The demand for sixth schedule status is aimed for <span style=\"color: #ff0000;\">greater autonomy<\/span> to the region. While the demands for a separate public service commission and two parliamentary seats were met, the demands of the statehood for Ladakh and its inclusion under the sixth schedule of the Indian constitution has been rejected by the MHA.<\/p>\n<p>Also, recently, <span style=\"color: #ff0000;\">similar demands<\/span> have been made in <span style=\"color: #ff0000;\">Arunachal Pradesh<\/span> and <span style=\"color: #ff0000;\">Manipur<\/span> for their inclusion in the <span style=\"color: #ff0000;\">sixth schedule<\/span>. The focus is on the protection of ethnic groups under special constitutional provisions.<\/p>\n<p>In this article, we will look at the <span style=\"color: #ff0000;\">historical roots of demands for fifth and sixth schedule of the constitution<\/span>. We will look at the provisions of the sixth schedule of the constitution. India follows an <span style=\"color: #ff0000;\">asymmetrical federal structure<\/span>, where <span style=\"color: #ff0000;\">certain states or regions<\/span> have more autonomy than others.<br \/>\nUnlike <span style=\"color: #ff0000;\">symmetrical federations<\/span> like the <span style=\"color: #ff0000;\">U.S. or Australia<\/span>, where all states share equal powers, India <span style=\"color: #ff0000;\">grants special provisions to some areas<\/span> (under <span style=\"color: #ff0000;\">fifth <span style=\"color: #333333;\">and<\/span> sixth schedule<\/span>), especially those with unique ethnic compositions.<\/p>\n<p><span style=\"color: #000000;\"><strong>Historical Context behind the introduction of Fifth and Sixth Schedules<\/strong><\/span><\/p>\n<p><strong>Impact of Colonial Rules-<\/strong> The <span style=\"color: #ff0000;\">Fifth<\/span> and <span style=\"color: #ff0000;\">Sixth Schedules<\/span> of the Indian Constitution have their roots in <span style=\"color: #ff0000;\">colonial policies<\/span> that recognized the distinct nature of tribal populations.<br \/>\nTribals maintained their autonomy over their lands until British forest policies restricted their rights. This led to rebellions like the <span style=\"color: #ff0000;\">Kol<\/span> (1831-32) and <span style=\"color: #ff0000;\">Santhal<\/span> (1885) revolts. To address tribal discontent, the Government of India Act of 1935 introduced &#8216;<span style=\"color: #ff0000;\">excluded<\/span>&#8216; and &#8216;<span style=\"color: #ff0000;\">partially excluded<\/span>&#8216; areas, which later influenced the creation of the Fifth and Sixth Schedules.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What are the Distinctive Features of the Special Schedules which provide for regional Autonomy?<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\"><strong>Distinctive Features of special schedules<\/strong><\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 23.494%;\"><strong>Fifth Schedule<\/strong><\/td>\n<td style=\"width: 76.506%;\">The Fifth Schedule applies to &#8216;<span style=\"color: #ff0000;\">Scheduled Areas<\/span>,&#8217; which are identified based on criteria like a <span style=\"color: #ff0000;\">high tribal population<\/span> and <span style=\"color: #ff0000;\">economic backwardness<\/span>. The fifth schedule areas span across 10 states. <span style=\"color: #ff0000;\">Tribes Advisory Councils<\/span> (TACs) advise on tribal welfare.<br \/>\n<span style=\"color: #ff0000;\">Governors<\/span> have powers to <span style=\"color: #ff0000;\">regulate land allotment<\/span> and <span style=\"color: #ff0000;\">manage money-lending practices<\/span> in these areas, ensuring some degree of tribal autonomy.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 23.494%;\"><strong>Sixth Schedule<\/strong><\/td>\n<td style=\"width: 76.506%;\">The Sixth Schedule grants <span style=\"color: #ff0000;\">greater autonomy to tribal areas<\/span> in <span style=\"color: #ff0000;\">Assam<\/span>, <span style=\"color: #ff0000;\">Meghalaya<\/span>, <span style=\"color: #ff0000;\">Mizoram<\/span>, and <span style=\"color: #ff0000;\">Tripura<\/span>.<br \/>\n<span style=\"color: #ff0000;\">Autonomous District Councils<\/span> (ADCs) manage <span style=\"color: #ff0000;\">land use<\/span>, <span style=\"color: #ff0000;\">inheritance laws<\/span>, and <span style=\"color: #ff0000;\">social customs<\/span>. ADCs hold <span style=\"color: #ff0000;\">legislative<\/span>, <span style=\"color: #ff0000;\">executive<\/span>, and <span style=\"color: #ff0000;\">financial powers<\/span>, with the <span style=\"color: #ff0000;\">ability to collect taxes<\/span> and <span style=\"color: #ff0000;\">manage local resources<\/span>. Unlike the Fifth Schedule, ADCs can make laws that supersede those of the state, pending approval by the Governor.