SC has <span style=\"color: #ff0000;\">invalidated the arrest<\/span>, citing that \u201c<span style=\"color: #ff0000;\">grounds of arrest<\/span>\u201d were not provided to Prabir Purkayastha as required by the <span style=\"color: #ff0000;\">Constitution\u2019s Article 22<\/span> before his production before the Additional Sessions Judge (ASJ).<\/p>\n<p>The SC judgement has <span style=\"color: #ff0000;\">highlighted the importance of due process of law<\/span>. It is a <span style=\"color: #ff0000;\">constitutional guarantee<\/span> that<span style=\"color: #ff0000;\"> prevents governments from impacting citizens in an abusive way<\/span>.<\/p>\n<p>It is not just a procedural safeguard. It involves the <span style=\"color: #ff0000;\">right to fairness<\/span>, <span style=\"color: #ff0000;\">reasonableness<\/span>,<span style=\"color: #ff0000;\"> justness<\/span>, <span style=\"color: #ff0000;\">non-arbitrariness<\/span>.<\/p>\n<p><strong>Types of Due Process<\/strong><\/p>\n<p><strong>Procedural Due Process-<\/strong> Procedural due process refers to the <span style=\"color: #ff0000;\">legal procedures that must be followed to protect the rights of individuals<\/span>. Procedural due process focuses on how laws and actions are carried out, ensuring that individuals receive fair treatment through the judicial process.<\/p>\n<p><strong>Substantive Due Process-<\/strong> Substantive due process <span style=\"color: #ff0000;\">focuses on the content of laws and government actions<\/span>. It protects individuals from laws and government actions that<span style=\"color: #ff0000;\"> may infringe on fundamental rights and liberties<\/span>, even if the procedures used to implement them are fair.<\/p>\n<p><span style=\"color: #000000;\"><strong>Evolution of Concept of Due Process of Law\u00a0<\/strong><\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">1. <span style=\"color: #ff0000;\">Magna Carta<\/span> (<span style=\"color: #ff0000;\">1215<\/span>), which was the first major human rights instrument, talked of only procedural rights.<br \/>\n2. The expression &#8216;due process&#8217; was used for the first time in the statute of British King Edward III.<br \/>\n3. <span style=\"color: #ff0000;\">Fifth Amendment to the American Constitution<\/span> (<span style=\"color: #ff0000;\">1791<\/span>) that introduced the concept of \u201cdue process\u201d in a constitution.<br \/>\n4. <span style=\"color: #ff0000;\">The Fourteenth\u00a0Amendment to the American Constitution<\/span> prohibited the curtailment of the right\u00a0to equality, the right to life and liberty, without the due process of law.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong><span style=\"color: #000000;\">History of due process in India<\/span><\/strong><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">1. In 1918, the Indian National Congress asked the colonial government to <span style=\"color: #ff0000;\">revoke all laws that allowed state authorities to arrest or detain people without due process<\/span>. Balgangadhar Tilak and M K Gandhi invoked due process in their defence against unjust laws.<br \/>\n2. The proponents of Due process, in the constituent assembly, held that &#8216;<span style=\"color: #ff0000;\">due process of law&#8217; provided minimum standards of fairness<\/span>. Without it, Article 21 cannot be termed a Fundamental Right. They feared that people would be detained without trial on false pretences.<br \/>\n2. However, In Article 21 of the constitution, &#8216;<span style=\"color: #ff0000;\">due process<\/span>&#8216; was replaced by the narrower expression &#8216;<span style=\"color: #ff0000;\">procedure established by law<\/span>&#8216;.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>SC Decisions on Due Process of Law<\/strong><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 29.8788%;\"><strong>A K Gopalan (1950)<\/strong><br \/>\n<strong>ADM Jabalpur (1976)<\/strong><\/td>\n<td style=\"width: 70.1212%;\">SC <span style=\"color: #ff0000;\">overemphasised the literal meaning of procedure established by law<\/span>. It contributed to <span style=\"color: #ff0000;\">undermining of due process of law<\/span>.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.8788%;\"><strong>Maneka Gandhi v. Union of India (1978) <\/strong><\/td>\n<td style=\"width: 70.1212%;\"><span style=\"color: #ff0000;\">Due process was judicially recognised as part of the right to life and personal liberty<\/span>. Every law must now be reasonable, just, fair and non-arbitrary.