{"id":31238,"date":"2018-10-27T12:38:43","date_gmt":"2018-10-27T07:08:43","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=31238"},"modified":"2018-10-27T12:38:43","modified_gmt":"2018-10-27T07:08:43","slug":"dealing-with-hijacking","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/dealing-with-hijacking\/","title":{"rendered":"Dealing with hijacking"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/opinion\/op-ed\/dealing-with-hijacking\/article22765526.ece\"><b>Dealing with hijacking<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">India had repealed Anti-Hijacking Act of 1982 in 2016<\/span><\/p>\n<p><b>The need for new stricter law:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The hijacking of Indian Airlines flight IC-814 in 1999 and the 9\/11 attacks in the U.S., in which aircraft were used as missiles, made India realize that it needs to tighten the 1982 anti-hijacking law.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The need was also felt to make hijacking punishable with death penalty.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The government felt that the Anti-Hijacking Act of 1982 had insufficient penalties and was not comprehensive enough to deal with new challenges.<\/span><\/li>\n<\/ul>\n<p><b>Highlights of the Anti-Hijacking Act, 2016<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Anti-Hijacking Act, 2016 repealed the 1982 Act.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> Its objectives are in accordance to the<\/span><span style=\"font-weight: 400;\"> Convention for the Suppression of Unlawful Seizure of Aircraft.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Act further incorporated the September 2010 <\/span><span style=\"font-weight: 400;\">Beijing Protocol Supplementary to the Convention<\/span><span style=\"font-weight: 400;\"> which specifically dealt with \u201cunlawful acts against civil aviation by new types of threats\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> The Act highlighted the government\u2019s concern for expedient measures to be taken during hostile acts of seizure or exercise of control of aircraft which jeopardise the safety of persons and property.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The new law revamped Section 3 of the 1982 legislation to expand the definition of hijacking to seizure or takeover of an aircraft using \u201cany technological means\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The law takes into consideration the possibility that a hijacker need not be physically present inside the aircraft to take control of it. According to the Act, even a credible \u201cthreat\u201d to hijack an aircraft amounts to hijacking.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The definition of \u2018hijacking\u2019 further includes an attempt to commit the crime, abetting, organising, participating in it as an accomplice, and unlawfully and intentionally assisting a person involved in hijacking to evade investigation or prosecution or punishment.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Section 4 of the Act allows capital punishment if the hijacking leads to the death of a hostage, a security personnel, or any person not involved in the offence.
