Chandrachud is slated to a petition filed by the NGO Association for Democratic Reforms (ADR), regarding the <span style=\"color: #ff0000;\">discrepancies in Voter Turnout Data<\/span>. The petition seeks SC to give <span style=\"color: #ff0000;\">directions to the Election Commission of India<\/span> (<span style=\"color: #ff0000;\">ECI<\/span>) to <span style=\"color: #ff0000;\">upload polling station-wise voter turnout data<\/span> on its website within <span style=\"color: #ff0000;\">48 hours of the conclusion of polling for each phase<\/span> of the Lok Sabha elections.<\/p>\n<p>Also, the <span style=\"color: #ff0000;\">voter turnout has showed a notable decline across several states<span style=\"color: #333333;\">, <\/span><\/span>compared to the 2019 and 2014 elections. <span style=\"color: #000000;\">For ex-<\/span> <span style=\"color: #ff0000;\">Assam has witnessed a drop from 85.3% in 2019 to 74.6% in 2024<\/span>. Enhanced accountability and representation-<\/strong> High voter turnout holds politicians more accountable to their constituents. It also ensures the institution of a more representative government, appealing for a<span style=\"color: #ff0000;\">\u00a0larger and more diverse electorate<span style=\"color: #333333;\">.<\/span><\/span><\/p>\n<p><strong>3. Promotes Democratic Health and Civic Education-\u00a0<\/strong>A<span style=\"color: #ff0000;\"> high and transparent voter turnout<\/span> is an indicator of a healthy democracy with strong civic norms and institutions. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Ease of voting<\/span>, <span style=\"color: #ff0000;\">competitive electoral process<\/span> and <span style=\"color: #ff0000;\">strong political participation<span style=\"color: #333333;\">.<\/span><\/span><\/p>\n<p><strong>4. Social Cohesion-\u00a0<\/strong>Lower participation of voters, exacerbate feelings of alienation and division within society, which <span style=\"color: #ff0000;\">undermines the social fabric and national unity<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What are the issues related to Voter Turnout In India?<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\"><strong><a id=\"toc6\"><\/a>1. Opacity in Voter Turnout Calculation and Publication<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #333333;\">Availability of Proper data is important to calculate the actual voter turnout. It is also important to compare it to the past trends, so that corrective actions can be taken to resolve issues faced by voters. <\/span><\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #333333;\">The recent controversy, highlighting discrepancies in the calculation and publication of Voter turnout data, has evoked sharp criticisms from the Opposition and civil society. Following are the details of the controversy:<\/span><\/span><\/p>\n<p><b>a.<\/b>\u00a0<strong>A significant delay and a sizeable difference in the initial turnout figures released by the ECI and the final voter percentages published subsequently. <\/strong><\/p>\n<p>Only voting percentages have been published by the ECI. There has been <span style=\"color: #ff0000;\">significant delay on the part of ECI to publish the final voter percentage<\/span>. The final voter percentage has been published <span style=\"color: #ff0000;\">11 days after the first phase of polling held on April 19<\/span> and <span style=\"color: #ff0000;\">4 days after the second phase of polling held on April 26<\/span>.<\/p>\n<p>The <span style=\"color: #ff0000;\">provisional polling percentages<\/span> for the <span style=\"color: #ff0000;\">first phase<\/span> released by the ECI at 7 pm on April 19 was about <span style=\"color: #ff0000;\">60%<\/span> and for the <span style=\"color: #ff0000;\">second phase<\/span> on April 26 was <span style=\"color: #ff0000;\">60.96%<\/span>. However, there has been a substantial increase in the final figures released by ECI. <span style=\"color: #ff0000;\">For the first phase<\/span>, it stood at <span style=\"color: #ff0000;\">66.14%<\/span> (an increase of more than 5.5%) and for the <span style=\"color: #ff0000;\">second phase<span style=\"color: #333333;\">, it stood at<\/span> 66.71%<\/span> (an increase of more than 5.74%).<\/p>\n<p><strong>b. Non publication of the absolute number of votes polled in constituency as contained in Form 17C by the ECI<\/strong><\/p>\n<p>Political parties have raised the concerns regarding the<span style=\"color: #ff0000;\"> ECI&#8217;s preclusion from publishing the exact voter turnout data of each polling station<\/span>, as contained in Form 17C. Also, some candidates have complained about the delay in receiving Form 17C from the returning officer.<\/p>\n<p>As per the <span style=\"color: #ff0000;\">Conduct of Election Rules, 1961 Rules<\/span>, the ECI has to maintain two forms that have data on the number of electors and the votes polled- <span style=\"color: #ff0000;\">Forms 17A<\/span> and <span style=\"color: #ff0000;\">17C<\/span>.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 20.0606%;\"><strong>Form 17A<\/strong><\/td>\n<td style=\"width: 79.9394%;\">It is<span style=\"color: #ff0000;\"> used to record the details of every voter<\/span> who comes into a polling booth and casts his or her vote.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 20.0606%;\"><strong>Form 17C<\/strong><\/td>\n<td style=\"width: 79.9394%;\">It is an <span style=\"color: #ff0000;\">account of all the actual votes recorded<\/span>. It contains information about the <span style=\"color: #ff0000;\">total number of voters as entered in the register for voters<\/span> (<span style=\"color: #ff0000;\">Form 17A<\/span>), the <span style=\"color: #ff0000;\">number of voters who decided not to record their votes<\/span> after signing the register and the <span style=\"color: #ff0000;\">number of voters who were not allowed to vote<\/span>.