{"id":30049,"date":"2018-10-26T13:34:03","date_gmt":"2018-10-26T08:04:03","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30049"},"modified":"2018-10-26T13:34:03","modified_gmt":"2018-10-26T08:04:03","slug":"sc-to-issue-orders-in-roster-case","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/sc-to-issue-orders-in-roster-case\/","title":{"rendered":"SC to issue orders in roster case"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/sc-to-issue-order-in-roster-case\/article23486025.ece\"><strong>SC to issue orders in roster case<\/strong><\/a><\/p>\n<p><strong>\u00a0<\/strong><strong>Context<\/strong><\/p>\n<p>Petition calls for transparent, codified procedure for constitution of Benches<\/p>\n<p><strong>What has happened?<\/strong><\/p>\n<p>A day after the Supreme Court\u2019s number two judge, Justice Jasti Chelameswar, attacked the Chief Justice of India\u2019s discretionary powers to constitute Benches and allocate cases, a three-judge Bench led by Chief Justice of India Dipak Misra on Monday decided to pass judicial orders on a petition calling for a transparent and codified procedure for constitution of Benches and allocation of cases in the court<\/p>\n<p><strong>\u00a0<\/strong><strong>Main points of the petition<\/strong><\/p>\n<ul>\n<li>Unfettered power is being exercised by the Chief Justices in the matter of formation of Benches, and so, the same is liable to be regulated through specific rules<\/li>\n<li>Specific provisions should be incorporated in the Supreme Court Rules of 2013 that the three-judge Bench in the Chief Justice of India\u2019s court should consist only of the Chief Justice of India and the court\u2019s two senior-most judges<\/li>\n<li>Constitution Bench of the Supreme Court should consist of five senior-most judges \u2014 the CJI, Justices Chelameswar, Gogoi, Madan B. Lokur and Kurian Joseph \u2014 or a combination of the three senior-most and two junior-most judges<\/li>\n<\/ul>\n<p><strong>Earlier petition<\/strong><\/p>\n<ul>\n<li>By former Union Law Minister Shanti Bhushan for a declaration that the authority of the CJI as \u201cmaster of roster\u201d should not be reduced to an absolute, singular and arbitrary power<\/li>\n<li>He has asked the Supreme Court Registry not to place his petition before a Bench of which Chief Justice Misra is a part of<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>SC to issue orders in roster case \u00a0Context Petition calls for transparent, codified procedure for constitution of Benches What has happened?
