The CAG report has also highlighted that the Urban bodies generate only 32% of their revenue independently, with the rest coming from state and Union government transfers. It also added <span style=\"color: #ff0000;\">12th Schedule<\/span> to the Constitution. It contains <span style=\"color: #ff0000;\">18 functional items of Municipalities<\/span>.<\/p>\n<p><strong><span style=\"color: #333333;\">Structure of Urban Local Bodies in India- <\/span><\/strong>The Urban Local Government in India consists of eight types of Urban local bodies.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Municipal Corporation<\/strong><\/td>\n<td style=\"width: 73.4086%;\">Mahanagar Palikas\/Municipal Corporation for areas with <span style=\"color: #ff0000;\">a population of more than one million<\/span>. Municipal corporations are usually found in big cities such as Bangalore, Delhi, Mumbai, Kolkata, etc.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Municipality<\/strong><\/td>\n<td style=\"width: 73.4086%;\">Nagar Palikas\/Municipal council\/Municipal committee\/Municipal board for areas with <span style=\"color: #ff0000;\">less than a million people<\/span>. The smaller cities tend to have the provision of municipalities.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Notified Area Committee<\/strong><\/td>\n<td style=\"width: 73.4086%;\">Notified area committees are set up for the <span style=\"color: #ff0000;\">fast-developing towns<\/span> and the towns lacking the basic amenities. <span style=\"color: #ff0000;\">All the members<\/span> of the notified area committee are <span style=\"color: #ff0000;\">nominated by the state government<\/span>.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Town Area Committee<\/strong><\/td>\n<td style=\"width: 73.4086%;\">The town area committee is found in the <span style=\"color: #ff0000;\">small towns<\/span>. It has <span style=\"color: #ff0000;\">minimal authority<\/span> such as street lighting, drainage roads, and conservancy.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Cantonment Board<\/strong><\/td>\n<td style=\"width: 73.4086%;\">It is usually set up for a civilian population living in the cantonment area. It is <span style=\"color: #ff0000;\">created and run by the central government<\/span>.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Township<\/strong><\/td>\n<td style=\"width: 73.4086%;\">Township is another form of urban government to provide basic facilities to the staff and workers living in the colonies established near the plant. It has <span style=\"color: #ff0000;\">no elected members<\/span> and is <span style=\"color: #ff0000;\">merely an extension of the bureaucratic structure<\/span>.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Port Trust<\/strong><\/td>\n<td style=\"width: 73.4086%;\">Port trusts are established in the port areas such as <span style=\"color: #ff0000;\">Mumbai<\/span>, <span style=\"color: #ff0000;\">Chennai<\/span>, <span style=\"color: #ff0000;\">Kolkata<\/span>, etc. It manages and takes care of the port. It also <span style=\"color: #ff0000;\">provides basic civic amenities to the people<\/span> living in that area.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 26.5914%;\"><strong>Special Purpose Agency<\/strong><\/td>\n<td style=\"width: 73.4086%;\">These agencies undertake the <span style=\"color: #ff0000;\">designated activities or specific functions<\/span> <span style=\"color: #ff0000;\">belonging<\/span> to the <span style=\"color: #ff0000;\">municipal corporations<\/span> or municipalities.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc2\"><\/a>What is the significance of Urban Local Bodies in India?<\/strong><\/span><\/h2>\n<p>1. <strong>Urban Planning and Development-<\/strong> Urban local bodies play a crucial role in land-use planning, infrastructure development, and implementing policies that promote sustainable urban growth. <strong>For ex- <\/strong><span style=\"color: #ff0000;\">Municipal Corporations<\/span> prepare <span style=\"color: #ff0000;\">master plans<\/span> to <span style=\"color: #ff0000;\">guide the development of cities<\/span>.