{"id":29891,"date":"2018-10-26T12:56:27","date_gmt":"2018-10-26T07:26:27","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=29891"},"modified":"2018-10-26T12:56:27","modified_gmt":"2018-10-26T07:26:27","slug":"minority-institutions-panel-gets-court-relief","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/minority-institutions-panel-gets-court-relief\/","title":{"rendered":"Minority institutions panel gets court relief"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/supreme-court-rules-ncmei-has-wide-powers\/article23597018.ece\"><strong>Minority institutions panel gets court relief<\/strong><\/a><\/p>\n<p><strong>Context<\/strong><\/p>\n<p>NCMEI has jurisdiction to determine minority status: SC<\/p>\n<p><strong>What has happened?<\/strong><\/p>\n<p>The Supreme Court on Wednesday held that the National Commission for Minority Educational Institutions (NCMEI) has original jurisdiction to determine which institution should be granted minority status<\/p>\n<p><strong>SC observed<\/strong><\/p>\n<ul>\n<li>Constitution granted a fundamental right to all minorities, whether based on religion or language, to establish and administer educational institutions of their choice<\/li>\n<li>NCMEI Act empowered the Commission \u201cto decide all questions relating to the status of an institution as a minority educational institution and to declare its status as such.\u201d<\/li>\n<li>The court held that the NCMEI had the power to decide any question that might arise, which relate directly or indirectly, with respect to the status of an institution as a minority educational institution.<\/li>\n<\/ul>\n<p><strong>At all stages<\/strong><\/p>\n<p>The Supreme Court held that the NCMEI could declare an establishment as a minority educational institution \u201cat all stages.\u201d<\/p>\n<p><strong>2006 amendments<\/strong><\/p>\n<ul>\n<li>Amendments to the NCMEI Act introduced a \u201csea change\u201d to the Commission\u2019s powers<\/li>\n<li>The 2006 amendments even conferred powers of appeal against orders of the competent authority to the NCMEI<\/li>\n<li>A power of cancellation was also vested in the NCMEI to cancel a certificate granted either by an authority or the NCMEI<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Minority institutions panel gets court relief Context NCMEI has jurisdiction to determine minority status: SC What has happened?
