The issue gained further momentum when <span style=\"color: #ff0000;\">a former chief executive officer of NITI Aayog<\/span> tweeted that <span style=\"color: #333333;\">reservations for persons with disabilities (PwDs) should be reassessed.\u00a0<\/span><\/p>\n<p><span style=\"color: #333333;\">This calls for a deep introspection in the Issue of Reservation for persons with disabilities in India. What are the provisions of reservations for persons with Disabilities?<\/strong><\/span><\/h2>\n<p>According to\u00a0<span style=\"color: #ff0000;\">The\u00a0United Nations Convention on the Rights of Persons with Disabilities<\/span>\u00a0(UN CRPD), Persons with disabilities are the ones who have\u00a0<span style=\"color: #ff0000;\">long-term physical<\/span>,\u00a0<span style=\"color: #ff0000;\">mental<\/span>,\u00a0<span style=\"color: #ff0000;\">intellectual<\/span>\u00a0or\u00a0<span style=\"color: #ff0000;\">sensory impairments<\/span>, which hinder their full and effective participation in society on an equal basis with others.<\/p>\n<p><strong>The Rights of Persons with Disabilities Act, 2016-<\/strong> This Act came into force in April 2017, and replaced the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.<\/p>\n<table style=\"height: 180px; width: 100%; border-collapse: collapse; border-style: solid; background-color: #f3f7ed;\">\n<tbody>\n<tr style=\"height: 90px;\">\n<td style=\"width: 24.498%; height: 90px;\"><strong>Definition of Disability<\/strong><\/td>\n<td style=\"width: 75.502%; height: 90px;\">It uses the same definition as the <span style=\"color: #ff0000;\">UN CRPD<\/span> to define persons with Disabilities.<br \/>\n\u2018<strong>Person with Benchmark Disability<\/strong>\u2018- It further defines \u2018Person with Benchmark Disability\u2018 as \u2018<span style=\"color: #ff0000;\">A person with not less than 40% of a specified disability<\/span>\u2018.<\/td>\n<\/tr>\n<tr style=\"height: 60px;\">\n<td style=\"width: 24.498%; height: 60px;\"><strong>Reservation Provisions Guaranteed under the Act<\/strong><\/td>\n<td style=\"width: 75.502%; height: 60px;\">The Act <span style=\"color: #ff0000;\">increased the magnitude of reservation<\/span> for Persons with Disabilities from <span style=\"color: #ff0000;\">3% to 4% in government jobs<\/span> and from <span style=\"color: #ff0000;\">3% to 5% in higher education institutes<\/span>.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Supreme Court Judgments mandating reservation for Persons with Disabilities<br \/>\n<\/strong><\/p>\n<p>The Supreme Court of India has also made several significant rulings regarding reservations for persons with disabilities (PwD) in employment, particularly focusing on the applicability of such reservations in promotions.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid; background-color: #f2fbff;\">\n<tbody>\n<tr>\n<td style=\"width: 32.3293%;\"><strong>Indra Sawhney v. Union of India (1992)<\/strong><\/td>\n<td style=\"width: 67.6707%;\">The Supreme Court <span style=\"color: #ff0000;\">established the framework for reservations in India<\/span>, distinguishing between &#8220;vertical&#8221; and &#8220;horizontal&#8221; reservations. SC noted that <span style=\"color: #333333;\">reservations for persons with disabilities <\/span>should be <span style=\"color: #ff0000;\">considered horizontal reservations under Article 16(1) of the Constitution<\/span>, which allows for a <span style=\"color: #333333;\">separate quota of 3% for persons with disabilities acr<\/span>oss various employment sectors. This decision <span style=\"color: #ff0000;\">reinforced the principle<\/span> of <span style=\"color: #ff0000;\">equality<\/span> and <span style=\"color: #ff0000;\">non-discrimination<\/span> in<span style=\"color: #ff0000;\"> access to education<\/span> and <span style=\"color: #ff0000;\">employment opportunities<\/span>.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What is the significance of introduction of reservations for persons with Persons with Disabilities?<\/strong><\/span><\/h2>\n<p><strong>1. Level playing field by providing equitable opportunities to PwDs-<\/strong> Reservations aim to provide equal opportunities in employment for PwDs, who often face discrimination and barriers that hinder their access to jobs. This <span style=\"color: #ff0000;\">aligns with Article 16 of the Indian Constitution<\/span>, which guarantees equality of opportunity in public employment<\/p>\n<p><strong>2. Low employment rate for Persons with Disability-<\/strong> According to the <span style=\"color: #ff0000;\">76th round of the National Sample Survey in 2018, <\/span>only 23.8% of PwDs were employed in India, against the national average of Labour Force Participation Rate of 50.2%. Hence, reservation becomes an important tool to ensure their adequate representation.