{"id":31063,"date":"2018-10-27T12:00:11","date_gmt":"2018-10-27T06:30:11","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=31063"},"modified":"2018-10-27T12:00:11","modified_gmt":"2018-10-27T06:30:11","slug":"an-umbrella-for-the-consumer","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/an-umbrella-for-the-consumer\/","title":{"rendered":"An umbrella for the consumer"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-opinion\/an-umbrella-for-the-consumer\/article22830121.ece\"><b>An umbrella for the consumer<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Consumer Protection Bill, 2018 is a step towards providing ordinary consumers some protection of their interests and effective administration and settlement of disputes.<\/span><\/li>\n<\/ul>\n<p><b>Definition of consumer:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The pending Bill, which will replace the Consumer Protection Act, 1986, defines the \u201cconsumer\u201d as a person who buys any good or avails a service for a consideration.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Bill covers transactions, both online and offline, and includes tele-shopping and multi-level marketing.<\/span><\/li>\n<\/ul>\n<p><b>\u201cConsumer rights\u201d<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The definition of \u201cconsumer rights\u201d in the Bill exhaustively covers the right to be protected against the marketing of goods, products or services that are hazardous to life and property.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It also focuses on the right to be informed about the quality, quantity, potency, purity, standard and price of goods, products or services, as the case may be, so as to protect a consumer against unfair trade practices.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It also includes the right to be assured, wherever possible, of access to a variety of goods, products or services at competitive prices.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> It involves the right to seek redress against unfair or restrictive trade practices, or unscrupulous exploitation of consumers.<\/span><\/li>\n<\/ul>\n<p><b>Salient features of the Bill:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Bill\u2019s salient features include <\/span><b>establishment of an executive agency to be known as the Central Consumer Protection Authority (CCPA)<\/b><span style=\"font-weight: 400;\"> to promote, protect and enforce the rights of the consumers.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> The Bill proposes to empower the CCPA to investigate, recall, refund and impose penalties.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> \u00a0<\/span><span style=\"font-weight: 400;\">The Bill provides for product liability action in cases of personal injury, death or property damage caused by or resulting from any product, and mediation as an alternate dispute resolution, making the process of dispute adjudication simpler and quicker.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The CCPA is also empowered to deal with unfair trade practices and misleading advertisements.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The CCPA is to be headed by a Chief Commissioner.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Bill seeks to set up a <\/span><b>monitoring cell,<\/b><span style=\"font-weight: 400;\"> to be constituted by the president of the <\/span><b>National Consumer Disputes Redressal Commission<\/b><span style=\"font-weight: 400;\"> to oversee the functioning of the State consumer commissions from the administrative point of view.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Bill provides for a State government to establish <\/span><b>a consumer mediation cell<\/b><span style=\"font-weight: 400;\"> to be attached to each of the district commissions and the State commissions.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Bill proposes that the Centre establishes a consumer mediation cell to be attached to the National Commission.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>An umbrella for the consumer Context: The Consumer Protection Bill, 2018 is a step towards providing ordinary consumers some protection of their interests and effective administration and settlement of disputes.
