{"id":30941,"date":"2018-10-27T11:31:23","date_gmt":"2018-10-27T06:01:23","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30941"},"modified":"2018-10-27T11:31:23","modified_gmt":"2018-10-27T06:01:23","slug":"haryana-cabinet-nod-to-death-penalty-for-rape-of-victim-aged-12-or-less","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/haryana-cabinet-nod-to-death-penalty-for-rape-of-victim-aged-12-or-less\/","title":{"rendered":"Haryana cabinet nod to death penalty for rape of victim aged 12 or less"},"content":{"rendered":"<p><a href=\"http:\/\/indianexpress.com\/article\/india\/haryana-cabinet-nod-to-death-penalty-for-rape-of-victim-aged-12-or-less-5080677\/\"><b>Haryana cabinet nod to death penalty for rape of victim aged 12 or less<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Haryana Chief Minister, who had expressed anguish and concern over recent incidents of rape, had said that provisions of \u201charsher punishment for rape\u201d were required in the state. <\/span><\/p>\n<p><b>What has happened?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Haryana government has given its nod to a proposal to bring in a legislation that would have a provision awarding death penalty to those guilty of raping girls aged 12 years or less.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It has also been decided to make the existing criminal laws related to sexual offences more stringent.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The government has decided to amend legal provisions like section <\/span><b>376A<\/b><span style=\"font-weight: 400;\"> (Intercourse by a man with his wife during separation), <\/span><b>376D <\/b><span style=\"font-weight: 400;\">(rape by one or more persons constituting a group), <\/span><b>354<\/b><span style=\"font-weight: 400;\"> (Assault or criminal force against woman with intent to outrage her modesty) and <\/span><b>354 D (2)<\/b><span style=\"font-weight: 400;\"> (stalking) of Indian Penal Code (IPC).<\/span><\/li>\n<\/ul>\n<p><b>What are the provisions approved?<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">In case of rape or gang rape of a girl upto 12 years of age, there will be a punishment of death or rigorous imprisonment of not less than 14 years which may extend to imprisonment for life that is for remainder period of person\u2019s natural life<\/span><\/li>\n<\/ul>\n<p><b>376D A of the IPC<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In case a girl upto 12 years of age is raped by one or more persons constituting a group, each of those persons shall be deemed to have committed the offence of rape and will be punished with death or rigorous imprisonment for a term which will not be less than 20 years, but which may extend to life along with a fine<\/span><\/p>\n<p><b>354 of the IPC<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The punishment under section 354 of the IPC will not be less than two years (<\/span><i><span style=\"font-weight: 400;\">earlier not less than one year<\/span><\/i><span style=\"font-weight: 400;\">) but may extend upto seven years (<\/span><i><span style=\"font-weight: 400;\">earlier upto five years<\/span><\/i><span style=\"font-weight: 400;\">) and shall also liable to fine.<\/span><\/p>\n<p><b>354D (2) of IPC<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Whoever commits the offence or stalking will be punished on first conviction with imprisonment of either description for a term which may extend to three years and be punished on a second or subsequent conviction, with imprisonment for not less than three years, but which may extend to seven years (<\/span><i><span style=\"font-weight: 400;\">earlier up to five years<\/span><\/i><span style=\"font-weight: 400;\">)<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Haryana cabinet nod to death penalty for rape of victim aged 12 or less Context: Haryana Chief Minister, who had expressed anguish and concern over recent incidents of rape, had said that provisions of \u201charsher punishment for rape\u201d were required in the state.
