According to the survey, <span style=\"color: #ff0000;\">sexual harassment is widespread in different job sectors<\/span>. The sexual harassment varies from vulgar comments to an outright demand for sexual favours.<\/p>\n<p>According to the <span style=\"color: #ff0000;\">Ministry of Women and Child development between 2015-2017<\/span>, a total of <span style=\"color: #ff0000;\">1631 cases<\/span> had been filed under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. There has been a <span style=\"color: #ff0000;\">wide disparity among states<\/span>, with Uttar Pradesh recording for nearly 25% of all cases, followed by Delhi (16%).<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What is the POSH Act? What are the important provisions of the Protection of Women from Sexual Harassment Act (POSH Act)?<\/strong><\/span><\/h2>\n<p><strong>About the Act-<\/strong> The POSH Act is a legislation enacted by the<span style=\"color: #ff0000;\"> Government of India in 2013<\/span> to <span style=\"color: #ff0000;\">address the issue of sexual harassment faced by women<\/span> in the workplace. The Act aims to create a safe and conducive work environment for women and provide protection against sexual harassment.<\/p>\n<p><strong>Background of Enaction-<\/strong> The Supreme Court in the landmark judgment in the <span style=\"color: #ff0000;\">Vishakha and others v State of Rajasthan 1997<\/span> case gave the \u2018<span style=\"color: #ff0000;\">Vishakha guidelines<\/span>\u2019 for prevention of sexual harassment at workplace.<br \/>\nIndia has also signed the<span style=\"color: #ff0000;\"> CEDAW<\/span> (<span style=\"color: #ff0000;\">Convention on the Elimination of all Forms of Discrimination against Women<\/span>) 1980. India has also ratified the convention later.<\/p>\n<p>The POSH Act was enacted to give a statutory and a legal backing to these guidelines and Conventions.<\/p>\n<p><span style=\"color: #000000;\"><strong>Important Provisions of the POSH Act<\/strong><\/span><\/p>\n<p><strong>1. Definition of Sexual Harassment-<\/strong> The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act) <span style=\"color: #ff0000;\">defines sexual harassment as one or more of the following unwelcome acts or behavior<\/span>. Such as<br \/>\n(i) physical contact and advances; or<br \/>\n(ii) a demand or request for sexual favours; or<br \/>\n(iii) making sexually colored remarks; or<br \/>\n(iv) showing pornography; or<br \/>\n(v) any other unwelcome physical, verbal or non-verbal conduct of sexual nature;<\/p>\n<p><strong>2. Prevention and Prohibition-<\/strong> The Act places a <span style=\"color: #ff0000;\">legal obligation on employers<\/span> to <span style=\"color: #ff0000;\">prevent<\/span> and <span style=\"color: #ff0000;\">prohibit sexual harassment<\/span> in the workplace.<\/p>\n<p><strong>3. Internal Complaints Committee (ICC)-<\/strong> The employers are required to constitute an <span style=\"color: #ff0000;\">Internal Complaints Committee<\/span> (ICC) at each workplace with <span style=\"color: #ff0000;\">10 or more employees<\/span> to receive and address complaints of sexual harassment. The Complaints Committees <span style=\"color: #ff0000;\">have the powers of civil courts<\/span> for gathering evidence.<\/p>\n<p><strong>4. Duties of Employers-<\/strong> According to the Act, the employers must <span style=\"color: #ff0000;\">undertake awareness programs<\/span>, <span style=\"color: #ff0000;\">provide a safe working environment<\/span>, and <span style=\"color: #ff0000;\">display information about the POSH Act<\/span> at the workplace.<\/p>\n<p><strong>5. Complaint Mechanism-<\/strong> The POSH Act lays down a <span style=\"color: #ff0000;\">procedure for filing complaints<\/span>, <span style=\"color: #ff0000;\">conducting inquiries<\/span>, and <span style=\"color: #ff0000;\">providing a fair opportunity<\/span> to the parties involved.<\/p>\n<p><strong>6. Penalties-<\/strong> Non-compliance with the Act&#8217;s provisions can result in penalties, including fines and cancellation of business licenses.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What is the Significance of the Prevention of Sexual Harassment at Workplace Act in India?