<\/p>\n<p>2. <strong>Service Delivery-<\/strong> ULBs are responsible for providing essential services to urban residents like <span style=\"color: #ff0000;\">water supply<\/span>, <span style=\"color: #ff0000;\">sanitation<\/span>, <span style=\"color: #ff0000;\">solid waste management<\/span>, <span style=\"color: #ff0000;\">street lighting<\/span>, and <span style=\"color: #ff0000;\">public health services<\/span>.<\/p>\n<p>3. <strong>Disaster and Pandemic Management-<\/strong> ULBs are involved in developing and implementing plans to mitigate the impact of natural disasters and other emergencies at the local Level. <strong>For Ex-<\/strong> <span style=\"color: #ff0000;\">BMC at the frontline during COVID-19 outbreak management and Mumbai Floods<\/span>.<\/p>\n<p>4. <strong>Empowerment of Women and Marginalized Groups-<\/strong> <span style=\"color: #ff0000;\">Reservations for women and marginalized groups in local bodies<\/span>, as mandated by the 73rd and 74th Constitution Amendment Acts, have led to their increased participation in the decision-making processes.<\/p>\n<p>5. <strong>Community Participation-<\/strong> The urban local bodies is reflective of Gandhiji&#8217;s dream of &#8216;<span style=\"color: #ff0000;\">Poorna Swaraj<\/span>&#8216; through &#8216;<span style=\"color: #ff0000;\">Oceanic circle of power<\/span>&#8216; and &#8216;<span style=\"color: #ff0000;\">democratic decentralisation<\/span>&#8216;. <strong>For ex-<\/strong> Mechanisms such as <span style=\"color: #ff0000;\">ward committees <span style=\"color: #333333;\">and<\/span> public consultations<\/span> help the residents to actively engage in local governance.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc3\"><\/a>What are the Challenges faced by Urban Local Bodies In India?<\/strong><\/span><\/h2>\n<p><span style=\"color: #000000;\"><strong>Funding Challenges<\/strong><\/span><\/p>\n<p>1. <strong>Dependence on Central and State Transfers-<\/strong> According to the RBI Report on Municipal Finances 2022, Urban Local Bodies are dependent on state and central transfers for around <span style=\"color: #ff0000;\">35% of their revenue<\/span>. Further, the top-down transfers to the ULBs from the state and central Govt. as a percentage of GDP is extremely less in comparison with other countries.<\/p>\n<p>2. <strong>Reduced Revenue raising avenues in Post-GST mechanism-<\/strong> ULBs have bore the burnt in the Post-GST era with the <span style=\"color: #ff0000;\">subsumption of major sources of its revenue<\/span> like <span style=\"color: #ff0000;\">sales tax<\/span>, <span style=\"color: #ff0000;\">octroi<\/span> (<span style=\"color: #ff0000;\">in states like Maharashtra<\/span>) and <span style=\"color: #ff0000;\">local entertainment taxes<\/span> in the GST structure. <strong>For Ex-<\/strong> <span style=\"color: #333333;\">Loss of around \u20b97,000 crore, or 35% of its total revenue to Municipal Corporation of Greater Mumbai (MCGM) with the subsumption of Octroi taxes in GST regime. Also, the <span style=\"color: #ff0000;\">increase in cess and surcharges by the Central Govt,<\/span> which need not be devolved, has impacted the ULBs finances.<\/span><\/p>\n<p>3. <strong>Incapacity in raising direct finances from the assigned taxes-<\/strong> The <span style=\"color: #ff0000;\">ES 2018<\/span> has pointed out the <span style=\"color: #ff0000;\">failure of Urban Local Bodies in realising the full potential of property tax<\/span>, which is the exclusive domain of Urban local bodies. <strong>For Ex-<\/strong> A\/c to Peterson Institute of International Economics, China&#8217;s ULBs raise 20-22% of finance from property taxes while Indian ULBs raise only 10-11% from property taxes.<\/p>\n<p>4. <strong>Narrow\u00a0taxation powers-<\/strong> ULBs in India do not have wide taxation powers as compared to other developed nations. