{"id":296837,"date":"2024-05-24T18:44:52","date_gmt":"2024-05-24T13:14:52","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=296837"},"modified":"2024-05-24T18:45:18","modified_gmt":"2024-05-24T13:15:18","slug":"foreigners-tribunals-fts","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/foreigners-tribunals-fts\/","title":{"rendered":"Foreigners Tribunals (FTs)"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Source<\/strong>-This post on <strong>Foreigners Tribunals (FTs)<\/strong> has been created based on the article <a href=\"https:\/\/www.barandbench.com\/news\/supreme-court-halts-deportation-cooch-behar-woman-declared-foreigner-tribunal\">&#8220;Supreme Court halts deportation of Cooch Behar woman declared foreigner by tribunal&#8221;<\/a> \u00a0published in \u201c<b>Bar and Bench<\/b>\u201d on 24 May 2024.<\/p>\n<h2 style=\"text-align: justify;\">Why in News?<\/h2>\n<p style=\"text-align: justify;\">The Supreme Court recently stopped the deportation of a woman who had been declared a foreigner by a Foreigners&#8217; Tribunal in Assam.<\/p>\n<h2 style=\"text-align: justify;\">About Foreigners Tribunals (FTs)<\/h2>\n<p style=\"text-align: justify;\">1.\u00a0 Foreigners Tribunals were established <span style=\"color: #ff0000;\">under the Foreigners (Tribunals) Order, 1964,<\/span> which was enacted by the Central government utilizing powers from Section 3 of the Foreigners Act, 1946.<\/p>\n<p style=\"text-align: justify;\"><strong>2. Geographical Application:<\/strong> While <span style=\"color: #ff0000;\">applicable across India,<\/span> FTs are currently <span style=\"color: #ff0000;\">operational only in Assam.<\/span> In other states, suspected illegal immigrants are presented before local courts under the Foreigners Act, 1946.<\/p>\n<p style=\"text-align: justify;\"><strong>3. Recent amendment:<\/strong> Initially, only the Central government could establish FTs. The <span style=\"color: #ff0000;\">2019 amendment<\/span> to the Foreigners (Tribunals) Order granted this power to state governments as well.<\/p>\n<p style=\"text-align: justify;\"><strong>4. Role and Functions of FTs<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>a) Detection of Suspected Foreigners:<\/strong> The superintendents of police (SPs) and district commissioners identify suspected foreigners. The Election Commission of India can also refer cases of &#8216;Doubtful&#8217; voters to the local SP, who then refers them to the FTs.<\/p>\n<p style=\"text-align: justify;\"><strong>b) National Register of Citizens (NRC): I<\/strong>ndividuals excluded from the final draft of the NRC released in August 2019, can appeal to the FTs to establish their citizenship.<\/p>\n<p style=\"text-align: justify;\"><strong>5. Procedures Followed by FTs<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>a) Issuance of Notices:<\/strong> Upon receiving a referral, the tribunal serves the suspected individual with a copy of the grounds of suspicion and a show-cause notice within 10 days, indicating the burden of proof lies with the individual to demonstrate they are not a foreigner.<\/p>\n<p style=\"text-align: justify;\"><strong>b) Opportunity for Defense:<\/strong> The FT provides the individual a fair chance to make a representation in person or via a lawyer and to present evidence supporting their claim of citizenship.<\/p>\n<p style=\"text-align: justify;\"><strong>c) Consequences of Non-Compliance:<\/strong> If the individual fails to prove their citizenship and cannot secure bail, the FT orders their detention and transfer to a detention center.<\/p>\n<p style=\"text-align: justify;\"><strong>6.