<\/p>\n<p><strong>3. This helps in <span style=\"color: #ff0000;\">normalizing their presence<\/span> in the workforce and <span style=\"color: #ff0000;\">reducing stigma<\/span> associated with disabilities.<\/p>\n<p><strong>5. Career Progression-<\/strong> Allowing reservations in promotions ensures that PwDs have the opportunity to advance in their careers. This helps in <span style=\"color: #ff0000;\">preventing stagnation and frustration<\/span> that can arise from<span style=\"color: #ff0000;\"> limited career progression<\/span> options. This is <span style=\"color: #ff0000;\">crucial for their economic independence<\/span> and <span style=\"color: #ff0000;\">self-esteem<\/span>.<\/p>\n<p><strong>6. Backing of Legislative Framework and Judicial Endorsement-<\/strong> The <span style=\"color: #ff0000;\">Rights of Persons with Disabilities Act<\/span>, 2016, <span style=\"color: #ff0000;\">explicitly mandates reservations for PwDs<\/span>. Structural challenges in assessment of Disability-<\/strong> <span style=\"color: #ff0000;\">Lack of specialists<\/span> to evaluate various disabilities, makes the disability certification process inaccessible and time consuming. Further, the <span style=\"color: #ff0000;\">complicated assessment guidelines<\/span> prescribed by the state are often <span style=\"color: #ff0000;\">unrealistic to be examined at the level of district hospitals<\/span>, which are constrained in terms of both infrastructure and resources.<\/p>\n<p><strong>3. Outdated certification system for Psychosocial disabilities-<\/strong> The psychosocial disabilities <span style=\"color: #ff0000;\">whose assessment is relatively more subjective<\/span>, are assessed based on the <span style=\"color: #ff0000;\">outdated IDEAS<\/span> (Indian Disability Evaluation and Assessment Scale) <span style=\"color: #ff0000;\">scale<\/span>. Persons with invisible, hidden, or less apparent disabilities, such as blood disorders, often face rejection because they \u201cdo not look disabled\u201d, with tests not conducted properly.<\/p>\n<p><strong>4. Unconscious Ableism Bias-<\/strong> There exists unconscious bias of ableism (physical fitness for fulfillment of duties) that exists within the public servants and corridors of public service which hinders effective implementation of reservation policies for PwDs. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Kartik Kansal<\/span> and <span style=\"color: #ff0000;\">Ira Singhal cases <span style=\"color: #333333;\">of delay in allotment of service<\/span><\/span> citing disability, despite both of them clearing the UPSC examination.<\/p>\n<p><strong>5. Exploitation of Benefits-<\/strong> Incidents of individuals allegedly misrepresenting their disabilities to gain benefits have raised concerns about the integrity of reservation policies. <strong>For ex-<\/strong> Puja Kedkhar case has jeopardised the reservation for PwDs.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What Should be the Way Forward?<\/strong><\/span><\/h2>\n<p><strong>1. Change in the assessment criteria of Disability-<\/strong> <span style=\"color: #ff0000;\">Functional limitations<\/span>, <span style=\"color: #ff0000;\">rather than medical percentages<\/span>, should be the basis for assessment of disability and issuance of disability certificate and Unique Disability ID (UDID).<\/p>\n<p><strong>2. Addressing the structural limitations-<\/strong> The <span style=\"color: #ff0000;\">shortage of adequate medical staff<\/span>,<span style=\"color: #ff0000;\"> infrastructure at local hospitals must be addressed<\/span> to make it convenient for the persons with disabilities to obtain their certificates.<\/p>\n<p><strong>3. New model for assessment of Psychosocial disabilities-<\/strong> A new model for the assessment of psychosocial disabilities must be developed to <span style=\"color: #ff0000;\">replace the old and outdated IDEAS scale<\/span> (Indian Disability Evaluation and Assessment Scale).<\/p>\n<p><strong>4. Regularly review and updates-<\/strong> The list of specified disabilities must be regularly reviewed and updated to align with international standards and best practices. This would ensure that the system remains inclusive and responsive to the diverse needs of PwDs.<\/p>\n<p><strong>5. Establishment of a robust monitoring and evaluation mechanism-<\/strong> A robust tracking mechanism needs to be developed <span style=\"color: #ff0000;\">for detection of fraud cases of disability<\/span>.
