{"id":30913,"date":"2018-10-27T11:25:03","date_gmt":"2018-10-27T05:55:03","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30913"},"modified":"2018-10-27T11:25:03","modified_gmt":"2018-10-27T05:55:03","slug":"against-human-rights","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/against-human-rights\/","title":{"rendered":"Against human rights"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/opinion\/op-ed\/against-human-rights\/article22882692.ece\"><b>Against human rights<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Rule of law is the fundamental principle of governance of any civilised liberal democracy but \u00a0the <\/span><b>Uttar Pradesh government looks somewhat determined to disregard the first principles of the criminal justice system.<\/b><\/li>\n<\/ul>\n<p><b>More in news:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Police encounters have <\/span><b>become routine in U.P.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In December, Chief Minister Yogi Adityanath had<\/span> <span style=\"font-weight: 400;\">introduced in the State Assembly <\/span><b>the Uttar Pradesh Control of Organised Crime Bill, 2017 on the pattern of the regressive Maharashtra Control of Organised Crime Act (MCOCA).<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Such legislation <\/span><b>does not promote the rule of law, but is itself a kind of violence, though a legitimate one with due authority of law.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Such laws are basically examples of <\/span><b>\u201crule by law\u201d as law itself negates human rights and permits deviations from due processes.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The fundamental premise of the rule of law is that <\/span><b>every human being, including the worst criminal, is entitled to basic human rights and due process. <\/b><\/li>\n<\/ul>\n<p><b>Encounter killing:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Encounter killings generally take place with the<\/span><b> prior consent or in full knowledge of the top authority.<\/b><\/li>\n<li><span style=\"font-weight: 400;\">But in reality, when after a long wait, the trial in cases of <\/span><b>fake encounter takes place, the main culprits easily get discharged, and, in some cases, the Central Bureau of Investigation even refuses to file an appeal against such discharge, and subsequently many prosecution witnesses turn hostile.<\/b><\/li>\n<li><span style=\"font-weight: 400;\">There is a qualitative difference between use of force in an operation and use of such deadly force that is akin to using a sledgehammer to kill a fly;<\/span><b> one is an act of self-defence while the other is an act of retaliation.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Importantly, the above observations were <\/span><b>about terrorists, not ordinary criminals like those being killed in U.P. encounters.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">From the details of U.P. encounters, they <\/span><b>do not look like acts of defence by the U.P. police.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">These encounters demonstrate the <\/span><b>government\u2019s resolve to adopt \u2018the rule by gun\u2019 in preference to \u2018the rule of law\u2019.<\/b><\/li>\n<\/ul>\n<p><b>Conclusion:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The primordial value is that it is the responsibility of every organ of the State to function within the four corners of constitutional responsibility. <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">That is the ultimate rule of law.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Against human rights Context: Rule of law is the fundamental principle of governance of any civilised liberal democracy but \u00a0the Uttar Pradesh government looks somewhat determined to disregard the first principles of the criminal justice system.
