What happens if an MP is in jail?&#8221; <\/b><\/a>published in \u201c<b>Indian Express<\/b>\u201d on 24 June 2024.<\/p>\n<h2 style=\"text-align: justify;\">Why in the news?<\/h2>\n<p style=\"text-align: justify;\">The 18th Lok Sabha&#8217;s first session will start on Monday. Before the House begins its legislative work, <span style=\"color: #ff0000;\">the newly elected Members of Parliament (MPs) must take the oath as provided in the Constitution<\/span>.<\/p>\n<h2 style=\"text-align: justify;\">About the term of a Lok Sabha MP<\/h2>\n<p style=\"text-align: justify;\"><strong>1. Lok Sabha MP&#8217;s Term: <\/strong>The five-year term of a Lok Sabha MP begins when the Election Commission of India (ECI) <span style=\"color: #ff0000;\">declares the results according to Section 73 of the Representation of the People Act, 1951<\/span>.<\/p>\n<p style=\"text-align: justify;\">2. From that day onward, MPs are eligible for certain rights as elected representatives.<\/p>\n<p style=\"text-align: justify;\">3. The start of their term means that <span style=\"color: #ff0000;\">if MPs change their party allegiance<\/span>, their political party can ask the Speaker to disqualify them from Parliament under the anti-defection law.<\/p>\n<p>4. Requirements for an MP to Participate in Lok Sabha:<\/p>\n<p style=\"text-align: justify;\">i) Winning the election and starting the term does not automatically allow an MP to participate in House proceedings.<\/p>\n<p style=\"text-align: justify;\">ii) To <span style=\"color: #ff0000;\">debate and vote in Lok Sabha<\/span>, an <span style=\"color: #ff0000;\">MP must take a seat in the House by making and subscribing to an oath or affirmation as prescribed in the Constitution<\/span> (Article 99).<\/p>\n<p style=\"text-align: justify;\">iii) The Constitution specifies a <span style=\"color: #ff0000;\">financial penalty of Rs 500<\/span> if a person participates or votes in House proceedings <span style=\"color: #ff0000;\">without taking the oath<\/span> (<span style=\"color: #ff0000;\">Article 104<\/span>). <span style=\"color: #ff0000;\">This is the only financial penalty mentioned in the Constitution.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>5. Exception:<\/strong> An individual can become a minister without being elected to Parliament. They have six months to secure a seat in either Lok Sabha or Rajya Sabha.<span style=\"color: #ff0000;\"> During this time, they can participate but not vote in House proceedings<\/span>.<\/p>\n<h2 style=\"text-align: justify;\">About Parliamentary oath<\/h2>\n<p style=\"text-align: justify;\">1. The text of the parliamentary oath is found in the <span style=\"color: #ff0000;\">third schedule of the Constitution<\/span>.<\/p>\n<p style=\"text-align: justify;\">2. Before taking the oath, MPs must submit their <span style=\"color: #ff0000;\">election certificate to the Lok Sabha staff<\/span>. This requirement was introduced after a 1957 incident where a mentally unsound individual posed as an MP and took the oath.<\/p>\n<p style=\"text-align: justify;\">3. Once verified, MPs <span style=\"color: #ff0000;\">can take the oath or affirmation in English or any of the 22 languages specified in the Constitution<\/span>. Approximately half of the MPs take their oath in Hindi or English. Sanskrit has also become a popular choice in recent Lok Sabhas.<\/p>\n<p style=\"text-align: justify;\">4.\u00a0 MPs <span style=\"color: #ff0000;\">must use the name mentioned in their election certificate<\/span> and adhere to the exact text of the oath.<\/p>\n<p style=\"text-align: justify;\">5. MPs <span style=\"color: #ff0000;\">can choose<\/span> between <span style=\"color: #ff0000;\">swearing in the name of God<\/span> or <span style=\"color: #ff0000;\">making a solemn affirmation<\/span>.<\/p>\n<p style=\"text-align: justify;\">6. The Constitution specifies that if an <span style=\"color: #ff0000;\">MP does not attend Parliament for 60 days<\/span>, their seat can be declared vacant.
