Ministry of Electronics and Information Technology (MeitY) notified the <span style=\"color: #ff0000;\">PIB&#8217;s FCU<\/span> as the <span style=\"color: #ff0000;\">fact check unit<\/span> under the provisions of the amended rules.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 23.2932%;\"><strong>Aim of FCU<\/strong><\/td>\n<td style=\"width: 76.7068%;\">The FCU would flag any social media posts it deemed &#8216;<span style=\"color: #ff0000;\">fake<\/span>,&#8217; &#8216;<span style=\"color: #ff0000;\">false<\/span>,&#8217; or &#8216;<span style=\"color: #ff0000;\">misleading<span style=\"color: #333333;\">&#8216;<\/span><\/span><span style=\"color: #333333;\">\u00a0<\/span>regarding government affairs. It could also <span style=\"color: #ff0000;\">compel platforms to remove such content<\/span> to maintain their \u201csafe harbour\u201d status and legal immunity.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>This raised concerns over free speech and the extent of government regulation, as it positioned the government as the sole arbiter of truth regarding its own activities.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What does the Judgement of the Bombay High Court entail?<\/strong><\/span><\/h2>\n<p>The Bombay HC held that the amended rules were unconstitutional, with a 2-1 verdict.<\/p>\n<p><strong>a. Restriction of Fundamental Rights-<\/strong> The majority judgement has held that the amended Rule <span style=\"color: #ff0000;\">violated<\/span> <span style=\"color: #ff0000;\">Articles 14<\/span>, <span style=\"color: #ff0000;\">19<\/span>(<span style=\"color: #ff0000;\">1<\/span>)(<span style=\"color: #ff0000;\">a<\/span>), and <span style=\"color: #ff0000;\">19<\/span>(<span style=\"color: #ff0000;\">1<\/span>)(<span style=\"color: #ff0000;\">g<\/span>) of the Constitution by restricting fundamental rights beyond permissible limits.<\/p>\n<p><strong>b. Vague and Misleading Terms-<\/strong> The verdict holds that the terms like &#8216;<span style=\"color: #ff0000;\">fake<\/span>, <span style=\"color: #ff0000;\">false<\/span>, or <span style=\"color: #ff0000;\">misleading<\/span>&#8216; are <span style=\"color: #ff0000;\">vague<\/span> and <span style=\"color: #ff0000;\">overbroad<\/span>. It is not the state\u2019s role to ensure citizens receive only &#8216;truthful&#8217; information.<\/p>\n<p><strong>c. Chilling effect on Freedom of Speech and Expression-<\/strong> The verdict has noted that the<span style=\"color: #ff0000;\"> threat<\/span> to <span style=\"color: #ff0000;\">social media platforms<\/span> of <span style=\"color: #ff0000;\">losing their<\/span> \u201c<span style=\"color: #ff0000;\">safe harbour<\/span>\u201d status, created a chilling effect on freedom of speech.<\/p>\n<p><strong>d. Overarching powers of the Fact-Check Unit-<\/strong> The verdict criticized the Fact Check Unit&#8217;s (FCU\u2019s) power as overreaching. The verdict holds that the state classifying speech as true or false and forcing non-publication, <span style=\"color: #ff0000;\">tantamounts to censorship<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What is the PIB&#8217;s Fact-Check Unit (PIB-FCU)?<\/strong><\/span><\/h2>\n<p><strong>PIB&#8217;s Fact-Check Unit (PIB-FCU)-<\/strong> PIB&#8217;s Fact-Check Unit was established in <span style=\"color: #ff0000;\">November 2019<\/span> with a <span style=\"color: #ff0000;\">stated objective of acting as a deterrent<\/span> to creators and disseminators of fake news and misinformation. It aims to provide people with an <span style=\"color: #ff0000;\">easy avenue to report suspicious and questionable information<\/span> pertaining to the Government of India.<\/p>\n<p><strong>Functions\/Mandate of PIB-FCU<\/strong><\/p>\n<p><strong>a.<\/strong> The <span style=\"color: #ff0000;\">PIB-FCU is mandated to counter misinformation<\/span> on Government policies, initiatives, and schemes either suo motu or under a reference via complaints.<\/p>\n<p><strong>b.<\/strong> The <span style=\"color: #ff0000;\">PIB-FCU actively monitors<\/span>, <span style=\"color: #ff0000;\">detects<\/span>, <span style=\"color: #ff0000;\">and counters disinformation campaigns<\/span>, ensuring that false information about the Government is promptly exposed and corrected.<\/p>\n<p><strong>c.<\/strong> When this unit flags a <span style=\"color: #ff0000;\">piece of content as fake<\/span>, <span style=\"color: #ff0000;\">social media platforms<\/span> will have to <span style=\"color: #ff0000;\">take it down as part of their due diligence requirement<\/span> under the IT Rules. Also, the <span style=\"color: #ff0000;\">internet and telecom service providers like Jio and Airtel<\/span> will have to block the web link of a particular fake news information.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What was Govt&#8217;s rationale for notifying PIB&#8217;s Fact-Check Unit (PIB-FCU) as the Central Govt&#8217;s Fact-check Unit?<\/strong><\/span><\/h2>\n<p><strong>1. Addressing the issue of fake news-<\/strong> The fact-checking body can help to <span style=\"color: #ff0000;\">address the issue of fake news and misinformation on online platforms<\/span>, which can potentially cause harm to society.