{"id":31440,"date":"2018-10-27T13:53:38","date_gmt":"2018-10-27T08:23:38","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=31440"},"modified":"2018-10-27T13:53:38","modified_gmt":"2018-10-27T08:23:38","slug":"khap-menace","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/khap-menace\/","title":{"rendered":"Khap menace"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-opinion\/khap-menace\/article22684119.ece\"><b>Khap menace<\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> It is not the first time that the Supreme Court is impelled to remind khap panchayats and the society at large that they have <\/span><b>no business interfering in the life choices of individuals regarding marriage and love.<\/b><\/li>\n<\/ul>\n<p><b>Supreme Court\u2019s latest observations:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The court\u2019s latest observations are that khap panchayats <\/span><b>should not act as though they are conscience-keepers of society.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">And no one should interfere in relationships between adults came while it was hearing a writ petition <\/span><b>seeking a ban on such community organisations and guidelines to put an end to \u201chonour killings\u201d.<\/b><\/li>\n<\/ul>\n<p><b>Key concern:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is a grave misfortune that <\/span><b>parents and self-appointed guardians of society<\/b><span style=\"font-weight: 400;\"> continue to use <\/span><b>coercion and harassment, and even resort to murderous violence,<\/b><span style=\"font-weight: 400;\"> as a means to enforce their exclusionary and feudal prejudices.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">These khap organisations in north India seek to <\/span><b>enforce age-old taboos<\/b><span style=\"font-weight: 400;\"> such as the prohibition on sagothra marriages among Hindus.<\/span><\/li>\n<\/ul>\n<p><b>Bill to prohibit interference in marriage alliances:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Law Commission in 2012 prepared a draft bill to prohibit interference in marriage alliances.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Key provisions that seek to address the problem of khap panchayats in this draft say such <\/span><b>informal groups<\/b><span style=\"font-weight: 400;\"> would be treated as an <\/span><b>\u2018unlawful assembly\u2019<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">And decisions that amount to harassment, social boycott, discrimination or incitement to violence should be <\/span><b>punishable with a minimum sentence<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Whether the solution is social transformation or legislative change, high-handed mediation or interference <\/span><b>should brook no sympathy.<\/b><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Khap menace Context: It is not the first time that the Supreme Court is impelled to remind khap panchayats and the society at large that they have no business interfering in the life choices of individuals regarding marriage and love.