<br \/>\n<span style=\"color: #ff0000;\">Part I of Form 17C<\/span> also contains crucial information like-<br \/>\na. The identification numbers of the EVMs used in the polling station<br \/>\nb. The total number of test votes and votes recorded per EVM<br \/>\nb. The total number of electors assigned to the polling station<br \/>\n<span style=\"color: #ff0000;\">Part II<\/span> of Form 17C\u00a0<span style=\"color: #ff0000;\">contains the results of the counting<\/span> carried out on the stipulated day.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>The <span style=\"color: #ff0000;\">data in Form 17C is used by candidates to verify the results<\/span> on the counting day by matching it with the EVM count. An election petition can be moved in the concerned High Court in case of any discrepancies.<\/p>\n<p><span style=\"color: #000000;\"><strong><a id=\"toc7\"><\/a>2. Decreasing Voter Turnout<\/strong><\/span><\/p>\n<p>Voter Turnout has declined in both rural and urban areas. <span style=\"color: #333333;\">There are few reasons which are leading to a decline in the voting percentage, both in urban and rural areas:<\/span><\/p>\n<p><strong>a. Urban Voter Apathy-<\/strong> Parliamentary constituencies in various urban cities such as Mumbai, Thane, Nashik and Lucknow have displayed the <span style=\"color: #ff0000;\">trend of urban apathy in voting<\/span>.<\/p>\n<p><strong>b. Missing Voter Slips-<\/strong> Voters have also complained of deletion of their names from the electoral rolls and not being provided the voter slips in time for voting.<\/p>\n<p><strong>c. Heat impacting Voter Turnout-<\/strong> The extreme heat of April and May has affected voter turnout by discouraging people, <span style=\"color: #ff0000;\">especially those in rural areas<\/span>, from travelling long distances to vote.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What Steps have been taken by the Election Commission to address the issues with Voter Turnout?<\/strong><\/span><\/h2>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 22.3636%;\"><span style=\"color: #000000;\"><strong>Transparency in Voter Turnout Calculation and Publication<\/strong><\/span><\/td>\n<td style=\"width: 77.6364%;\"><strong>Mandatory sharing of Form 17C-<\/strong> Copies of Form 17C are shared by the presiding officers with polling agents present under <span style=\"color: #ff0000;\">Rule 49S(2) of the Conduct of Election Rules<\/span>, <span style=\"color: #ff0000;\">1961<span style=\"color: #333333;\">.<\/span> <span style=\"color: #333333;\">Hence, the candidates are aware and in possession of exact voter turnout data in absolute numbers even before it is known to the ECI.<br \/>\n<\/span><\/span><\/td>\n<\/tr>\n<tr>\n<td style=\"width: 22.3636%;\"><span style=\"color: #000000;\"><strong>Increasing Voter Turnout<\/strong><\/span><\/td>\n<td style=\"width: 77.6364%;\"><strong>Addressing Voter Apathy<br \/>\na. Systematic Voter Education and Electoral Participation (SVEEP) program-<\/strong> ECI launched the Systematic Voter Education and Electoral Participation (SVEEP) program in 2010 to <span style=\"color: #ff0000;\">educate voters about the importance of voting<\/span>.<br \/>\n<strong>b. Turnout Implementation Plan (TIP)-<\/strong> Targeted interventions under the Turnout Implementation Plan (TIP) have been undertaken to <span style=\"color: #ff0000;\">boost participation in low turnout constituencies<\/span>.<br \/>\n<strong>c. Revision of electoral rolls-<\/strong> Regular revision of electoral rolls to remove duplicate and ineligible names while adding new eligible voters has been undertaken by ECI.<br \/>\n<strong>Heat Wave Impact<br \/>\na. Task Force Creation:<\/strong> The Election Commission of India has formed a task force with officials from the <span style=\"color: #ff0000;\">IMD<\/span>, <span style=\"color: #ff0000;\">NDMA<\/span>, and <span style=\"color: #ff0000;\">MoHFW<\/span> to review the impact of heat waves and humidity.<br \/>\n<strong>b.Health Authority Instructions<\/strong>: EC has directed the <span style=\"color: #ff0000;\">MoHFW to prepare state health authorities for assisting in heat wave conditions<\/span> affecting election operations.<br \/>\n<strong>c. Online Publication of absolute voting data by ECI based on Form 17C data-<\/strong> ECI refrains from disclosing Form 17C data as they <span style=\"color: #ff0000;\">fear<\/span> \u2018<span style=\"color: #ff0000;\">confusion in the minds of voters<\/span>\u2019 as it also includes postal ballot counts. ECI also <span style=\"color: #ff0000;\">fears misuse by persons with motivated interests to cast aspersion on the whole electoral process<\/span>.<\/p>\n<p>However, ECI must take progressive steps to allay these fears and publish absolute voting data of Form 17C on its website, as <span style=\"color: #ff0000;\">smaller political parties cannot afford to have polling agents in all booths or constituencies<\/span> due to financial constraints.<\/p>\n<p><strong>2. Ready availability of Form 17C-<\/strong> The <span style=\"color: #ff0000;\">issues of delay in providing Form 17C data by the returning officers<\/span> must be addressed by the ECI.<\/p>\n<p><strong>3. Rescheduling of Elections- <\/strong>ECI must consider a<span style=\"color: #ff0000;\">djusting the election timetable to cooler months<\/span> to enhance voter comfort and participation, avoiding the peak heat of April to June.<\/p>\n<p><strong>4. Enhancement of On-site Facilities-<\/strong> There must be <span style=\"color: #ff0000;\">expansion of the provision of shelters<\/span>, <span style=\"color: #ff0000;\">fans<\/span>, and <span style=\"color: #ff0000;\">water at all polling stations<\/span>, to better accommodate voters and staff during hot weather.<\/p>\n<p><strong>5.
