{"id":301785,"date":"2024-06-24T17:33:58","date_gmt":"2024-06-24T12:03:58","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=301785"},"modified":"2024-06-24T17:33:58","modified_gmt":"2024-06-24T12:03:58","slug":"the-telecommunications-act-2023","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/the-telecommunications-act-2023\/","title":{"rendered":"The Telecommunications Act 2023"},"content":{"rendered":"<p><strong>Source<\/strong>\u2013 This post on The Telecommunications Act 2023 has been created based on the article <a href=\"https:\/\/pib.gov.in\/PressReleasePage.aspx?PRID=2027941\" target=\"_blank\" rel=\"noopener\"><strong>&#8220;The Telecommunications Act, 2023: Ushering in new era of connectivity&#8221;<\/strong><\/a> published in \u201c<b>PIB<\/b>\u201d on 22 June 2024.<\/p>\n<h2>Why in the news?<\/h2>\n<p>Recently, Union Government <span style=\"color: #ff0000;\">issued Gazette Notification<\/span> for enforcing sections 1, 2, 10 to 30, 42 to 44, 46, 47, 50 to 58, 61 and 62 of the Telecommunications Act, 2023.<\/p>\n<h2>About the Telecommunications Act, 2023<\/h2>\n<p><strong>1. <\/strong>The Telecommunications Act 2023 aims to <span style=\"color: #ff0000;\">update and unify the laws<\/span> related to developing, expanding, and operating telecommunication services and networks. It also covers the assignment of spectrum and other related matters.<\/p>\n<p>2. This new Act<span style=\"color: #ff0000;\"> replaces older laws<\/span> like the <span style=\"color: #ff0000;\">Indian Telegraph Act, 1885<\/span>, and<span style=\"color: #ff0000;\"> the Indian Wireless Telegraph Act, 1933<\/span>, due to significant technological advancements in the telecom sector.<\/p>\n<p>3. The Act <span style=\"color: #ff0000;\">promotes digital implementation<\/span>, including online dispute resolution and other frameworks.<\/p>\n<p>4. It is guided by principles like <span style=\"color: #ff0000;\">Inclusion<\/span> (Samavesh), Security (Suraksha), <span style=\"color: #ff0000;\">Growth<\/span> (Vriddhi) and <span style=\"color: #ff0000;\">Responsiveness<\/span> (Tvarit).<\/p>\n<h2>Key Features:<\/h2>\n<p>1.\u00a0The Act clearly <span style=\"color: #ff0000;\">defines various telecom-related terms. <span style=\"color: #333333;\">This <\/span><\/span><span style=\"color: #333333;\">reduces uncertainties and improving investor confidence, which aids in ease of doing business<\/span>.<\/p>\n<p>2. It provides an effective Right of Way (RoW framework) for both public and private properties. It includes government agencies, local bodies, and PPP projects like airports, seaports, and highways.<\/p>\n<p><strong>Note-<\/strong> RoW framework is one in which a <span style=\"color: #ff0000;\">public entity that owns the land has to grant \u2018right of way\u2019 permission expeditiously<\/span> unless it gives a substantive ground for refusal.<\/p>\n<p>3. Telecommunication infrastructure will be considered separate from the property it is on. This will reduce disputes when the property is sold or leased.<\/p>\n<p>4. The Central Government will establish common ducts and cable corridors, in line with the PM Gati Shakti vision.<\/p>\n<p>5. The Act empowers <span style=\"color: #ff0000;\">setting standards and conformity assessments<\/span> for telecommunication services, networks, and security to ensure national security and promote Indian technology.<\/p>\n<p><strong>6.