<\/strong><\/span><\/h2>\n<p><strong>1. Ensures Emotional Well-Being of women-<\/strong> Sexual harassment <span style=\"color: #ff0000;\">can endanger the victim\u2019s emotional and mental health<\/span>. It can lead to the <span style=\"color: #ff0000;\">loss of self-esteem<\/span>, and it <span style=\"color: #ff0000;\">may even compromise personal relationships.<\/span> Hence, the Act aims to ensure the emotional well-being of women in India.<\/p>\n<p><strong>2. Improved Physical Health-<\/strong> Weak emotional health often leads to <span style=\"color: #ff0000;\">physical health issues<\/span>, such as <span style=\"color: #ff0000;\">loss of appetite<\/span>, <span style=\"color: #ff0000;\">headaches<\/span>, <span style=\"color: #ff0000;\">weight fluctuations<\/span>, and <span style=\"color: #ff0000;\">sleep disturbances<\/span>. Hence, the Act aims at improving the physical health of women in India.<\/p>\n<p><strong>3. Ensures protection of women against Financial hardships-<\/strong> Sexual harassment frequently leads to <span style=\"color: #ff0000;\">financial hardship and challenges <\/span>due to loss of job references and hostile work environment. <strong>For ex-<\/strong> According to a study led by the ILO, <span style=\"color: #ff0000;\">lewd behaviour and threatening at workplaces<\/span> were the most well-known reasons due to which women left the workforce in Uttar Pradesh.<\/p>\n<p><strong>4. Protection against economic losses-<\/strong> <span style=\"color: #ff0000;\">Low productivity<\/span>, <span style=\"color: #ff0000;\">low employee turnover<\/span>, <span style=\"color: #ff0000;\">low morale<\/span>, and <span style=\"color: #ff0000;\">high legal costs arising from sexual harassment<\/span> costs millions of Dollars. The economy also suffers due to premature retirement and higher insurance costs (paid if women left the job).<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What are the challenges with the POSH Act cases in India?<\/strong><\/span><\/h2>\n<p>The Supreme Court of India has recently raised several serious lapses and uncertainties in the implementation of the POSH Act. These are mentioned as followed-<\/p>\n<p><strong>1. Non-compliance of Companies and organisations-<\/strong> There are many private companies and organisations which have not constituted an Internal Complaints Committee (ICC) to look into the complaints of sexual harassment at the workplace. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Only 16 out of 30 national sports federations had constituted Internal Complaints Committees<\/span> (ICCs) as mandated.<\/p>\n<p><strong>2. Improper constitution of ICCs-<\/strong> The majority of the ICCs either have an inadequate number of members or lack mandatory external member. Most of the committees lack people who have knowledge about <span style=\"color: #ff0000;\">legal technicalities involved in conducting the inquiry<\/span>, <span style=\"color: #ff0000;\">cross-examinations<\/span>, and <span style=\"color: #ff0000;\">its importance<\/span>.<\/p>\n<p><strong>3. Lack of Gender Neutrality-<\/strong> The law does not take into account <span style=\"color: #ff0000;\">sexual harassment<\/span> faced by <span style=\"color: #ff0000;\">men<\/span>, <span style=\"color: #ff0000;\">transgender<\/span>, and <span style=\"color: #ff0000;\">transsexual individuals<\/span>.<\/p>\n<p><strong>4. Exclusion of certain categories of women-<\/strong> The Act does not cove<span style=\"color: #ff0000;\"><span style=\"color: #333333;\">r<\/span> women working as agricultural workers<\/span> and <span style=\"color: #ff0000;\">in the armed forces<\/span>. These are<span style=\"color: #ff0000;\"> largely male-dominated sectors<\/span>.<\/p>\n<p><strong>5. Fear of Victimization-<\/strong> Victimization in sexual harassment often occurs, when a woman lodges a complaint against a superior. The POSH Act is <span style=\"color: #ff0000;\">silent on victimisation<\/span> and <span style=\"color: #ff0000;\">has neither any preventive provisions nor any remedies<\/span>. <strong>For ex-<\/strong> A survey revealed that <span style=\"color: #ff0000;\">nearly 70% of women did not complain<\/span> due to fear, embarrassment, lack of confidence in complaint mechanism etc.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc6\"><\/a>What are the other women initiatives for safety of Women?