On August 5, 2019, Prime Minister Narendra Modi announced the abrogation of Article 370 and the <span style=\"color: #ff0000;\">end of special status for the state of Jammu and Kashmir<\/span>. Subsequently, Parliament used its powers under Article 3 of the Constitution, for the first time, to withdraw statehood and create two Union Territories. The Supreme Court in a 5-0 unanimous ruling upheld the Centre\u2019s abrogation of Article 370 of the Constitution.<\/p>\n<p>Since, 5 years have passed after the abrogation of Art 370, there is a need of introspection of the achievement of stated objectives of removal of Art 370 and the challenges ahead.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid; background-color: #fcfce3;\">\n<tbody>\n<tr>\n<td style=\"width: 100%; text-align: center;\"><strong>Table of Content<\/strong><\/td>\n<\/tr>\n<tr>\n<td style=\"width: 100%;\"><a href=\"#toc1\">What was Article 370 of the constitution? How was it removed?<\/strong><\/span><\/h2>\n<p><strong>Article 370-<\/strong>\u00a0Article 370, was added to the Indian constitution, as a \u2018<span style=\"color: #ff0000;\">temporary provision<\/span>\u2019, on October 17, 1949. It permitted the state of J&amp;K to draft its own Constitution. The <span style=\"color: #ff0000;\">Constituent Assembly of Jammu &amp; Kashmir<\/span> was <span style=\"color: #ff0000;\">empowered<\/span> to <span style=\"color: #ff0000;\">recommend<\/span> which <span style=\"color: #ff0000;\">articles of the Indian Constitution<\/span> should <span style=\"color: #ff0000;\">apply to the state<\/span>. It restricted the Indian Parliament\u2019s legislative powers in the state.<\/p>\n<p><strong>Article 35A-<\/strong>\u00a0<span style=\"color: #ff0000;\">Clause 3<\/span> of the <span style=\"color: #ff0000;\">Article 370<\/span> gave the President of India the power to <span style=\"color: #ff0000;\">amend its provisions and scope<\/span>. Article 35A stemmed from Article 370 and was introduced through a <span style=\"color: #ff0000;\">Presidential Order in 1954<\/span>, on the recommendation of the J&amp;K Constituent Assembly. Article 35A empowered the Jammu &amp; Kashmir legislature to define the permanent residents of the state, and their special rights and privileges.<\/p>\n<p><strong>Presidential Proclamation Abrogating Article 370-<\/strong>\u00a0On 5th August 2019, President of India in the exercise of the powers conferred by Clause (1) of Article 370 of the Constitution had issued the <span style=\"color: #ff0000;\">Constitution<\/span> (<span style=\"color: #ff0000;\">Application to Jammu and Kashmir<\/span>) <span style=\"color: #ff0000;\">Order<\/span>, <span style=\"color: #ff0000;\">2019<\/span>. The laws of the Parliament will now be applicable to the state of Jammu and Kashmir.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What was the rationale for the abrogation of Article 370?<\/strong><\/span><\/h2>\n<p><strong>1.<\/strong>\u00a0<strong>Promotion of\u00a0National Integration-<\/strong> Article 370 <span style=\"color: #ff0000;\">allowed a separate constitution<\/span>,<span style=\"color: #ff0000;\"> flag<\/span> and <span style=\"color: #ff0000;\">powers<\/span> to Jammu and Kashmir, which created a <span style=\"color: #ff0000;\">sense of separate identity among the people of the state<\/span>. This was used to misguide youth and created a demand of separatism among them. A rationale was provided that the abrogation of Article 370 was a means to promote national integration.<\/p>\n<p><strong>2. Aid in the fight against Terrorism-<\/strong> Owing to cross border terrorism, around <span style=\"color: #ff0000;\">42 thousand people<\/span> had lost lives in the state of Jammu and Kashmir. The special status accorded to Jammu and Kashmir, due to Article 370, was considered an <span style=\"color: #ff0000;\">impediment in fight against terrorism<\/span>. It was reasoned that abrogation of Article 370 allowed for the application of stringent anti-terror laws like UAPA.<\/p>\n<p><strong>3.\u00a0Reduction of\u00a0Corruption and graft-\u00a0<\/strong>Article 370 resulted in poor anti-graft architecture in the state of Jammu and Kashmir. Anti-corruption agencies could not enter the state, which resulted in massive corruption, money laundering and <span style=\"color: #ff0000;\">hawala transactions<\/span>. It was reasoned that abrogation of Article 370, allowed for the stringent application of the <span style=\"color: #ff0000;\">PMLA<\/span> and <span style=\"color: #ff0000;\">FEMA Act<\/span>.<\/p>\n<p><strong>4.\u00a0Promotion of economic development-\u00a0<\/strong>Due to the application of Article 370, the land in the state could only be sold and bought by the permanent residents of the state. As a result, large businesses houses did not invest in the region owing to land concerns. It was reasoned that repeal of Article 370, would<span style=\"color: #ff0000;\"> allow greater investment in the state of J&amp;K<\/span>.<\/p>\n<p><strong>5.