What are the different types of Dark Patterns?<\/strong><\/span><\/h2>\n<p>According to ASCI definition, Dark patterns are business practices employing elements of digital choice architecture, in particular in online user interfaces, that subvert or impair consumer autonomy, decision making or choice.<\/p>\n<p>Dark patterns are also called deceptive patterns. These patterns are used for <span style=\"color: #ff0000;\">intentionally manipulating<span style=\"color: #333333;\"> or<\/span> misleading users to make certain choices<\/span> or<span style=\"color: #ff0000;\"> perform specific actions<\/span> that may not be in their best interest.<br \/>\nThese <span style=\"color: #ff0000;\">unethical strategies<\/span> are designed to <span style=\"color: #ff0000;\">exploit certain cognitive<\/span> and <span style=\"color: #ff0000;\">behavioral biases<\/span> to persuade users into purchasing goods and services they would typically not pay for. However, in 2022, Amazon made its cancellation process easier for online customers in European countries.<\/p>\n<p><strong>YouTube-<\/strong> YouTube nags users to sign up for YouTube Premium with pop-ups (<span style=\"color: #ff0000;\">nagging<\/span>).<\/p>\n<p><strong>Indigo airlines-<\/strong> Indigo airlines have been found to be creating <span style=\"color: #ff0000;\">false urgency in booking of seats from their app<\/span>, and <span style=\"color: #ff0000;\">Interface interference<\/span> ( the option to skip is placed in the top right corner and displayed in a tiny font).<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What are the concerns with dark patterns?<\/strong><\/span><\/h2>\n<p><strong>1. Harm to consumer autonomy-<\/strong> These <span style=\"color: #ff0000;\">compromise consumers\u2019 personal autonomy<\/span> as they lead consumers to make choices they may not otherwise have made. These deceptive patterns often <span style=\"color: #ff0000;\">provide the illusion of control<\/span> rather <span style=\"color: #ff0000;\">than actual control<\/span> to consumer.<\/p>\n<p><strong>2. Financial loss to the consumer-<\/strong> Deceptive patterns such as <span style=\"color: #ff0000;\">basket sneaking<\/span>, <span style=\"color: #ff0000;\">drip pricing<\/span> or <span style=\"color: #ff0000;\">false urgency<\/span>, lead to financial losses for the consumers, as these lead to more spending than their intended expenditure.<\/p>\n<p><strong>3. Harm to customer Data Privacy-<\/strong> <span style=\"color: #ff0000;\">Privacy-intrusive deceptive patterns<\/span> like <span style=\"color: #ff0000;\">nagging<\/span> and <span style=\"color: #ff0000;\">confirm shaming<\/span>, force consumers into <span style=\"color: #ff0000;\">accepting privacy-intrusive settings<\/span>. Consequently, consumers unintentionally disclose more personal data than intended. This potentially <span style=\"color: #ff0000;\">exposes them to additional risks<\/span> and <span style=\"color: #ff0000;\">violates their right to privacy<\/span> (<span style=\"color: #ff0000;\">Article 21<\/span>).<\/p>\n<p><strong>4. Psychological harm and time loss-<\/strong> These patterns cause <span style=\"color: #ff0000;\">psychological harm<\/span> like emotional distress, feelings of shame and frustration.<\/p>\n<p><strong>5. Limits User-Centric Innovation-<\/strong> Reliance on deceptive patterns for short-term gains, stifles innovation in user-centric design. Businesses start prioritizing deceptive practices over creating genuinely valuable and user-friendly products. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">False urgency practice in seat booking started gaining prominence in Indian airlines industry<\/span>.<\/p>\n<p><strong>6. Social Backlash and brand erosion-<\/strong> These deceptive patterns lead to <span style=\"color: #ff0000;\">negative publicity<\/span>, especially in the age of social media where users can share their experiences widely. Public backlash can damage a company\u2019s brand image.<\/p>\n<p><strong>7. Complexity of Legal Definitions-<\/strong> Determination what constitutes a dark pattern is often complex, as it is <span style=\"color: #ff0000;\">at times challenging to determine the threshold<\/span> at which the pattern crosses from controversial marketing technique to illegal practice.<\/p>\n<p><strong>3. Evolving Nature-<\/strong> The tactics used in dark patterns are continually evolving. This makes it difficult for regulatory frameworks to keep pace, and deal with the menace of these deceptive patterns. Further, there are <span style=\"color: #ff0000;\">insufficient case laws available for the regulators<\/span>, to draw upon previous rulings and guide enforcement actions.<\/p>\n<p><strong>4. Enforcement Challenges-<\/strong> Regulatory bodies <span style=\"color: #ff0000;\">lack the resources<\/span> to monitor and address dark patterns effectively.<\/p>\n<p><strong>5.