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 29.8788%;\"><strong>K. S. Puttaswamy v. Union of India (2019)<\/strong><\/td>\n<td style=\"width: 70.1212%;\">SC held that the substitution of <span style=\"color: #ff0000;\">due process of law<\/span>, by <span style=\"color: #ff0000;\">procedure established by law<\/span> by the Drafting Committee, has made it more cryptic and ambiguous.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What is the difference between procedure established by Law and Due process of Law?<\/strong><\/span><\/h2>\n<p>Due process of law and procedure established by law differ primarily in protecting citizen&#8217;s rights. Due process ensures fairness and justice by safeguarding rights, while the procedure established by law has a limited focus and may not prioritize citizens&#8217; rights.<\/p>\n<table style=\"height: 240px; width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr style=\"height: 30px;\">\n<td style=\"width: 50%; text-align: center; height: 30px;\"><span style=\"color: #000000;\"><strong>The procedure established by Law<\/strong><\/span><\/td>\n<td style=\"width: 50%; text-align: center; height: 30px;\"><span style=\"color: #000000;\"><strong>Due process of Law <\/strong><\/span><\/td>\n<\/tr>\n<tr style=\"height: 30px;\">\n<td style=\"width: 50%; height: 30px;\">1. Protection of Individual Rights-<\/strong> Due process ensures that <span style=\"color: #ff0000;\">individuals are protected from arbitrary and unjust actions by the government<\/span>. It guarantees that <span style=\"color: #ff0000;\">no person will be deprived of life, liberty, or property<\/span> without fair procedures and safeguards. (Protection of rights under Article 21 of the Constitution)<\/p>\n<p><strong>2. Establishment of Fair Legal Procedures-<\/strong> It includes<span style=\"color: #ff0000;\"> the right to a fair trial<\/span>, <span style=\"color: #ff0000;\">the right to be heard<\/span>, and the <span style=\"color: #ff0000;\">right to an impartial judge<\/span>. These procedural protections help prevent wrongful convictions and ensure justice is served. <strong>For ex-<\/strong> SC judgement on release of prisoners under preventive detention.<\/p>\n<p><strong>3. Equality Before the Law-<\/strong> It <span style=\"color: #ff0000;\">promotes equality<\/span> by ensuring that all individuals receive the same legal protections and are subject to the same laws. It prevents discrimination and ensures that everyone is treated fairly regardless of their status.<\/p>\n<p><strong>4. Limitation of Government Power-<\/strong> It <span style=\"color: #ff0000;\">prevents the government from enacting and enforcing laws in an arbitrary manner<\/span>, ensuring that all actions are conducted according to the rule of law.<\/p>\n<p><strong>5. Prevent the misuse of preventive detention laws-<\/strong> As per the National Crime Records Bureau (NCRB) over <span style=\"color: #ff0000;\">12,000 people were in prisons in 2021<\/span> under preventive detention laws. Application of due process principle can help in preventing the misuse of the preventive detention laws.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What should be the way Forward?<\/strong><\/span><\/h2>\n<p><strong>1. Providing &#8216;Grounds of arrest&#8217; must be strictly followed-<\/strong> The principle laid down in<span style=\"color: #ff0000;\"> Pankaj Bansal (2023)<\/span> regarding the practice of providing the written ground of arrest must be applied to persons arrested under UAPA act.<\/p>\n<p><strong>2. Prevent the misuse of Preventive detention laws-<\/strong> SC in <span style=\"color: #ff0000;\">Pramod Singla case (2023)<\/span> termed preventive detention laws as a colonial legacy with great potential of abuse. India has several stringent preventive detention laws, both at the Centre and state levels. Efforts must be made to prevent the misuse of preventive detention laws.<\/p>\n<p><strong>3. Notification of preventive detention provisions of 44th Amendment Act-<\/strong> <span style=\"color: #ff0000;\">44th Amendment (1978) made the right to life and personal liberty a non-derogable right<\/span> that can no longer be suspended, even during an emergency.
