{"id":30164,"date":"2018-10-26T14:28:50","date_gmt":"2018-10-26T08:58:50","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30164"},"modified":"2018-10-26T14:28:50","modified_gmt":"2018-10-26T08:58:50","slug":"sc-to-hear-cauvery-case-on-april-9","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/sc-to-hear-cauvery-case-on-april-9\/","title":{"rendered":"SC to hear Cauvery case on April 9"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/sc-to-hear-cauvery-case-on-april-9\/article23428965.ece\"><strong>SC to hear Cauvery case on April 9<\/strong><\/a><\/p>\n<p><strong>What has happened?<\/strong><\/p>\n<p>The Supreme Court on Tuesday agreed to hear, on April 9, the Centre\u2019s plea to extend the deadline for framing a scheme to implement its February 16 judgment in the Cauvery water dispute<\/p>\n<p><strong>SC judgement<\/strong><\/p>\n<p>The February 16 judgment in the Cauvery appeals had directed the Centre to frame the scheme in six weeks<\/p>\n<p><strong>Centre files for extension<\/strong><\/p>\n<p>On the eve of the deadline (Mar 29), the Centre had moved the Supreme Court for a three-month extension for implementation of the judgment as Assembly elections were scheduled for May 12 in Karnataka<\/p>\n<p><strong>Centre seeks clarification also<\/strong><\/p>\n<ul>\n<li>Centre asked the court to clarify if it was open to framing a scheme \u201cat variance\u201d with the tribunal\u2019s recommendations.<\/li>\n<li>Technical and administrativeCMBFor one, it wanted to know whether a Cauvery Management Board (CMB) could have an assemblage of administrative and technical expertise rather than be a purely technical body as envisaged by the Cauvery Tribunal in 2007.<\/li>\n<\/ul>\n<p><strong>Different functions for CMB?<\/strong><\/p>\n<p>Centre asked whether it could accord the CMB with functions different from those recommended by the tribunal<\/p>\n<ul>\n<li><strong>SC opinion on framing the scheme under Section 6A<\/strong><\/li>\n<\/ul>\n<p>Finally, the Centre has asked the Supreme Court for its opinion on the framing of the scheme under Section 6A of the Inter-State River Water Disputes Act of 1956, considering the divergent views expressed between Tamil Nadu and Karnataka<\/p>\n<p><strong>Divergent views of Karnataka and TN<\/strong><\/p>\n<p>Tamil Nadu wants the CMB as per the 2007 tribunal order, while Karnataka wants a two-layer scheme, one headed by a committee led by the Union Water Resources Secretary.<\/p>\n<p><strong>Tamil Nadu files for contempt<\/strong><\/p>\n<p>Tamil Nadu has accused the Centre of not \u201cprotecting the interests of the farmers and the larger interests of the State\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>SC to hear Cauvery case on April 9 What has happened?