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">China<\/span> (ULBs major component comes from selling land use rights), <span style=\"color: #ff0000;\">Denmark<\/span> (Local personal Income Tax), <span style=\"color: #ff0000;\">US<\/span> (City governments can impose wide-ranging taxes).<\/p>\n<p>5. <strong>Lack of timely Constitution of State Finance Commission-<\/strong> States in India have failed in timely constitution of the state finance commissions. Further, according to RBI report, there has been a <span style=\"color: #ff0000;\">shortfall of 15% in the 15th FC recommended grants to ULBs<\/span> due to attached conditionalities.<\/p>\n<p><span style=\"color: #000000;\"><strong>Functional Challenges<\/strong><\/span><\/p>\n<p>1. <strong>Parastatal agencies-<\/strong> Various parastatal agencies created by the State government deny the local bodies their functional autonomy. <strong>For Ex-<\/strong> Creation of <span style=\"color: #ff0000;\">Urban development authorities<\/span> (for <span style=\"color: #ff0000;\">building infrastructure<\/span>), <span style=\"color: #ff0000;\">public corporations<\/span> (<span style=\"color: #ff0000;\">water, electricity, transportation services<\/span> etc).<\/p>\n<p>2. <strong>Improper Devolution of Functions-<\/strong> The power to devolve functions to local governments rests with the State Government. <span style=\"color: #ff0000;\">Most States have not devolved adequate functions to local government bodies<\/span>.<\/p>\n<p>3. <strong>Lack of constitution of District Planning Committee-<\/strong> The 74th amendment requires a<span style=\"color: #ff0000;\"> District Planning Committee to be set up in each district<\/span>, for the consolidation and integration of development plans prepared by the panchayats and urban local bodies. According to a study by the India Development Review, <span style=\"color: #ff0000;\">District Planning Committees are non-functional in 9 states. <span style=\"color: #333333;\">Further, in states where DPCs have been created, DPCs have <\/span><\/span><span style=\"color: #333333;\"><span style=\"color: #ff0000;\">failed to prepare integrated plans in 15 states<\/span>.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Functionaries Challenges<\/strong><\/span><\/p>\n<p>1. <strong>Delays in conduction of Elections to ULBs-<\/strong> There have been delays in conduction of elections to the urban local bodies by the state Govt, as no constitutional provisions for ensuring elections to ULBs. <strong>For Ex-<\/strong> <span style=\"color: #ff0000;\">BBMP<\/span>, the municipal corporation of Bangalore, has been <span style=\"color: #ff0000;\">without an elected body since late 2020.<\/span> There have been regular delays in conduction of <span style=\"color: #ff0000;\">MCD<\/span>, <span style=\"color: #ff0000;\">Chennai<\/span> and <span style=\"color: #ff0000;\">Mumbai Municipal Corporations<\/span>.<\/p>\n<p>2. <strong>Criminalisation of the ULBs-<\/strong> There has been <span style=\"color: #ff0000;\">increasing criminalisation of ULBs<\/span> as large number of corporators having <span style=\"color: #ff0000;\">criminal and corrupt backgrounds<\/span> getting selected to the corporations and councils.<\/p>\n<p>3. <strong>Corporator Pati-<\/strong> The real aim of political empowerment of women in urban areas has been thwarted by the emergence of <span style=\"color: #ff0000;\">Corporator pati\/Mayor Pati syndrome<\/span>.<\/p>\n<p>4. <strong>Bureaucratic control-<\/strong> Many cash rich corporations are <span style=\"color: #ff0000;\">controlled by the municipal commissioners<\/span> appointed by the state governments and with the Mayor just being a ceremonial head.<\/p>\n<p>5. <strong>Lack of Staff-<\/strong> There is <span style=\"color: #ff0000;\">huge shortage of skilled staff<\/span> in the Urban local bodies to carry out the designated functions entrusted to them. About <span style=\"color: #ff0000;\">35% of posts in India\u2019s municipal corporations are vacant<\/span> (as of 2022).