{"id":30718,"date":"2018-10-26T17:55:50","date_gmt":"2018-10-26T12:25:50","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30718"},"modified":"2018-10-26T17:55:50","modified_gmt":"2018-10-26T12:25:50","slug":"sc-upholds-passive-euthanasia","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/sc-upholds-passive-euthanasia\/","title":{"rendered":"SC upholds passive euthanasia"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/sc-upholds-passive-euthanasia\/article23016537.ece\"><b>SC upholds passive euthanasia<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court has upheld <\/span><b>passive euthanasia and the right to give advance medical directives or \u2018Living Wills\u2019 to smoothen the dying process<\/b><span style=\"font-weight: 400;\"> as part of the fundamental right to live with dignity.<\/span><\/li>\n<\/ul>\n<p><b>More in news:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A five-judge Constitution Bench, led by Chief Justice of India Dipak Misra has recently ruled that the <\/span><b>fundamental right to life and dignity under Article 21 of the Constitution<\/b><span style=\"font-weight: 400;\"> includes the <\/span><b>\u201cright to die with dignity.\u201d<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dignity is lost if a man is allowed or forced to undergo pain and suffering because of <\/span><b>\u201cunwarranted medical support.\u201d<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Justice D.Y. Chandrachud observed that <\/span><b>\u201cto deprive a person of dignity at the end of life is to deprive him of a meaningful existence.\u201d<\/b><\/li>\n<li style=\"font-weight: 400;\"><b>\u201cMeaningful existence\u201d<\/b><span style=\"font-weight: 400;\"> includes a person\u2019s right to self-determination and autonomy to decide his medical treatment, the court held.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Justice Ashok Bhushan observed that right to a dignified life includes a <\/span><b>\u201cdignified procedure of death.\u201d<\/b><\/li>\n<\/ul>\n<p><b>Passive euthanasia:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Passive euthanasia is the act of withdrawing or withholding medical support to a dying patient who has no hope for revival or cure.<\/span><\/li>\n<\/ul>\n<p><b>Passive euthanasia is different from suicide and active euthanasia:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court had differentiated passive euthanasia from suicide and active euthanasia.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It called passive euthanasia as a <\/span><b>\u201cmere acceleration of the inevitable conclusion.\u201d<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Active euthanasia, the court concluded, <\/span><b>is unlawful.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Suicide involves <\/span><b>\u201covert acts\u201d<\/b><span style=\"font-weight: 400;\"> which culminates in an unnatural death.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>SC upholds passive euthanasia Context: The Supreme Court has upheld passive euthanasia and the right to give advance medical directives or \u2018Living Wills\u2019 to smoothen the dying process as part of the fundamental right to live with dignity.