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 23.494%;\"><strong>Special Provisions for Northeastern States<\/strong><\/td>\n<td style=\"width: 76.506%;\">Several northeastern states have additional protections under <span style=\"color: #ff0000;\">Part XXI<\/span> of the Constitution (<span style=\"color: #ff0000;\">Articles 371A-H<\/span>), which safeguard local customs and practices. These provisions ensure representation and development in tribal and hill areas of <span style=\"color: #ff0000;\">Nagaland<\/span>, <span style=\"color: #ff0000;\">Assam<\/span>, <span style=\"color: #ff0000;\">Manipur<\/span>, <span style=\"color: #ff0000;\">Sikkim<\/span>, <span style=\"color: #ff0000;\">Mizoram<\/span>, and <span style=\"color: #ff0000;\">Arunachal Pradesh<\/span>.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>Why is Ladakh Demanding Inclusion in the Sixth Schedule of The Constitution?<\/strong><\/span><\/h2>\n<p><strong>1. Political Representation and autonomy-<\/strong> The <span style=\"color: #ff0000;\">Jammu and Kashmir Reorganisation Act 2019<\/span>, created two separate <span style=\"color: #ff0000;\">UTs of J&amp;K<\/span> (<span style=\"color: #ff0000;\">with legislature<\/span>) and <span style=\"color: #ff0000;\">Ladakh<\/span> (<span style=\"color: #ff0000;\">without legislature<\/span>).\u00a0 While there had been four MLAs from the Ladakh region in the erstwhile J&amp;K Assembly, now the administration of Ladakh is <span style=\"color: #ff0000;\">completely in the hands of bureaucrats<\/span>. Thus, sixth schedule status is being demanded to ensure political representation and autonomy.<\/p>\n<p><strong>2. Lack of Local Employment opportunities-<\/strong> The administration of UT of Ladakh has failed to create local employment opportunities for youth of Ladakh. <strong>For Ex-<\/strong> <span style=\"color: #ff0000;\">Absence of a public service commission<\/span> and <span style=\"color: #ff0000;\">lack of comprehensive job policy<\/span> even after 4 years of creation of UT of Ladakh.<\/p>\n<p><strong>3. Preservation of Cultural Identity-<\/strong> Sixth schedule status is also being demanded to protect Ladakh&#8217;s unique cultural heritage and traditional customs. <strong><span style=\"color: #333333;\">For ex-<\/span><\/strong> Tribals like <span style=\"color: #ff0000;\">Gujjars<\/span>, <span style=\"color: #ff0000;\">Bakarwals<\/span>, <span style=\"color: #ff0000;\">Bots<\/span>, <span style=\"color: #ff0000;\">Changpas<\/span>, <span style=\"color: #ff0000;\">Baltis<\/span> and <span style=\"color: #ff0000;\">Purigpas\u00a0<span style=\"color: #333333;\">have distinct cultures which can better be preserved under sixth schedule of the constitution.<\/span><\/span><\/p>\n<p><strong>4. Preservation of Ladakh\u2019s Fragile ecosystem- <\/strong>Climate activists have raised flagged <span style=\"color: #ff0000;\">serious concerns regarding mining<span style=\"color: #333333;\"> and<\/span> industrialisation<\/span> in the fragile glacial ecological system of Ladakh. Sixth schedule status is being demanded <span style=\"color: #ff0000;\">to protect<\/span> the <span style=\"color: #ff0000;\">high-altitude deserts<\/span>, <span style=\"color: #ff0000;\">glaciers<\/span> and <span style=\"color: #ff0000;\">alpine meadows<\/span> which are a crucial habitat for rare and endangered species.<\/p>\n<p><strong>5. Change in domicile policy of Jammu and Kashmir-<\/strong> The change of domicile policy in UT of J&amp;K has amplified demands for sixth schedule for Ladakh to ensure domicile for Ladakh population.<\/p>\n<p><strong>6. Strengthening of democratic institutions-<\/strong> The establishment of autonomous councils under the Sixth Schedule would also strengthen democratic institutions at the grassroots level. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">More powers and autonomy to Ladakh Autonomous Hill Development Councils<\/span> (<span style=\"color: #ff0000;\">LAHDC<\/span>).<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What are The Advantages of Being Included in the Sixth Schedule of The Constitution?<\/strong><\/span><\/h2>\n<p><strong>1. Democratic Devolution of Powers-<\/strong> Sixth Schedule has helped in democratic devolution of powers through the <span style=\"color: #ff0000;\">creation of Autonomous District Councils<\/span> which have some legislative, judicial and administrative autonomy within a state.<\/p>\n<p><strong>2. Preservation of Cultural Practices and Customs-<\/strong> The inclusion of a region in the sixth schedule ensures protection of local language, cultural practices and customs. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Bodo language of Bodoland were protected<\/span>.<\/p>\n<p><strong>3. Protection of tribal Land rights-<\/strong> Sixth schedule has also helped in protection of agrarian and land rights by granting the autonomous councils the powers to <span style=\"color: #ff0000;\">legislate on matters like land<span style=\"color: #333333;\">,<\/span> forests<span style=\"color: #333333;\">, and<\/span> fisheries.