<\/p>\n<p><span style=\"color: #000000;\"><strong>Functionality Challenge<\/strong><\/span><\/p>\n<p>1. <strong>Ensuring Planned Urbanisation-<\/strong> The municipal corporations have failed in comprehensively planning the holistic urban development. These have resulted in growth of <span style=\"color: #ff0000;\">unchecked slums<\/span>, <span style=\"color: #ff0000;\">traffic congestion<\/span> and <span style=\"color: #ff0000;\">colonies without proper facilities such as schools, parks and hospitals<\/span>.<\/p>\n<p>2. <strong>Corruption-<\/strong> The Corruption scandals, like <span style=\"color: #ff0000;\">MCD corruption in contract award<\/span>, have severely hampered the effective functionality of these bodies. Only <span style=\"color: #ff0000;\">11 of the 35 States\/Union Territories have enacted the Public Disclosure Law<\/span> that mandates publishing of key civic data.<\/p>\n<p>3. <strong>Lack of coordination-<\/strong> Poor coordination among <span style=\"color: #ff0000;\">centre, state, and various departments at local level<\/span> lead to poor implementation of urban policies.<\/p>\n<h2><span style=\"color: #000000;\"><strong><a id=\"toc4\"><\/a>What should be the way forward to improve the ULB functioning in India?<\/strong><\/span><\/h2>\n<p>The following recommendations of the 6th ARC on Urban Governance and NITI aayog&#8217;s recommendations must be implemented to ensure that the ULBs function as true instruments of local self-government in India.<\/p>\n<p><strong>6th ARC recommendations on Urban Governance<\/strong><br \/>\n1. <strong>Constitution of Metropolitan Planning Committee-<\/strong> The metropolitan Planning committee must be constituted to <span style=\"color: #ff0000;\">prepare development plan<\/span>, <span style=\"color: #ff0000;\">review and coordinate the plans of various local bodies<\/span> in India.<\/p>\n<p>2. <strong>Establishment of Unified Metropolitan Transport Authority (UMTA)-<\/strong> To integrate and manage <span style=\"color: #ff0000;\">public transportation services<\/span> and improve traffic management in the region.<\/p>\n<p>3. <strong>Strengthening of ULBs-<\/strong> <span style=\"color: #ff0000;\">Conduct regular elections<\/span>, devolve maximum functions and supplement the urban local bodies with adequate resources.<\/p>\n<p>4. <strong>Creation of National Urban Development and Housing Fund (NUDHF)-<\/strong> NUDHF must be created to provide <span style=\"color: #ff0000;\">financial assistance to ULBs for urban development<\/span> and housing projects.<\/p>\n<p>5. <strong>Implementation of PPP model and e-Governance-<\/strong> PPP model and e-Governance like <span style=\"color: #ff0000;\">citizen grievance redressal mechanism<\/span> must be adopted by the ULBs to enhance their transparency and accountability of functioning.<\/p>\n<p><strong>NITI Aayog&#8217;s Recommendations<br \/>\n<\/strong>1. <strong>Improving Financial Management of ULBs-<\/strong> ULBs must be provided <span style=\"color: #ff0000;\">adequate sources to raise their revenues<\/span>. Also, there must be an increase in the central devolution of funds by the Finance Commission. State Finance Commissions should be regularly constituted with clearly defined Terms of Reference (ToR).<\/p>\n<p>2.<strong> Capacity Building-<\/strong> <span style=\"color: #ff0000;\">Capacity building programs must be developed<\/span> for local government officials, urban planners and other stakeholders in urban governance.<\/p>\n<p>3. <strong>Strenghthening citizen participation-<\/strong> <span style=\"color: #ff0000;\">Ward committees and<span style=\"color: #333333;\"> other mechanisms like<\/span> NGOs and civil society organizations<\/span> must be used for strengthening citizen&#8217;s participation in the ULBs functioning.<\/p>\n<p><strong>CAG&#8217;s Recommendations for Strengthening ULBs<\/strong><\/p>\n<p>The CAG emphasized the urgent need for state governments to enhance ULB autonomy and participation in key areas like urban planning.
