{"id":30998,"date":"2018-10-27T11:44:12","date_gmt":"2018-10-27T06:14:12","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=30998"},"modified":"2018-10-27T11:44:12","modified_gmt":"2018-10-27T06:14:12","slug":"states-can-relax-highway-liquor-ban","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/states-can-relax-highway-liquor-ban\/","title":{"rendered":"States can relax highway liquor ban"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/states-can-relax-highway-liquor-ban\/article22853540.ece\"><b>States can relax highway liquor ban<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court gave the State governments the discretion to decide, on facts, whether areas covered by local self-governing bodies or areas proximate to municipal pockets should be exempted from the court\u2019s nationwide prohibition on sale of liquor within 500 metres along the highways.<\/span><\/li>\n<\/ul>\n<p><b>Background:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">On July 11, 2017, the court exempted municipal areas from the prohibition.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The purpose of the ban, imposed in a December, 2016 judgment, was to prevent drunken driving along these busy thoroughfares.<\/span><\/li>\n<\/ul>\n<p><b>Clarification sought<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">States, especially Tamil Nadu, came to the court, asking whether panchayats would also come under the definition of \u201cmunicipal areas\u201d mentioned in the July 11 order.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Tamil Nadu said \u201cmunicipal areas\u201d were not \u201cintended to exclude areas within the jurisdiction of local self-governing bodies.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The States reasoned that in future, these panchayats might be developed in a manner similar to municipalities, or some of them might be geographically proximate to an urban agglomeration.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They sought a clarification about the \u201cobvious uncertainties\u201d thrown open by the order.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>States can relax highway liquor ban Context: The Supreme Court gave the State governments the discretion to decide, on facts, whether areas covered by local self-governing bodies or areas proximate to municipal pockets should be exempted from the court\u2019s nationwide prohibition on sale of liquor within 500 metres along the highways.
