nepal.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What steps have been taken for the resolution of India-Nepal Boundary Dispute?<\/strong><\/span><\/h2>\n<p><strong>a.<\/strong> In the 1980s, India and Nepal set up the <span style=\"color: #ff0000;\">Joint Technical Level Boundary Working Group<\/span> to delineate their boundary. The group demarcated <span style=\"color: #ff0000;\"><span style=\"color: #333333;\">every border except<\/span> Kalapani <span style=\"color: #333333;\">and<\/span> Susta area<\/span>.<\/p>\n<p><span style=\"color: #333333;\"><strong>b.<\/strong> <span style=\"color: #ff0000;\">In 1988<\/span>, Nepal officially brought the <span style=\"color: #ff0000;\">issue of Kalapani before India<\/span>. Prime Minister I K Gujral (April 1997-March 1998) promised to give up these areas if Nepal was able to produce evidence for its claim.<\/span><\/p>\n<p><strong>c.<\/strong> <span style=\"color: #ff0000;\">In 2000<\/span>, at the prime ministerial level talk held between PM Atal Bihari Vajpayee and the visiting Nepal PM G P Koirala,<span style=\"color: #ff0000;\"> both the sides agreed to demarcate the outstanding areas (including Kalapani) by 2002<\/span>. However, the mechanism led by the two foreign secretaries did not make progress.<\/p>\n<p><strong>d.<\/strong> <span style=\"color: #ff0000;\">In 2014<\/span>, at the meeting between <span style=\"color: #ff0000;\">PM Narendra Modi<\/span> and <span style=\"color: #ff0000;\">his Nepali Counterpart Sushil Prasad Koirala<\/span>, it was agreed to set up a boundary working group for speedy settlement of the border issue in Kalapani and Susta.<\/p>\n<p>However, the issue has not been resolved between the two countries. Recently, a Constitutional Amendment Bill was passed by Nepal\u2019s parliament to legitimize the alteration to the country\u2019s map with the addition of Kalapani, Lipulekh and Limpiyadhura.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>Why is the early resolution of the Border Dispute between India and Nepal necessary for both the parties?<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\"><strong>Nepal\u2019s importance to India<\/strong><\/span><\/p>\n<p><strong>a. Strategic location-<\/strong> Nepal shares a border of about <span style=\"color: #ff0000;\">1850 km<\/span> with five Indian States \u2013 <span style=\"color: #ff0000;\">Uttarakhand<\/span>, <span style=\"color: #ff0000;\">Uttar Pradesh<\/span>, <span style=\"color: #ff0000;\">Bihar<\/span>, <span style=\"color: #ff0000;\">West Bengal<\/span> and <span style=\"color: #ff0000;\">Sikkim<\/span>. This makes it an <span style=\"color: #ff0000;\">important buffer state for India\u2019s security interests<\/span>.<\/p>\n<p><strong>b. Connectivity-<\/strong> Nepal provides a crucial transit route for India to connect with other neighbouring countries and enhance regional connectivity. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">The location of Lipulekh pass provides connectivity to Tibetan region<\/span>.<\/p>\n<p><strong>c. Energy cooperation-<\/strong> Nepal\u2019s hydropower potential can contribute to <span style=\"color: #ff0000;\">India\u2019s renewable energy requirements<\/span>. This will <span style=\"color: #ff0000;\">help India to fulfil its Panchamrit obligations<\/span>.<\/p>\n<p><strong>d. Regional stability-<\/strong> A stable and friendly Nepal is essential for India\u2019s overall regional stability and influence. It will also help to <span style=\"color: #ff0000;\">counter the growing Chinese influence in the region<\/span>.<\/p>\n<p><strong><span style=\"color: #000000;\">India\u2019s importance to Nepal<\/span><\/strong><\/p>\n<p><strong>a. Economic dependence-<\/strong> <span style=\"color: #ff0000;\">Nepal relies on India for trade and transportation of goods<\/span>, as well as access to sea routes.<\/p>\n<p><strong>b. Cultural and religious Ties-<\/strong> <span style=\"color: #ff0000;\">India and Nepal share a deep cultural and religious heritage<\/span>, which strengthens their social bonds.<\/p>\n<p><strong>c. Assistance and support-<\/strong> During times of crisis, such as the <span style=\"color: #ff0000;\">2015 earthquake and pandemic<\/span>, India has provided significant aid and support to Nepal.<\/p>\n<p><strong>d. Infrastructure development-<\/strong> India\u2019s involvement in infrastructure projects, such as hydropower, contributes to Nepal\u2019s economic growth and development.<\/p>\n<p><strong>e. Cartographic Disagreements-<\/strong> India and Nepal have disputes over the historical maps issued by the British Surveyor General of India in <span style=\"color: #ff0000;\">1819<\/span>, <span style=\"color: #ff0000;\">1821<\/span>, <span style=\"color: #ff0000;\">1827<\/span>, <span style=\"color: #ff0000;\">1856<\/span>, <span style=\"color: #ff0000;\">1921<\/span> and <span style=\"color: #ff0000;\">1947<\/span>.<\/p>\n<p><strong>b. Frequently changing courses of rivers-<\/strong> Since the boundaries have been demarcated based on the drainage pattern of the rivers, the meandering of these rivers have resulted in boundary disputes. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Meandering of Gandak river causing the emergence of Susta dispute<\/span>.<\/p>\n<p><strong>c.<\/strong> <strong>Growing Chinese influence-<\/strong> There has been an <span style=\"color: #ff0000;\">increase in the Chinese Influence in the domestic affairs of Nepal<\/span>. This has also resulted in the aggravation of the Border Disputes.<\/p>\n<p><strong>d. Anti India Feeling-<\/strong> The <span style=\"color: #ff0000;\">134-day blockade of Nepal in September 2015<\/span> and the <span style=\"color: #ff0000;\">Madheshi issue<\/span> has created significant distrust against India. This has led to the<span style=\"color: #ff0000;\"> prolongation of the border dispute between India and Nepal. <span style=\"color: #333333;\">It has prompted Nepal to sign a<\/span> trade and<\/span>\u00a0<span style=\"color: #ff0000;\">transit agreement with China<\/span> in order to create a fallback source for the supply of essential goods.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc5\"><\/a>What Should be the Way Forward?<\/strong><\/span><\/h2>\n<p><strong>1. Establishment of permanent mechanism of Boundary Dispute Resolution-\u00a0<\/strong>A permanent mechanism of Boundary Dispute resolution must be established between India and Nepal for peaceful resolution of Disputes through Diplomatic Channels. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Nepal sorting out its boundary issues with China in the early 1960s<\/span>.<\/p>\n<p><strong>2. Addressing the geographical and ecological concerns-<\/strong> A <span style=\"color: #ff0000;\">consultative approach needs to be evolved<\/span> where ecological concerns and the changing geographical patterns of the rivers are addressed.<\/p>\n<p><strong>3. Mutual addressal of Concerns-<\/strong> The Nepal government has to <span style=\"color: #ff0000;\">shed<\/span> its <span style=\"color: #ff0000;\">rigid stance of territorial nationalism<\/span> and the <span style=\"color: #ff0000;\">Indian Government must shed its big brother attitude to arrive at mutual consensus<\/span> to resolve their boundary concerns.<\/p>\n<p>The India-Nepal relationship is a unique relationship, built by friendship and cooperation with cultural and civilizational links. The border dispute is one of the important issues to solve to take ahead India and Nepal relations to another level.