\u00a0Effective implementation of affirmative policies-<\/strong> Various affirmative legislations such as Right to Education, Right to Information were not available to the citizens of Jammu and Kashmir. Also, the <span style=\"color: #ff0000;\">reservations benefits<\/span>, to <span style=\"color: #ff0000;\">OBCs<\/span>, <span style=\"color: #ff0000;\">SCs<\/span>, <span style=\"color: #ff0000;\">STs<\/span> were not available to the marginalized sections of the state. It was reasoned that <span style=\"color: #ff0000;\">abrogation of Article 370<\/span> would <span style=\"color: #ff0000;\">allow for effective implementation<\/span> of affirmative policies.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What have been the positive developments post abrogation of Article 370?<\/strong><\/span><\/h2>\n<p><strong>1. Improvement in Governance-<\/strong> There have been substantial gains on the governance front, with the <span style=\"color: #ff0000;\">improvement in the last-mile delivery of services<\/span>, <span style=\"color: #ff0000;\">digitisation of 1000 public utilities<\/span>, <span style=\"color: #333333;\">near completion of major projects in the PM&#8217;s development package.<\/span><\/p>\n<p><strong>2. Improved economic situation of J&amp;K-<\/strong> The abrogation of Article 370 and the improved governance has helped in <span style=\"color: #ff0000;\">attracting Rs 6,000-crore worth of investments<\/span>. The number of tourists visiting the UT went up from 3.4 million in 2020 to 21.1 million in 2023.<\/p>\n<p><strong>3. Increased trust in the Political and electoral System-<\/strong> Despite the detention of several elected leaders in August 2019 during abrogation of Article 370, the <span style=\"color: #ff0000;\">people of J&amp;K<\/span> have shown their faith in the ballot. The 2024 general election was an incident-free poll, with <span style=\"color: #ff0000;\">voter turnout at 58.6 percent<\/span>, the highest in 35 years.<\/p>\n<p><strong>4. Absence of a counter-hegemonic view on Kashmir- <\/strong>There has been an emergence of consensus across political parties on the abrogation of Article 370. The <span style=\"color: #ff0000;\">customary call for boycott<\/span>, <span style=\"color: #ff0000;\">bandhs<\/span>, <span style=\"color: #ff0000;\">civil unrest<\/span> and <span style=\"color: #ff0000;\">stone pelting<\/span> incidents, have stopped since the abrogation of Article 370 in Kashmir.<\/p>\n<p><strong>5. Social Stability-<\/strong> With the decline in violence and the restoration of normalcy, <span style=\"color: #ff0000;\">public and social life in the Jammu and Kashmir region has returned to a more stable state<\/span>. Events promoting peace and development are now being held in areas that were previously considered no-go zones.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What are the prevailing challenges after the abrogation of Article 370?<\/strong><\/span><\/h2>\n<p><strong>1. Changing theater and character of conflict-<\/strong> The infiltrators from across the border have become more active in the Jammu sector. Pakistan, its partnership with China and its sponsorship of terror has increased in the region. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Increased terror attacks on civilians and army personnel in Jammu region<\/span>.<\/p>\n<p><strong>2. Erosion of social capital-<\/strong> The constitutional amendments, followed by legislative changes, executive fiats and administrative orders have eroded the social capital of Kashmir. There has been <span style=\"color: #ff0000;\">concentration of power in the region<\/span>.<\/p>\n<p><strong>3. Political Challenges-<\/strong> The abrogation has marginalized traditional political entities, causing a vacuum in local governance and representation. Mainstream political parties, such as the National Conference and the Peoples Democratic Party, have struggled to regain their footing in the Jammu and Kashmir region.<\/p>\n<p><strong>4. Social and Human Rights Concerns-<\/strong> Post-abrogation, there have been <span style=\"color: #ff0000;\">widespread reports of human rights violations<\/span>, including restrictions on civil liberties, internet blackouts, and the detention of political leaders and activists.<\/p>\n<p><strong>5. This can be achieved by facilitating dialogue between the central government and regional political leaders to address their grievances. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Regular meeting between LG and heads of political parties<\/span>.<\/p>\n<p><strong>2. Enhancing Security and Community Trust-<\/strong> Building trust between security forces and local communities is necessary for restoration of normalcy in J&amp;K. Initiatives that <span style=\"color: #ff0000;\">promote community policing<\/span> can help in reducing tensions and fostering a cooperative environment.<\/p>\n<p><strong><span style=\"color: #333333;\">3. Cultural and Educational Programs-<\/span><\/strong> Initiatives that promote cultural exchange and education can help bridge divides between different communities within J&amp;K. This includes <span style=\"color: #ff0000;\">support for local arts<\/span>, <span style=\"color: #ff0000;\">crafts<\/span>, and <span style=\"color: #ff0000;\">educational institutions<\/span> that foster a sense of unity.<\/p>\n<p><strong>4.