<\/span><\/p>\n<p><strong>4. Grant-in Funds-<\/strong> Sixth schedule areas are provided with enhanced quantum of Grant-in Funds for rapid development and transformation. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Finance commission recommendations for Grant-in aids for sixth scheduled areas<\/span><\/p>\n<p><strong>5. Sustainable Socio-Economic Development-<\/strong> The inclusion of a region in the sixth schedule ensures <span style=\"color: #ff0000;\">socio-economic development of a region<\/span>\u00a0in consonance with the <span style=\"color: #ff0000;\">cardinal virtue of sustainability<\/span>.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc5\"><\/a>What are The Issues with The VI Schedule of the Constitution?<\/strong><\/span><\/h2>\n<p><strong>1. Limited Geographical Coverage-<\/strong> The sixth schedule areas are limited in their geographical coverage and exclude numerous tribal communities, leading to unequal treatment and exclusion. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Only limited to certain tribal pockets of Assam, Meghalaya, Tripura and Mizoram<span style=\"color: #333333;\">.<\/span><\/span><\/p>\n<p><strong>2. Lack of Effective decentralisation-<\/strong> The sixth schedule areas often lack effective and real decentralisation of powers and administration. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Only one District council for entire Bodo Territorial Area districts.<\/span><\/p>\n<p><strong>3. Legislative power of state over autonomous councils-<\/strong> The laws made by the councils <span style=\"color: #ff0000;\">require the assent of governor<\/span>. Also, in case of conflict of interest between the District Councils and the state legislature, the latter would prevail.<\/p>\n<p><strong>4. Financial dependency-<\/strong> Autonomous councils are <span style=\"color: #ff0000;\">dependent on their respective state governments for funds<\/span> in addition to the occasional special package from the Centre. <strong>For ex- <\/strong>Lack of timely constitution of State Finance Commission for recommending devolution of\u00a0 funds to District Councils and Regional Councils.<\/p>\n<p><strong>5. Corruption and Financial Mismanagement-<\/strong> The functioning of different councils in the sixth schedule areas has been marred by<span style=\"color: #ff0000;\"> corruption and financial mismanagement<\/span>.<\/p>\n<p><strong>6. Lack of skilled professionals-<\/strong> The autonomous councils lack skilled planning professionals, which<span style=\"color: #ff0000;\"> results in ill-conceived development projects<\/span> without proper technical and financial consideration.<\/p>\n<p><strong>7. Lack of Codification of customary Laws-<\/strong> The councils have failed in codifying customary laws of the local tribal population.<\/p>\n<p><strong>8. Political Interference-<\/strong> The autonomy granted by the Sixth Schedule is often undermined by<span style=\"color: #ff0000;\"> political interference<\/span> from the Centre and State governments.<\/p>\n<p><strong>9. Pending Constitutional Bill which provides for greater reforms-<\/strong> The delay in passage of the <span style=\"color: #ff0000;\">125th Constitutional Amendment Bill<\/span>, which aims to empower ADCs, has <span style=\"color: #ff0000;\">hindered greater self-governance<\/span> in these areas.<\/p>\n<p><strong>10. Non-implementation of FRA-<\/strong> The Forest Rights Act, 2006, which <span style=\"color: #ff0000;\">aims to protect tribal land rights<\/span>, has not <span style=\"color: #ff0000;\">yet been implemented<\/span> in the sixth schedule area.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc6\"><\/a>What Should be The Way Forward?<\/strong><\/span><\/h2>\n<p><strong>1. Creation of elected Village Councils-<\/strong> Village councils must be created with their accountability to the local Gram Sabhas.<\/p>\n<p><strong>2. Ensuring regular Elections-<\/strong> The state governments must ensure <span style=\"color: #ff0000;\">regular, free and fair elections<\/span> to these autonomous councils. <strong>For Ex-<\/strong> <span style=\"color: #ff0000;\">Reduce the dominance of Tribal Elites<\/span>.<\/p>\n<p><strong>3. Representation of Women and other Ethnic Minorities-<\/strong> Women and other ethnic minorities must be provided <span style=\"color: #ff0000;\">adequate representation<\/span> in these autonomous councils.<\/p>\n<p><strong>4. Increase geographical coverage-<\/strong> Constitutional amendment must be brought to expand coverage of 6th scheduled areas in other tribal dominated regions which need protection. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Ladakh inclusion in 6th schedule<\/span>.<\/p>\n<p><strong>5.
