{"id":30801,"date":"2018-10-26T18:16:12","date_gmt":"2018-10-26T12:46:12","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30801"},"modified":"2018-10-26T18:16:12","modified_gmt":"2018-10-26T12:46:12","slug":"cji-led-bench-to-resolve-conflict-over-judgments","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/cji-led-bench-to-resolve-conflict-over-judgments\/","title":{"rendered":"\u2018CJI-led Bench to resolve conflict over judgments"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/cji-led-bench-to-resolve-conflict-over-judgments\/article22954507.ece\"><b>\u2018CJI-led Bench to resolve conflict over judgments<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Amid a conflict over \u201cjudicial discipline\u201d within the Supreme Court in connection with certain land acquisition cases, a five-judge Bench led by Chief Justice of India Dipak Misra sets to resolve the conflict.<\/span><\/li>\n<\/ul>\n<p><b>Background:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>2014:<\/b><span style=\"font-weight: 400;\"> In 2014, three judges of the Supreme Court had ruled that the government&#8217;s acquiring land could be considered void if the money had not been deposited into the accounts of the landowners.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This ruling helped people who had refused to surrender their land and refused to accept the compensation amount.<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>2018: <\/b><span style=\"font-weight: 400;\">But on February 8, 2018 a three-judge bench headed by Justice Arun Mishra reversed this verdict.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This set of three judges decided that it was enough for the government to offer the compensation and it did not matter if the landowner refused to accept the money.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This judgment had declared the previous 2014 verdict as per <\/span><b>incuriam \u2014 that is, delivered without care for the law or facts.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court has asked all high courts across the country to put off decisions in land acquisition disputes on the basis of these judgments till the matter was sorted out by March 7<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\">, 2018.<\/span><\/li>\n<\/ul>\n<p><b>Judicial discipline:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If a judgment is wrong, there is a method of <\/span><b>reference to a larger bench <\/b><span style=\"font-weight: 400;\">and this is the practice being followed over the years.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This procedure needs a<\/span><b> conscious judicial discipline.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">But this judicial discipline has not been followed (by the Justice Arun Mishra bench).<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If it wants to correct an earlier judgment, it should be done by the larger bench to make it (the judgment) as the last word.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>\u2018CJI-led Bench to resolve conflict over judgments Context: Amid a conflict over \u201cjudicial discipline\u201d within the Supreme Court in connection with certain land acquisition cases, a five-judge Bench led by Chief Justice of India Dipak Misra sets to resolve the conflict.
