Chandrachud pointed out how the Aadhaar Act could allow the State, in future, to seek DNA, hair and even semen samples from citizens as \u201cbiometric information.\u201d<\/p>\n<p><strong>Where the law is unclear?<\/strong><\/p>\n<p>In the Section 2(g) of the Aadhaar Act which defines biometrics.<\/p>\n<p><strong>Definition of biometric information:<\/strong> \u00a0photograph, finger print, iris scan, or such other biological attributes of an individual as may be specified by regulations<strong>.<\/strong><\/p>\n<p><strong>The ambiguity<\/strong><\/p>\n<ul>\n<li>The Act does not specify what the phrase \u2018other biological attributes\u2019 means<\/li>\n<li>Nor does the Act prescribe any limit to biometric information<\/li>\n<\/ul>\n<p><strong>Question raised by the Court<\/strong><\/p>\n<p>Whether Section 2(g) did not amount to \u201cexcessive delegation\u201d of power to an executive authority<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Can DNA be taken for Aadhaar, asks judge Context An executive authority may even expand the meaning of biometrics What has happened?