<\/p>\n<p><strong>2. Improved accountability of Social Media Intermediaries-<\/strong> The notification of PIB&#8217;s Fact-Check Unit as the Govt&#8217;s Fact-checking unit will <span style=\"color: #ff0000;\">increase accountability<\/span> of social media intermediaries like <span style=\"color: #ff0000;\">Facebook<\/span>, <span style=\"color: #ff0000;\">Twitter<\/span> etc., which will now be required to remove false and misleading content.<\/p>\n<p><strong>3. Enhancement of Cybersecurity-<\/strong> PIB&#8217;s Fact-Check Unit can improve the cybersecurity by preventing the misuse of online platforms for illegal or harmful activities. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Regulation of Sharing of Deepfakes<\/span>.<\/p>\n<p><strong>4. Prevention of Hate Speech and Violence-<\/strong> The Fact-Check unit seeks to ensure compliance with Indian laws like IT Act and laws related to national security. This <span style=\"color: #ff0000;\">helps to prevent the misuse of social media platforms<\/span> and other digital media outlets <span style=\"color: #ff0000;\">to incite violence or spread hate speech<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc5\"><\/a>What were the Concerns with notification of fact-check Unit by the Government of India?<\/strong><\/span><\/h2>\n<p><strong>1. &#8216;Chilling effect&#8217; on freedom of speech and expression-<\/strong> There were concerns that PIB&#8217;s fact-check unit and its power to censor content could have a <span style=\"color: #ff0000;\">chilling effect on free speech and expression provided under Art 19(1)(a)<\/span>.\u00a0 There were concerns that people would be hesitant to express their opinions online for fear of being censored or facing legal consequences.<\/p>\n<p><strong>2. Potential for Misuse by the Govt-<\/strong> The fact-check unit\u2019s power <span style=\"color: #ff0000;\">could be misused by the government to silence dissenting voices or criticism<\/span> of government actions. This could have serious implications for democracy and human rights.<\/p>\n<p><strong>3. Conflict of interest-<\/strong> The role played by the fact-checking unit has a significant conflict of interest as it plays the <span style=\"color: #ff0000;\">role of judge<\/span>, <span style=\"color: #ff0000;\">jury, and<\/span>\u00a0<span style=\"color: #ff0000;\">executioner<\/span>.<\/p>\n<p><strong>4. Lack of clarity on what constitutes \u201cfake or false or misleading\u201d information-<\/strong> There is lack of a clear definition of <span style=\"color: #ff0000;\">what types of information qualify as<\/span> &#8216;<span style=\"color: #ff0000;\">fake or false or misleading<\/span>&#8216;. This lack of clarity <span style=\"color: #ff0000;\">creates ambiguity<\/span> and can <span style=\"color: #ff0000;\">lead to arbitrary censorship<\/span> by the government.<\/p>\n<p><strong>5. Short-circuiting established legal procedures-<\/strong> The notification of a <span style=\"color: #ff0000;\">fact-checking unit with powers to issue directions to take down content<\/span>, short-circuit the procedures, safeguards, and conditions laid out in <span style=\"color: #ff0000;\">Shreya Singhal v. Union of India<\/span> and <span style=\"color: #ff0000;\">Section 69A of the IT Act<\/span>. The judgement extends the right to free speech into the online space.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc6\"><\/a>What Should be the Way Forward?<\/strong><\/span><\/h2>\n<p><strong>1. Final Verdict of the SC-<\/strong> The Bombay HC Verdict in the <span style=\"color: #ff0000;\">Kunal Kamra v. Union of India<\/span> (<span style=\"color: #ff0000;\">2023<\/span>) <span style=\"color: #ff0000;\">case<\/span> held the establishment of fact check units under the amended rules as unconstitutional. The SC must deliver final verdict on other concerns of IT Rules, such as <span style=\"color: #ff0000;\">mandates for social media platforms to establish grievance redressal<\/span> and <span style=\"color: #ff0000;\">compliance mechanisms<\/span>.<\/p>\n<p><strong>2. Develop a more transparent and participatory process-<\/strong> The government should work with <span style=\"color: #ff0000;\">civil society<\/span>, <span style=\"color: #ff0000;\">media organizations<\/span>, and <span style=\"color: #ff0000;\">other stakeholders<\/span> to develop a more transparent and participatory process for <span style=\"color: #ff0000;\">determining what content should be considered fake or misleading<\/span>.<\/p>\n<p><strong>3. Need an independent and non-partisan fact-checking body-<\/strong> The government should ensure that <span style=\"color: #ff0000;\">anybody tasked with fact-checking is independent and non-partisan<\/span>, with clear guidelines for how decisions are made.<\/p>\n<p><strong>4. Ensure functioning according to judicial and legal guidelines-<\/strong> The government should ensure that any takedown requests are made in accordance with the procedures and safeguards laid out in <span style=\"color: #ff0000;\">Shreya Singhal v.