<\/strong><\/span><\/h2>\n<table style=\"height: 300px; width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr style=\"height: 90px;\">\n<td style=\"width: 32.9091%; height: 90px;\"><strong>One Stop Centre Scheme<\/strong><\/td>\n<td style=\"width: 67.0909%; height: 90px;\">It is a centrally sponsored scheme for <span style=\"color: #ff0000;\">addressing the problem of violence against women<\/span>. It was launched in April 2015.<\/td>\n<\/tr>\n<tr style=\"height: 90px;\">\n<td style=\"width: 32.9091%; height: 90px;\"><strong>UJJAWALA<\/strong><\/td>\n<td style=\"width: 67.0909%; height: 90px;\">It is a comprehensive scheme for <span style=\"color: #ff0000;\">Prevention of trafficking and Rescue<\/span>, <span style=\"color: #ff0000;\">Rehabilitation and Re-integration of Victims of Trafficking<\/span> and <span style=\"color: #ff0000;\">Commercial Sexual Exploitation<\/span>.<\/td>\n<\/tr>\n<tr style=\"height: 90px;\">\n<td style=\"width: 32.9091%; height: 90px;\"><a href=\"https:\/\/forumias.com\/blog\/swadhar-greh-scheme\/#:~:text=About%20Swadhar%20Greh%20Scheme%3A,life%20with%20dignity%20and%20conviction.\" target=\"_blank\" rel=\"noopener\"><strong>SWADHAR Greh<\/strong><\/a><\/td>\n<td style=\"width: 67.0909%; height: 90px;\">The scheme through the <span style=\"color: #ff0000;\">provisions of shelter<\/span>, <span style=\"color: #ff0000;\">food<\/span>, <span style=\"color: #ff0000;\">clothing<\/span>, <span style=\"color: #ff0000;\">counseling<\/span>, <span style=\"color: #ff0000;\">training<\/span>, <span style=\"color: #ff0000;\">clinical and legal aid<span style=\"color: #333333;\">,<\/span> <\/span>aims to rehabilitate women in difficult circumstances.<\/td>\n<\/tr>\n<tr style=\"height: 30px;\">\n<td style=\"width: 32.9091%; height: 30px;\"><strong>Nari Shakti Puruskar<\/strong><\/td>\n<td style=\"width: 67.0909%; height: 30px;\">The Ministry of Women and Child Development announces these national level awards for individuals\/ groups\/ Non-governmental Organisations (NGOs)\/ institutions <span style=\"color: #ff0000;\">for encouraging women to participate in decision making roles<\/span>.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc7\"><\/a>What Should be the Way Forward?<\/strong><\/span><\/h2>\n<p>Justice JS Verma committee has recommended several changes to the POSH Act. The important recommendations are as follows-<\/p>\n<p><strong>1. Wider definition of rape-<\/strong> The committee has recommended to view rape and sexual assault as not merely a crime but also as an expression of power. So,<span style=\"color: #ff0000;\"> any non-consensual penetration of a sexual nature has to be included<\/span> in the <span style=\"color: #ff0000;\">definition of rape<\/span>.<\/p>\n<p><strong>2. Replacement of ICC with tribunal-<\/strong> The committee has <span style=\"color: #ff0000;\">recommended the establishment of a tribunal<\/span>, instead of an ICC. Because dealing with such complaints internally could discourage women from complaining.<\/p>\n<p><strong>3. Inclusion of excluded women-<\/strong> POSH Act should be amended to<span style=\"color: #ff0000;\"> include women in armed forces<\/span>, <span style=\"color: #ff0000;\">agriculture to get their grievances redressed<\/span>. The Act should focus on gender-neutral.<\/p>\n<p><strong>4. Punishment of companies for non-compliance-<\/strong> The government must form a committee to identify the <span style=\"color: #ff0000;\">companies not formed the ICC<\/span>, <span style=\"color: #ff0000;\">companies victimizing the women<\/span>. These companies must be financially penalized or name and shamed to make them compliant to the provisions of the Act.<\/p>\n<p><strong>5. Creation of Gender equity company index-<\/strong> The government should aim to <span style=\"color: #ff0000;\">create a Gender equity company index<\/span> like <span style=\"color: #ff0000;\">LGBT+ workplace equality index<\/span>. This will create a healthy gender-sensitive competition among companies to hire more women, and provide them with enough respect.<\/p>\n<p><strong>6. Raising awareness-<\/strong> Government needs to raise the awareness about <span style=\"color: #ff0000;\">gender-sensitive child-rearing practice<\/span>. The government can also introduce<span style=\"color: #ff0000;\"> a gender-equity syllabus<\/span> at <span style=\"color: #ff0000;\">school level<\/span>.
