Article 329(b) is part of <span style=\"color: #ff0000;\">Part XV of the Constitution,<\/span> which specifically addresses electoral issues.<\/p>\n<p><strong>2. Judicial Role in Electoral Matters:<\/strong><\/p>\n<p><span style=\"color: #ff0000;\">a) Article 329(a)<\/span> restricts the judiciary from questioning the constitutionality of laws concerning electoral district boundaries or seat allocation.<\/p>\n<p><span style=\"color: #ff0000;\">b) Article 329(b)<\/span> as amended by the<span style=\"color: #ff0000;\"> Constitution (19th Amendment) Act of 1966,<\/span> states that elections to either house of Parliament or state legislatures can only be challenged through an election petition as outlined by law.<\/p>\n<p><strong>3. Legal Framework for Election Petitions:<\/strong> The<span style=\"color: #ff0000;\"> Representation of the People Act, 1951,<\/span> specifies that high courts are the authorities empowered to hear and decide election petitions. \u00a0Decisions from these petitions can be appealed to the Supreme Court.<\/p>\n<p><strong>4. Supreme Court Interpretations<\/strong><\/p>\n<p><strong>a) Ponnuswamy Judgment (1952): <\/strong>The Supreme Court in &#8220;Ponnuswami v. Returning Officer, Namakkal&#8221;<span style=\"color: #ff0000;\"> clarified that the term &#8220;election&#8221; in Article 329(b) encompasses the entire electoral process,<\/span> from the notification of election to the declaration of results. It established that the courts cannot interfere with the electoral process once it has begun, until its completion.<\/p>\n<p><strong>b) Venkatachalam vs. A.
