{"id":31484,"date":"2018-10-27T14:18:45","date_gmt":"2018-10-27T08:48:45","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=31484"},"modified":"2018-10-27T14:18:45","modified_gmt":"2018-10-27T08:48:45","slug":"when-2-adults-marry-none-should-interfere","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/when-2-adults-marry-none-should-interfere\/","title":{"rendered":"\u2018When 2 adults marry, none should interfere\u2019\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/when-2-adults-marry-none-should-interfere\/article22663518.ece\"><b>\u2018When 2 adults marry, none should interfere\u2019<\/b><\/a><b>\u00a0<\/b><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Two adults are free to marry and \u201cno third party\u201d has a right to harass or cause harm to them, said Chief Justice of India Dipak Misra, speaking against honour killings.<\/span><\/li>\n<\/ul>\n<p><b>Case:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The court was hearing a petition filed by Shakti Vahini, an NGO, to make honour killing a specific crime.<\/span><\/li>\n<\/ul>\n<p><b>Court\u2019s verdict:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> \u201cWhen two people get into wedlock, no one should interfere. Neither parents, society, khap or panchayat&#8230; no one at all,\u201d<\/span> <span style=\"font-weight: 400;\">said Justice Misra, leading a three-judge Bench that upheld the fundamental right of two people who wish to marry and live peacefully.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">He argued that the objection of khaps to marriages between people from the same gotra was upheld in Section 5 of the <\/span><span style=\"font-weight: 400;\">Hindu Marriage Act of 1955<\/span><span style=\"font-weight: 400;\">. The section said \u201c sapinda should be removed by five degrees from the father\u2019s side and by three degrees from the mother\u2019s side.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Chief Justice repeated that no one has any individual, group or collective right to harass a couple.<\/span><\/li>\n<\/ul>\n<p><b>Freedom of adults<\/b><\/p>\n<p><span style=\"font-weight: 400;\">But the Chief Justice said the court was not concerned about khap panchayats either. \u201cWe are not writing an essay here on traditions, lineages, etc. We are only concerned with the freedom of adults to marry and live together without facing harassment,\u201d the Chief Justice said.<\/span><\/p>\n<p><b>What is Honour killing?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Honour killing is defined as the <\/span><span style=\"font-weight: 400;\">killing of a relative, especially a girl or woman,<\/span> <span style=\"font-weight: 400;\">who is perceived to have brought dishonour on the family.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">India registered <\/span><span style=\"font-weight: 400;\">251 honour killings in 2015,<\/span><span style=\"font-weight: 400;\"> recording a big spike in murders carried out by people professing to be acting in defence of their family\u2019s reputation.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It involves the murder of a woman or girl by male family members.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Honour killings have been reported in <\/span><span style=\"font-weight: 400;\">northern regions of India<\/span><span style=\"font-weight: 400;\">, mainly in the Indian states of Punjab, Rajasthan, Haryana and Uttar Pradesh as a result of people marrying without their family\u2019s acceptance, and sometimes for marrying outside their caste or religion.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Honour killings are <\/span><span style=\"font-weight: 400;\">also<\/span> <span style=\"font-weight: 400;\">widespread in South India<\/span><span style=\"font-weight: 400;\"> and the western Indian states of Maharashtra and Gujarat.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>\u2018When 2 adults marry, none should interfere\u2019\u00a0 Context: Two adults are free to marry and \u201cno third party\u201d has a right to harass or cause harm to them, said Chief Justice of India Dipak Misra, speaking against honour killings.
