The Bill allows the <span style=\"color: #ff0000;\">State to declare any organisation<\/span> as \u2018<span style=\"color: #ff0000;\">unlawful<\/span>\u2019, categorizing offences as cognisable and non-bailable.<\/p>\n<h2>About Maharashtra Special Public Security Bill, 2024<\/h2>\n<p>i) It was introduced to <span style=\"color: #ff0000;\">combat the increasing threat of Naxalism<\/span>, especially in urban areas through Naxal-affiliated organizations.<\/p>\n<p>ii) The state has the authority to declare an organization as \u201cunlawful.\u201d An <span style=\"color: #ff0000;\">advisory board<\/span> of three qualified individuals (current\/former\/qualified High Court judges) will review such decisions.<\/p>\n<p><strong>iii) Definition of Unlawful Activities: <\/strong><\/p>\n<p>a. The activities that threaten public order, peace, and tranquility.<\/p>\n<p>b. Interference with the administration of law and public servants.<\/p>\n<p>c. Acts of violence, vandalism, use of firearms, explosives, and disruption of transportation.<\/p>\n<p>d. Encouragement of disobedience to laws and institutions.<\/p>\n<p>e. Collecting funds or goods for unlawful activities.<\/p>\n<p>f. All offences under this law are cognizable and non-bailable. Investigations will be conducted by a police officer not below the rank of a Sub-Inspector.<\/p>\n<p><strong>iv) Punishments:<\/strong><\/p>\n<p>a. Members of Unlawful Organizations: Imprisonment up to 3 years and fines up to Rs 3 lakh.<\/p>\n<p>b. Non-members Contributing or Aiding Unlawful Organizations: Imprisonment up to 2 years and fines up to Rs 2 lakh.<\/p>\n<p>c. Management or Promotion of Unlawful Organizations: Imprisonment up to 3 years and fines up to Rs 3 lakh.<\/p>\n<p>d. Committing, Abetting, or Planning Unlawful Activities: Imprisonment up to 7 years and fines up to Rs 5 lakh.<\/p>\n<p><strong>v) Seizure and Forfeiture:<\/strong> \u00a0If an organization is declared unlawful, the <span style=\"color: #ff0000;\">District Magistrate or Commissioner of Police<\/span> can notify and take possession of any place used for its activities. The government can forfeit money and assets intended for unlawful organizations.<\/p>\n<p><strong>vi) Legal Review:<\/strong> An advisory board must review the <span style=\"color: #ff0000;\">declaration of unlawful organizations within six weeks and submit a report within three months<\/span>.
